The Florida Department of Transportation revoked permits for automated license plate readers (ALPRs) in state-highway rights-of-way, and agencies had until September 30, 2026, to remove covered equipment. Cameras on local roads were outside that removal order. Miami Beach’s mayor proposed putting new readers on private property with owners’ permission, but that proposal is not proof of an adopted plan—or of a police scheme to evade the order.
What did Florida order agencies to remove?
FDOT’s action concerned ALPR systems installed within rights-of-way on the State Highway System. It was not a statewide prohibition on Flock technology or on all license plate readers. The order also did not require cameras on local roads to be removed, according to Spectrum News’ September 2026 reporting.

Florida Statute §316.0777 defines an ALPR system as one or more mobile or fixed high-speed cameras paired with algorithms that turn plate images into computer-readable data. The statute allows FDOT, at its discretion, to permit a system in a state-highway right-of-way when a law-enforcement agency requests it for active criminal intelligence or active criminal investigative information. These systems cannot be used to issue traffic-infraction notices or uniform traffic citations.

When was the deadline, and what had agencies done?
Spectrum News reported that FDOT revoked permits on August 31, 2026, starting the statutory 30-day removal period. The deadline was September 30. The reporting available on deadline day was a snapshot of agency responses, not a complete statewide audit.

- Osceola County: The sheriff’s office said it had removed 35 devices from state-road rights-of-way and canceled its Flock contract on September 22.
- Lake County: The sheriff’s office said it had disabled access, but had not confirmed that the equipment had been physically removed.
- Okaloosa County: The sheriff’s office said it would remove its remaining devices on county rights-of-way as well—a broader response than the state-road order alone required.
Those reports describe different actions: taking equipment down, disabling access, or voluntarily removing equipment from additional locations. They do not establish the final status of every affected camera across Florida.
Where is the geographic gap?
The order’s reach depends on the location of the camera. A state-highway right-of-way is not the same as a local-road right-of-way or private property. The available reporting says the order did not require removal from local roads; it does not establish that every installation outside a state-road right-of-way is automatically permitted.

| Location | What the FDOT action required | What the sources establish |
|---|---|---|
| State Highway System right-of-way | Remove equipment covered by the revoked permits within 30 days of notice. | FDOT’s action and September 30, 2026 deadline were reported by Spectrum News. |
| Local-road right-of-way | No removal requirement under the FDOT action described in the reporting. | Spectrum News reported that local-road cameras were outside the order; other local rules may still apply. |
| Private property | No private-property removal requirement is established by the FDOT action described here. | Florida Senate staff analysis says state law was silent on private-sector ALPR use; that is not a definitive ruling that any specific installation is lawful. |
Did police move cameras to exploit that gap?
The sources show a location-based boundary and proposals that could put readers outside state-road rights-of-way. They do not prove that police broadly relocated cameras to circumvent FDOT’s action. “Loophole” is therefore best understood as shorthand for the order’s narrower geographic scope, not as an established statewide evasion scheme.

Axios reported on September 4, 2026, that Mayor Steven Meiner proposed allocating up to $50,000 for readers on private property with owners’ permission. Meiner said the city operated about 40 ALPRs, roughly half of them on state roads. The report described a proposal on a commission agenda; it did not establish that the allocation was approved or that cameras were moved in response to FDOT.

The cameras are designed to work with the included aosuBase, and add-on cameras connect through the base as well.
Commissioner David Suarez separately proposed a 90-day pause on new installations and additional oversight safeguards. That was also a proposal, rather than a confirmed citywide policy change.
St. Lucie County: an authorization problem, not proof of relocation
On October 2, 2026, TechRadar reported that authorities had found 14 unauthorized Flock devices along county roads. The sheriff’s office claimed three, though the report said they had been installed without necessary permits; the operators of the other 11 were unknown at publication. County authorities gave owners 30 days to come forward.

The report raises questions about who owns and authorizes equipment on county roads. It does not say the devices were moved from state roads or establish that police installed them to get around FDOT’s order.

Florida’s statute treats specified ALPR images and data containing personal identifying information as confidential and exempt from ordinary public-record disclosure. It permits disclosure to or by criminal-justice agencies carrying out official duties. An individual may access information associated with their own plate, subject to an exception for an active investigation.

A Florida Senate staff analysis for HB 543 describes a retention schedule of no longer than three years unless retention is otherwise required. That is a maximum described in the analysis, not evidence that every agency keeps every record for three years.
The same staff analysis says Florida law was silent on private-sector ALPR use and describes private ALPR companies compiling data and partnering with local governments and law enforcement. It is legislative staff analysis, not a court ruling that any particular camera placement, data-sharing arrangement, or police access is lawful. Property permission, right-of-way boundaries, local rules, and the distinction between private operation and government access can all matter.
What the order does—and does not—say about legality
Okaloosa County Sheriff Eric Aden said on August 31, 2026: “Though LPR technology has not been ruled unconstitutional, nor did the Governor determine it unlawful or illegal through legislation, the FDOT Memorandum eliminates our ability to use them.” His statement describes his office’s position on the effect of FDOT’s action; it does not settle the broader legal questions about ALPR surveillance or private installations.
For readers trying to understand whether a nearby camera had to come down, the key distinction is its location and authorization—not simply whether it is a Flock-branded device. The reporting cited here does not provide an independently verified statewide camera count or a statewide post-deadline compliance audit.
