Florida wins key ruling allowing enforcement of its social-media law for kids

Florida can enforce the challenged parts of its social-media law while the constitutional lawsuit continues. On October 14, 2026, a unanimous three-judge panel of the U.S. Court of Appeals for the Eleventh Circuit overturned the preliminary injunction that had blocked enforcement of HB 3 and sent the case back to federal district court in Tallahassee.

What the ruling means for Florida families

The decision removes the lower court order that had prevented Florida from enforcing the account-creation restrictions. It is an effective ruling for now, not a final resolution of whether HB 3 ultimately complies with the First Amendment.

The statute applies only to social-media services that meet a detailed definition. The age rules therefore do not automatically apply to every website, app or messaging service a child might use.

Age rules under Florida Statutes section 501.1736

Age What the statute allows What is restricted
Younger than 14 No covered-platform account may be created by the child. The child may not enter a contract to become a social-media account holder.
14 or 15 An account may be created only with affirmative parental consent. Creating the account without that consent is prohibited.
16 or older The statute’s account-creation limits do not apply. HB 3 sets no equivalent age restriction for this group.

The Eleventh Circuit emphasized that the law regulates a minor’s creation of an account, rather than imposing a universal ban on viewing a platform. The court said a minor may still use a service through a parent’s account or without an account, subject to the platform’s own rules.

Which platforms fall under HB 3?

A service is covered only when all of the statutory tests are satisfied. The definition is cumulative, so failing any one test places the service outside this particular account-creation regime.

  • At least 10% of the service’s daily active users younger than 16 spend an average of two hours or more per day on it.
  • The service uses algorithms that analyze user data to select content.
  • It has at least one listed addictive feature: infinite scrolling, push notifications or alerts, public interactive metrics, autoplay video or livestreaming.
  • Users can upload content or view other users’ content or activity.

The law excludes services whose exclusive function is private email or direct messaging among specifically identified recipients. A service that combines private messaging with public feeds or other covered functions would have to be evaluated against the full statutory definition rather than the exclusion alone.

Why the Eleventh Circuit allowed enforcement

The appellate panel treated HB 3 as a content-neutral speech regulation and applied intermediate scrutiny. That standard asks whether the law advances an important government interest without burdening substantially more speech than necessary.

The court identified four features it considered important to the law’s tailoring:

  1. The restrictions are calibrated by age instead of applying identically to every user.
  2. The statute regulates minors’ creation of their own accounts, not necessarily their access to platforms.
  3. It targets platforms shown by the statutory threshold to be heavily used by children.
  4. It reaches services only when algorithmic content selection is combined with at least one specified addictive feature.

“HB3 doesn’t ‘burden substantially more speech than necessary’ because it (1) calibrates its restrictions by age, (2) regulates minors’ creation of social-media accounts, not necessarily their access to the platforms themselves, (3) covers only those platforms that have been determined to induce heavy use by children, and (4) applies only to platforms that use both algorithms and one of several addictive features.”

That reasoning addresses the preliminary-injunction stage. The district court must still decide the underlying claims, and the appellate ruling does not establish that every implementation detail will survive later challenges.

Enforcement powers and potential money at stake

Florida’s Department of Legal Affairs can pursue an unfair- or deceptive-trade-practice action against a platform that violates the statute. The law also creates a private damages path for qualifying minor account holders.

How the case reached this point

Date Event
October 2024 CCIA and NetChoice sued, arguing that HB 3 violated providers’ and users’ First Amendment rights.
2025 The federal district court granted a preliminary injunction blocking enforcement of the challenged provisions.
During the appeal The Eleventh Circuit stayed the injunction while it reviewed the district court’s order.
October 14, 2026 A unanimous Eleventh Circuit panel overturned the injunction, allowing enforcement and returning the case to the district court in Tallahassee.

What happens next?

The district court will continue with the merits of the lawsuit. The parties may file additional motions, and the case could proceed to a final judgment. Rehearing before the Eleventh Circuit or review by the U.S. Supreme Court remain possible, so the legal position could change again.

NetChoice lawyer Paul Taske said the organization was evaluating its options and would continue fighting to protect Floridians’ online free-expression rights while keeping parents in control of family decisions. That statement signals continued litigation, but it does not itself change the effect of the October 14 ruling.

What the ruling does not establish

No authoritative published statistic currently measures the ruling’s real-world effect on youth mental health, account removals or platform compliance. The appellate decision resolves the injunction question; it does not supply a post-ruling impact study or a final judgment on those outcomes.
