Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteFATCA and CRS are information-sharing systems, not interchangeable names for your personal tax filings. FATCA is a U.S. law that reaches foreign financial institutions and certain U.S. taxpayers. CRS is an OECD-developed standard under which participating jurisdictions collect account information and exchange it annually. Neither system, by itself, tells you whether you must file a U.S. tax return, Form 8938, or an FBAR.
A U.S. citizen or resident alien generally remains subject to U.S. tax rules on worldwide income while living abroad. You must separately test the requirements for your income-tax return, Form 8938 (filed with that return), and FinCEN Report 114, commonly called the FBAR. One filing does not replace another.

The short answer: FATCA, CRS, Form 8938 and FBAR are different things
When a bank asks for a FATCA or CRS self-certification, it is complying with information-reporting rules that apply to the institution and its customers. That request does not determine whether you personally owe U.S. tax or must file a U.S. form.

| FATCA | U.S. law enacted in 2010 | Foreign financial institutions, partner governments and certain U.S. taxpayers | Usually to the IRS, directly or through a partner government under an agreement |
| CRS | OECD standard approved July 15, 2014 | Financial institutions in jurisdictions that implement it, with their tax authorities | Among participating jurisdictions’ tax authorities through annual automatic exchange |
| Form 8938 | U.S. individual information return for specified foreign financial assets | A taxpayer who meets the applicable filing thresholds | Attached to the federal income-tax return and filed with the IRS |
| FBAR (FinCEN Report 114) | U.S. report of foreign financial accounts | A U.S. person who meets the account-value and ownership or authority tests | Filed electronically with FinCEN through the BSA e-file system |
An overseas bank can report information under FATCA or CRS while you still have separate U.S. filing duties. Conversely, filing an FBAR or Form 8938 does not make a bank’s FATCA or CRS classification unnecessary.

What FATCA does
The Foreign Account Tax Compliance Act (FATCA) has two related sides. First, it requires certain foreign financial institutions to identify and report accounts held by U.S. persons under the applicable rules. Second, it requires certain U.S. taxpayers to disclose specified foreign financial assets on Form 8938 when the statutory thresholds are met.
How foreign-bank reporting works
FATCA implementation depends on the country and the agreement in force. Under a Model 1 intergovernmental agreement, a financial institution generally reports to its own government, which then exchanges information with the IRS. Under a Model 2 arrangement, institutions can have specified direct-reporting obligations to the IRS, subject to local rules and consent procedures. FATCA also contains withholding rules for certain withholdable payments. Those bank-facing and payment rules are not a substitute for a taxpayer’s return-based disclosures.
What a FATCA request from a bank means
A bank may ask whether you are a U.S. citizen, U.S. resident for tax purposes, or otherwise a U.S. person. It may request a Form W-9, a foreign-status form, a taxpayer identification number, or documentary evidence. The institution is determining how to classify and report the account under the law and the relevant local agreement. It is not deciding whether your income is taxable or whether you have met every U.S. filing requirement.

The OECD’s Common Reporting Standard calls on participating jurisdictions to obtain information from financial institutions and automatically exchange that information with other jurisdictions every year. The standard specifies the categories of financial institutions and accounts covered, the taxpayer information to collect, and common due-diligence procedures. OECD materials were amended in 2023, so technical definitions can change over time.

CRS is implemented country by country
CRS is not one worldwide return that a U.S. account holder files. Each participating jurisdiction adopts domestic rules, identifies its exchange partners, and sets procedures for financial institutions. Whether a particular account is reportable can depend on the institution’s classification, the account type, your tax residence, the relevant tax year, and whether an exchange relationship is active between the countries.
Does CRS apply to U.S. citizens?
A U.S. citizen who keeps an account in a CRS-implementing country may be asked to complete a CRS tax-residency self-certification. The bank may use that information under local law even though the United States relies primarily on FATCA for its own account-information exchanges. CRS onboarding does not create a U.S. filing form, and it does not eliminate U.S. filing obligations. For a specific country, check that country’s current tax-authority guidance and exchange relationships for the year in question.
Your first obligation: determine whether a U.S. tax return is required
The IRS states that U.S. citizens and residents abroad generally have filing responsibilities similar to those living in the United States. Living outside the country does not, by itself, end U.S. tax residence or remove the need to report worldwide income. Wages, business income, interest, dividends, rents, pensions and gains may all be relevant to the U.S. return, subject to the rules and relief provisions that apply to your facts.
Account-information reporting and income taxation are separate questions. A bank’s FATCA or CRS report may identify an account, but it does not calculate your taxable income. Likewise, an account that produced no income can still be relevant to Form 8938 or the FBAR if the applicable asset or account tests are met.

