FAQ: Using AI-Generated Content in Open-Source Software

By Freedom251 Team · · 8 min read

Yes, you can often submit AI-assisted code to an open-source project, but there is no universal permission or disclosure rule. The project’s current contribution policy, the AI service’s terms, your employer’s requirements, and the code’s licensing history all matter. You remain responsible for correctness, security, attribution, and license compatibility even when a model produced the first draft.

Use AI output as untrusted contribution material: verify it, test it, investigate any recognizable third-party code, and disclose its use exactly where the project asks. A disclosure label provides context; it does not transfer responsibility to the tool or guarantee acceptance.

Why one open-source answer does not fit every project

Open-source projects set their own contribution rules. A foundation-level recommendation is not a substitute for the repository’s current documentation, maintainers’ instructions, a contributor license agreement (CLA), or a developer certificate of origin (DCO). The Linux Foundation’s Guidance Regarding Use of Generative AI Tools for Open Source Software Development says projects and employers may impose more stringent requirements and that development and review of AI-generated code should be treated no differently from other code.

Before preparing a patch, identify the rules that apply to this particular repository and version of its policy. Check whether AI-assisted contributions are permitted, whether certain tools or output sources are prohibited, when disclosure must occur, how long that disclosure is retained, and what review or sign-off is required.

Question to compare Why it matters
Are AI-assisted contributions allowed? A project can permit, restrict, or temporarily prohibit particular uses.
When and how must use be disclosed? The required record may be a commit trailer, pull-request note, or another project-defined format.
Which tools or sources are acceptable? Terms, privacy settings, training-data concerns, or prohibited services can affect eligibility.
Who handles licensing and attribution? The contributor generally must identify third-party material and preserve required notices.
What human review is required? Projects may require tests, security review, maintainer approval, or sign-off regardless of AI use.
Do employer, CLA, or DCO rules add conditions? Your ability to grant rights or certify authorship may be constrained outside the repository.

Step 1: Read the project’s rules before generating or submitting code

  1. Read contribution and AI-use documents. Look in the repository’s contributing guide, governance pages, policy directory, and pull-request template. Check the document’s revision date and apply the latest version.
  2. Read the project license and contribution agreement. A CLA or DCO can require you to have the necessary rights and to make a personal certification. Do not sign a statement you cannot support because a model wrote part of the patch.
  3. Check employer instructions. An employer may require an approved service, prohibit confidential input, or demand an internal review and disclosure record. Those requirements can be stricter than the project’s.
  4. Ask maintainers when the rule is unclear. Keep the question specific: identify the tool, whether it generated or merely edited text, and where you propose to disclose it. Preserve the answer with your contribution records.

Do not assume that publicly visible source is free to copy. GitHub’s licensing documentation explains that, without a license, default copyright law applies; visibility on a hosting site does not itself grant permission to reproduce, distribute, or make derivative works.

Step 2: Check the AI service’s terms and your intended license

Read the service terms that apply to the account and model you used. Focus on provisions covering output rights, restrictions on use, confidentiality, retention, and any limits on assigning or licensing output. The relevant question is not simply whether you may view the output, but whether you can contribute it under the project’s license and any CLA or DCO.

  • Record the service and model version, date of use, and whether you supplied proprietary or confidential material.
  • Confirm that the terms do not restrict redistribution, sublicensing, or publication under the target project’s license.
  • Remove secrets, credentials, private source, personal data, and non-public customer material from prompts unless your employer expressly permits that use.
  • Keep the terms version or account record that governed the generation if your organization requires an audit trail.

A tool’s statement that it generated an answer does not establish that the answer is original or unencumbered. Treat output as material that still needs provenance and license review.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Step 3: Investigate third-party code and other protected material

Models can reproduce code, comments, documentation, or data that resembles material found in their training sources. Do not infer originality from the fact that a tool produced the text. Compare distinctive snippets, unusual comments, APIs, and generated documentation against likely upstream sources and your project’s existing dependencies.

When you find a possible match

  1. Identify the source. Locate the repository, file, release, or publication and save the exact version or commit where possible.
  2. Read its license and notices. Determine whether the terms are compatible with the destination project and whether attribution, notice preservation, source disclosure, or patent conditions apply.
  3. Choose a compliant path. Keep the material only when permission and license compatibility are established; otherwise rewrite it independently, replace it, or ask the copyright holder for permission.
  4. Carry notices forward. Put attribution and license text in the location required by the source license and the project’s conventions.
  5. Tell reviewers what changed. Explain the provenance decision in the pull request or commit record without claiming certainty you do not have.

These steps apply to code as well as copied documentation, images, test fixtures, data, and snippets embedded in comments. A clean scan is not proof that no third-party material exists.

Step 4: Review, test, and secure the contribution as ordinary project work

OpenInfra Foundation policy states: “As a contributor, you are responsible for the code you submit, whether you use AI tools or write it yourself.” Its guidance calls for review of correctness, quality, style, security, and licensing. Run the project’s normal checks and add targeted checks for risks that generated code commonly introduces.

