Families of Madison Mogen, Ethan Chapin and Kaylee Goncalves have sued in Walla Walla, seeking to stop public-records requesters from obtaining data extracted from the victims’ phones, according to an October 2, 2026, report by The Spokesman-Review. The dispute is about access to investigative records and the privacy of people whose communications may appear in them—not Bryan Kohberger’s completed criminal case.
What the Walla Walla lawsuit seeks
The families filed the action the previous week, the newspaper reported. It describes the suit as seeking to bar “avid requesters” from accessing the victims’ phone data. Six people had requested records connected to the phone extractions.

The report says no family member of Xana Kernodle, the fourth victim, is named in this particular suit. That does not change that Kernodle was one of the four students killed.
Which phone records were requested
The requests reportedly seek the “full digital extraction files” from the victims’ phones, as well as metadata, photographs, screenshots, emails and other documentation collected during the investigation. The report says the complaint characterizes the requests as overly broad and burdensome for city staff.

The request’s scope does not establish that every item on the phones is responsive to a request or legally subject to disclosure. Nor does the reporting establish that requesters have received the full extraction files.
Why the families object
The families’ stated concern is that broad extraction files could reveal private communications and information about relatives, friends and other people whose details appear in the data. These are the families’ arguments, not findings by a court.

Stacy Chapin, Ethan Chapin’s mother, said: “A blanket request for all data on these phones violates the rights of the children, our families, and everyone whose information is in the data.” Alivea Goncalves, Kaylee Goncalves’s sister, said “the public’s right to know has limits” and described the requests as an intrusion into her family’s privacy.
Which police department holds the records
Walla Walla police assisted with extracting data, but The Spokesman-Review says Moscow police is the records custodian. Those roles are distinct: assistance with the extraction does not mean Walla Walla police holds the records sought in these requests.

Idaho State Police guidance likewise distinguishes records produced by the state agency from investigative records maintained by other agencies, which should be requested from the relevant custodian. The phone-data dispute described in the newspaper report concerns records said to be held by Moscow police, not the Idaho State Police archive.
How this differs from the criminal case and earlier records litigation
The underlying criminal case is complete. Idaho State Police says Bryan Kohberger pleaded guilty and the case was fully adjudicated on July 23, 2025. He received four consecutive fixed life terms without parole and a fixed 10-year sentence for burglary. That disposition does not decide the separate records lawsuit.

The Walla Walla action is also distinct from a separate 2025 Idaho court action concerning a request to restrict the City of Moscow’s release of certain homicide records. The earlier action involved other records and does not establish the outcome of this phone-data suit.
What is known about the new case’s status
The available reporting does not confirm the new suit’s case number, its precise filing date or a ruling. It therefore does not establish that a court has blocked release, denied the families’ request or resolved what the police may disclose.