FBAR: the separate FinCEN report
When the general FBAR test is met
A U.S. person generally must file FinCEN Report 114 when they have a financial interest in, or signature authority or other authority over, foreign financial accounts whose combined value exceeded $10,000 at any time during the calendar year. The test is based on the aggregate maximum value of qualifying accounts, not merely the balance on December 31.
Foreign bank accounts are the most familiar example, but the definition can include other financial accounts maintained outside the United States. Ownership, control, signature authority, and special exceptions can change the result, so do not assume that an account in someone else’s name is irrelevant if you can direct it.
Where and how to file
- Collect the legal name and address of each foreign financial institution, account number or other identifier, account type, ownership status, and maximum value during the calendar year.
- Convert values using a consistent method and determine the highest aggregate amount reached during the year.
- Complete FinCEN Report 114 electronically through the BSA e-file system.
- Do not attach the FBAR to Form 1040 or another federal income-tax return. It is a separate FinCEN filing.
FinCEN’s current instructions control filing deadlines, extensions, exceptions and treatment of special ownership situations. The $10,000 figure is the general threshold described by current IRS guidance; it is not a universal answer to every account-reporting question.

Thresholds depend on residence and filing status
The IRS international-tax FAQ gives these examples for unmarried U.S. residents: filing is generally triggered when specified foreign financial assets exceed $50,000 on the last day of the tax year or $75,000 at any time during the year. For married taxpayers filing jointly who are U.S. residents, the examples are $100,000 at year end or $150,000 at any time.
| Illustrative filer category | Year-end amount in the IRS example | Any-time amount in the IRS example | Important qualification |
|---|---|---|---|
| Unmarried U.S. resident | More than $50,000 | More than $75,000 | Example thresholds from the IRS FAQ updated February 26, 2024; not universal |
| Married filing jointly, U.S. resident | More than $100,000 | More than $150,000 | Example thresholds from the same FAQ; other residence and filing situations differ |
| Taxpayer living abroad or another filing status | Not stated in the cited example | Not stated in the cited example | Use the current Form 8938 instructions for the applicable residence and filing status |
These examples must not be applied automatically to a taxpayer living abroad, filing separately, or meeting another special category. The current form instructions determine the threshold for the tax year and status involved.
Form 8938 does not replace the FBAR
The IRS expressly says that the Form 8938 filing requirement does not replace or otherwise affect a taxpayer’s obligation to file an FBAR. You may need both, one, or neither. The same bank account can appear on both forms, while an investment asset held outside a financial account may be reportable on Form 8938 without being an FBAR account.
FATCA versus CRS: a detailed comparison
| Comparison point | FATCA | CRS |
|---|---|---|
| Legal source | U.S. federal law enacted in 2010 | OECD-developed international standard approved July 15, 2014 |
| Primary purpose | Identify and report certain accounts held by U.S. persons and require specified individual disclosures | Enable participating jurisdictions to collect and exchange financial-account information about tax residents |
| Institutional duty | Certain foreign financial institutions report under FATCA rules and applicable agreements | Financial institutions in implementing jurisdictions perform due diligence and report to their local tax authority |
| Government-to-government path | Model 1 commonly routes data through a partner government; Model 2 can involve direct reporting to the IRS in specified circumstances | Local tax authorities exchange information annually when an activated relationship exists |
| Individual U.S. form | Form 8938 for taxpayers meeting specified-asset thresholds | No single CRS personal filing form for U.S. account holders |
| Account and asset scope | Defined FATCA account categories plus specified foreign financial assets for Form 8938 | Common reporting and due-diligence categories set by the standard and local implementation |
| What it does not decide | Whether all foreign income is taxable or whether an FBAR is required | Whether a U.S. tax return, Form 8938 or FBAR is required |
When the same account appears on multiple reports
Example: one account, two U.S. filings
Suppose a U.S. person has a foreign savings account that reaches $12,000 during the year. The amount exceeds the general FBAR threshold, so an FBAR may be required. If the person’s total specified foreign financial assets also exceed the applicable Form 8938 threshold, the account can be listed on both reports. The forms serve different agencies and ask for different information.
Best Value
Example: Form 8938 asset without an FBAR account
