SWFL.io republished a WINK News report dated September 30, 2026. It says the Lee County Sheriff’s Office identified Carli Michelle Heller, 30, of Bonita Springs, Florida. According to the arrest report as summarized by WINK, an account user identified as “Carli” wrote on September 26 that she would “shoot up” the sheriff’s office. The story says the platform’s safety and security measures monitored for key phrases and potentially threatening content, then escalated the messages to a human review team. That team reportedly contacted law enforcement. Deputies went to Heller’s home and detained her without incident. The report does not say that an automated system itself contacted police.
Lee County Sheriff Carmine Marceno told WINK that Heller later said she used AI like a “diary.” That characterization is reported secondhand through the sheriff, rather than in a direct statement from Heller in the available account.

What the arrest does—and does not—establish
Heller was charged with making a written threat of violence under Florida law. An arrest and charge are allegations, not a finding of guilt. WINK’s report said a court date was set for November, but did not provide a final case outcome. The available reporting also does not establish Heller’s own account, whether she had legal representation, what the AI replied, or the exact timing of the platform’s internal review.
How the incident compares with Anthropic’s published privacy terms
Anthropic’s privacy policy, effective September 10, 2026, says the company collects user inputs and outputs. It lists preventing or investigating abuse, policy violations and unlawful activity, as well as protecting safety, among its data uses. The policy also says Anthropic may disclose personal data to government authorities or law enforcement when it has a good-faith belief disclosure is reasonably necessary to prevent serious harm to a person or property, among other circumstances. Those are general policy terms, not an account of this incident. They do not independently verify what was sent to authorities, when any disclosure occurred, or the details of the review. WINK reportedly sought comment from Anthropic about the safeguards and disclosure process; its story did not include a company response.

Training-use controls and deletion
The policy says user inputs and outputs may be used to improve models unless a user opts out, with exceptions that include conversations flagged for safety review. It also says users can delete individual conversations from history and that deleted conversations are automatically removed from back-end systems within 30 days. The policy language does not establish that deletion would erase every record or prevent a safety-related or lawful disclosure in a particular case.

Why an AI conversation may feel private without being a private diary
WINK also quoted Ian Marlow, CEO of FITECH, on the conversational feel of AI: “Something that feels that it is conversational in nature doesn’t immediately feel like, ‘Oh, this is something that is being recorded,’ because they’re just having a conversation,” Marlow said.
Dr. Chrissann Ruehle, an assistant professor of AI and management at Florida Gulf Coast University, said: “There’s also a sense of, if I interact with a machine, the machine isn’t going to judge me,” Ruehle said. She added: “AI is not your best friend,” Ruehle said. “We need to keep in mind this is a technology.”

Those observations help explain why people may treat a chatbot as a confidant, but they do not change what a service’s privacy terms say. For conversations that could describe threats, plans to harm someone, or other serious risks, users should not assume the exchange has the confidentiality of a personal diary or a protected professional relationship.
What remains unknown
The available WINK account does not give a case disposition, describe any response from Heller, or explain what the AI said. It also does not report how long she had used the service or provide Anthropic’s case-specific explanation. Retired FBI Special Agent Richard Kolko told WINK: “This is all new stuff into the world and courts are still figuring it out,” Kolko said.
