Flock’s roadside license-plate-reader network and robotaxi cameras create different kinds of privacy exposure. Flock’s cameras capture vehicle plates and related images at fixed locations; robotaxis use exterior sensors for driving and may also have cabin cameras or microphones for rider support and safety. Each system’s reach depends on its settings, customer choices and policies. The companies’ published materials describe intended practices, not independent proof that every safeguard is followed.
What each system sees—and why
Flock Safety’s automated license-plate readers (LPRs) are fixed roadside cameras. Flock says its system can be used by law enforcement, private neighborhoods and businesses. Customers may choose to share their data with law enforcement. The core function is to capture and search vehicle reads, rather than to record every person continuously.

Robotaxis carry sensors through public streets and can also have cameras inside the passenger cabin. Waymo says its exterior cameras contribute to a 360-degree perception system used to identify roadway conditions such as traffic lights and construction zones. Its outside microphones are intended to detect emergency sirens, with safeguards intended to limit collection of human voices. Waymo says in-car cameras support rider assistance and operational checks.

Tesla’s Robotaxi privacy notice distinguishes standard rides from early access. It describes additional data collection by default for early-access riders; for standard rides, cabin-camera and sound-detection collection are not on by default except for specified needs. Tesla also describes anonymous recordings from exterior cameras for fleet learning. “Anonymous” describes how the notice characterizes those recordings; it does not by itself establish that the surrounding trip or vehicle activity has no privacy implications.

How long is the information kept?
| System | Published retention information | Qualification |
|---|---|---|
| Flock LPR | Seven calendar days as the standard period; up to one year for discretionary extended retention | Flock’s Evidence Policy, current text last updated August 12, 2026, says customer agreements or legal requirements can set a different period. A discretionary extension requires approval from an elected official and/or governing body. |
| Waymo vehicle cameras and sensors | No comparable overall retention period stated in the cited Waymo materials | Waymo Help and its August 24, 2026 privacy statement describe purposes and handling, but do not give one overall retention figure comparable to Flock’s standard. |
| Tesla Robotaxi | No comparable overall retention period stated in the cited notice | Tesla’s notice says certain safety-event camera clips can be up to 30 seconds long. That is a clip-length limit, not a total data-retention period. |
Flock’s policy says LPR data is hard-deleted after the applicable retention period, subject to longer periods required by law or customer agreements. Separately, the Associated Press reported on August 13, 2026, that Flock had announced platform changes amid public backlash: reducing the standard period from 30 days to seven, preserving case-linked evidence, and requiring law-enforcement customers to use audit tooling and case codes for searches. The AP reported that those changes were due by January 1; its report establishes an announcement and deadline, not completion across every customer.
Who can access or share the data?
Flock: customer decisions and law-enforcement searches
Flock’s stated model includes different kinds of customers, and customers may choose to share data with law enforcement. That is not the same as a claim that all Flock data is universally available to every agency. The access path depends on the customer’s sharing choices and applicable legal requirements.

In an October 16, 2025 letter to Flock CEO Garrett Langley, Senator Ron Wyden’s office said Flock had told it that 75% of law-enforcement customers were enrolled in the National Lookup Tool. The figure is what the senator’s office said Flock provided; it is not an independently audited count or a current enrollment rate. The letter also raised concerns about Customs and Border Protection access and audits. Those concerns and findings should be read as the senator’s dated oversight account, not as a universal access rule.

Tesla: notice-specific data practices
Tesla’s Robotaxi notice sets out different default collection practices for standard and early-access rides and describes safety-event clips and exterior-camera fleet-learning recordings. Those distinctions matter: a description of data collected in an early-access program should not be applied automatically to every standard ride.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Are the robotaxi cameras “watching” riders?
“Watching” captures the concern but can overstate what the published descriptions establish. A roadway camera used to perceive traffic, a cabin camera used for rider assistance and a microphone listening for sirens are different sensors with different purposes. The presence of a sensor does not establish that it continuously records, identifies a person or sends every sound or image to a human reviewer.

Waymo says its vehicle cameras support mapping, safe service delivery and technology improvement, not surveillance or biometric identification. It also says it does not sell personal information collected by vehicle cameras and sensors. Those are Waymo’s descriptions of its own practices. Its Help documentation says outside microphones are intended to detect emergency sirens with safeguards to limit human voice collection, and says riders are heard when they are on a Support call or actively choose to have microphones on.
Tesla’s notice similarly makes the ride type and stated exception relevant: standard rides do not have cabin-camera and sound-detection collection on by default except for specified needs, while early access has additional default collection. Neither company’s published statements, on their own, amount to an independent audit of actual operation.
What safeguards and accountability are established?
- Retention limits: Flock publishes a seven-calendar-day standard and describes exceptions and approval for discretionary extension. The cited Waymo and Tesla materials do not give an equivalent overall retention number.
- Access controls: Flock’s policy and the reported platform changes describe controls around retention and law-enforcement searches. The AP’s account is of announced changes and does not verify implementation across all customers.
- Legal disclosure rules: Waymo says it directs law-enforcement agencies to valid legal process and may disclose information for specified legal, agreement-enforcement or safety reasons.
- Purpose and collection statements: Waymo and Tesla describe particular sensor functions and collection settings. These statements are useful for understanding their stated practices, but they are not independent evidence of compliance.
- Oversight claims: Wyden’s October 2025 letter records his office’s account of Flock’s National Lookup Tool enrollment figure and concerns about access and audits. It should not be treated as a present-day audit or a universal description of access.
How to read the comparison
These systems should not be collapsed into one category of “surveillance.” Flock’s network is a customer-operated roadside vehicle-search system with a published standard retention period and customer sharing choices. Robotaxis are moving sensor platforms whose cameras and microphones are described as supporting driving, safety, rider support or technology improvement; the available notices distinguish vehicle exterior from cabin collection and, for Tesla, standard rides from early access.
The practical privacy questions are therefore specific: what sensor is involved, what function it serves, whether data is linked to a vehicle or account, how long it is retained, who can request or search it, and what record or audit exists when someone does. The cited company policies and notices answer some of those questions, but they do not provide a harmonized, independently audited comparison of real-world retention, access and compliance across Flock, Waymo and Tesla.