A foreign investment asset held directly outside a financial account may fall within Form 8938’s specified-asset categories even though it is not a reportable foreign financial account for FBAR purposes. The reverse can also occur when an account is relevant to FBAR but the taxpayer does not meet the Form 8938 threshold.
Example: authority without beneficial ownership
Someone with signature or other authority over an employer’s foreign account may face an FBAR question even without owning the funds. Exceptions and employer-account rules are technical; obtain advice rather than assuming that no personal ownership ends the analysis.
A practical process for U.S. taxpayers with overseas accounts
- Confirm your U.S. status for the year. Determine whether you are a U.S. citizen, resident alien, or another category and whether a federal income-tax return is required.
- Inventory every foreign account and asset. Record ownership, financial interest, signature or other authority, account type, institution, currency, and the highest value reached during the year.
- Test the FBAR separately. Add the maximum values of qualifying foreign financial accounts and compare the aggregate with the $10,000 general threshold.
- Test Form 8938 separately. Classify each specified foreign financial asset, apply the residence and filing-status threshold for the year, and follow the current form instructions.
- Prepare the correct filing channels. Attach Form 8938 to the income-tax return. File an FBAR electronically through FinCEN’s BSA e-file system; do not attach it to the return.
- Answer bank questionnaires accurately. Identify whether the request concerns FATCA status, CRS tax residence, or both. Ask which local law and legal regime govern the request, especially if you have more than one tax residence.
- Review special facts before filing. Joint accounts, community-property rules, trusts, partnerships, corporations, retirement arrangements, delegated authority and late or amended filings can change the analysis.
- Check current-year instructions. Thresholds, exceptions, deadlines and penalties are tax-year specific. Reconfirm them each year rather than reusing an old form or prior-year conclusion.
Penalties and omitted accounts
The IRS FATCA-reporting summary lists a $10,000 failure-to-file penalty for Form 8938, with an additional penalty of up to $50,000 for continued failure after IRS notification and a 40% penalty on an understatement of tax attributable to undisclosed assets. The IRS also says reasonable cause may prevent a Form 8938 penalty, determined case by case. These figures describe Form 8938 consequences and should not be treated as an automatic or complete statement of every penalty, nor as a substitute for the separate FBAR penalty rules.
If you discover an omitted account or asset, stop and reconstruct the facts before filing a late or amended report. Gather statements, maximum balances, ownership documents and prior returns. Entity, trust, signature-authority and delinquency issues can involve additional procedures, so individualized advice from a qualified U.S. international tax professional is appropriate when the facts are complex.
Common mistakes to avoid
- Treating CRS or FATCA onboarding as a tax return. A self-certification tells a bank how to classify an account; it does not report all income or satisfy U.S. forms.
- Using the $10,000 FBAR threshold for Form 8938. FBAR and Form 8938 have different scopes and thresholds.
- Assuming one form covers the other. The IRS explicitly says Form 8938 does not replace the FBAR.
- Checking only December 31 balances. FBAR uses the highest aggregate value reached at any time during the calendar year.
- Applying U.S.-resident Form 8938 examples to an overseas resident. Residence and filing status can produce different thresholds.
- Assuming every country exchanges with every other country. CRS participation, domestic implementation and activated exchange relationships must be checked for the relevant country and year.
- Ignoring authority over an account. FBAR analysis can involve signature or other authority even when you are not the beneficial owner.
- Reusing an old year’s instructions. Forms, definitions, exceptions and penalties can change.
What to ask a tax professional
Professional help is not automatically required, but it can prevent costly errors when your situation is not a simple individual bank account. Bring a list of every account and asset, peak balances, account statements, ownership and authority documents, prior U.S. returns, and copies of any FATCA or CRS forms supplied by financial institutions. Ask the adviser to address, separately:
Quick Recap
- whether you must file a U.S. income-tax return and how worldwide income is reported;
- whether Form 8938 applies for the specific tax year, residence and filing status;
- whether an FBAR is required, including accounts over which you had authority;
- how jointly held accounts, entities, trusts and retirement arrangements are treated;
- what correction or late-filing path is available if an account was omitted; and
- which country-specific CRS rules and exchange relationships affect a bank’s request.