Minimum review checklist

  • Read every changed line; do not approve a patch from a model transcript without understanding it.
  • Run unit, integration, regression, and platform-specific tests required by the project.
  • Check input validation, authorization, secrets handling, dependency versions, error paths, concurrency, and resource limits.
  • Compare behavior with the project’s documented API, style guide, and supported versions.
  • Inspect new dependencies and transitive licenses; remove unnecessary packages.
  • Test failure cases and adversarial inputs, not only the example supplied in the prompt.
  • Ask another qualified contributor to review high-risk changes such as cryptography, authentication, parsers, build tooling, or deployment scripts.

Disclosure does not replace review. OpenInfra explicitly says its disclosure label is context and is not, by itself, grounds for rejection.

How projects ask contributors to disclose AI use

Disclosure requirements differ in timing, wording, and retention. Follow the target project’s convention instead of copying an example mechanically.

Project or guidance Example requirement Practical implication
Open Source Robotics Foundation (OSRF) Disclose use at contribution time; the disclosure lasts as long as the contribution. Put the disclosure in the contribution record specified by OSRF and do not remove it from later history.
OpenInfra Foundation Recommends an Assisted-By: commit label with useful context. Use the project’s exact trailer format and identify the assistance clearly enough for reviewers and maintainers.
Apache Software Foundation Recommends noting tooling in a commit message. Describe the tool’s role in the commit record while still meeting Apache’s normal licensing and review rules.
Other projects May use a pull-request field, issue comment, signed-off-by process, or no written AI rule. Ask maintainers rather than assuming that silence means permission or that a foundation’s example applies.

What useful disclosure contains

Where permitted, include the tool name, model or version when known, the kind of assistance (for example, draft, refactor, test generation, or documentation), and enough context for a reviewer to understand what you personally checked. A project may ask for a shorter label; comply with that format rather than adding a private narrative to public history.

Illustrative labels include Assisted-By: tool-name or Generated-by: tool-name version. These are examples, not universal syntax. Never insert a label that conflicts with the repository’s required trailers or falsely suggests that the tool is an author or signatory.

Using license scanners and SPDX identifiers correctly

Software composition analysis and license-scanning tools can help inventory dependencies, recognize license texts, and flag suspicious matches. SPDX identifiers make license metadata more consistent and can improve the accuracy of composition-analysis reports. Use these tools as evidence for investigation, not as a completeness guarantee.

  • Scan the final tree, generated files, vendored code, tests, documentation, and build artifacts that will be distributed.
  • Review every finding against the actual file and upstream source; scanners can miss novel, modified, or embedded material and can produce false positives.
  • Record the license and version of each accepted dependency and preserve required notices.
  • Escalate uncertain or conflicting results to a maintainer or qualified legal adviser before merging.

Apache guidance cautions that tools and code scanning cannot establish that all third-party material is absent. A passing report therefore cannot substitute for human provenance review.

Copyrightability is separate from permission to contribute

Whether a person can claim copyright in an output is a different question from whether the project may receive and distribute it. Apache’s summary of U.S. Copyright Office guidance says purely AI-generated output is not copyrightable in the United States under that guidance, while human-authored selection, arrangement, or modification may be protected. The legal position can differ by jurisdiction and remains unsettled for some fact patterns.

That uncertainty does not automatically make a contribution unusable. A project still needs permission to use any third-party material, and a contributor still needs authority to make the representations required by a CLA or DCO. Conversely, adding substantial human-authored work may create protectable material without changing the license obligations attached to code copied from elsewhere.

If a dispute turns on a particular output, contract term, contributor certification, or country, obtain advice from a qualified lawyer familiar with copyright and open-source licensing. Do not promise that AI code is automatically open source, and do not claim that it can never be copyrighted.

Practical decision tree for a proposed patch

  1. Project rule found and AI use allowed? If no, stop and ask maintainers for a written exception or use a non-AI workflow.
  2. Tool terms compatible with the intended contribution? If uncertain, do not submit the output until the terms are clarified.
  3. Third-party material identified? If yes, verify permission, compatibility, and notices; if that cannot be done, replace the material.
  4. Patch fully understood and tested? If no, continue review and testing before opening a pull request.
  5. Disclosure format known? Add the required label or explanation at the required time and retain it as the policy specifies.
  6. CLA, DCO, or employer certification accurate? Sign only when you can truthfully make the required representations.

Common mistakes and how to correct them

“The model generated it, so it is automatically original.”

Generation does not prove provenance. Investigate distinctive passages, identify sources, and apply compatible licensing and attribution rules.

“The repository has no AI paragraph, so anything is allowed.”

General contribution, license, CLA, DCO, security, and employer rules still apply. Ask maintainers when the absence of an AI-specific rule leaves a material uncertainty.

“A scanner found no license issue, so the patch is clear.”

Scanners assist review but cannot prove that all third-party material is absent. Read the code and investigate matches manually.

“Disclosure shifts responsibility to the tool.”

It does not. The contributor remains accountable for correctness, security, quality, and licensing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“A public repository can be copied because anyone can view it.”

Without a license, default copyright law applies. Obtain permission or choose material whose license authorizes the intended use.
