The Klinko request
DSM says its second request concerned former Captain Eric Klinko and sought records of sustained misconduct and specified communications among executive staff. Its editorial reported that Klinko retired in March 2022 and later signed an agreement surrendering certifications; those details are part of DSM’s account and are not independently established by the cited material.
Why the search scope is disputed
DSM says EPD treated the Peckels request as requiring searches across all current and former city employees, even though the newsroom understood its communications request to be limited to executive staff. DSM disputes that interpretation. The timeline DSM reported is notable: it says it submitted the two requests on Aug. 1, was told on Sept. 8 that the initial search-and-location estimate was about two hours, and was informed on Sept. 28 that more material was exempt from release and that an additional $2,680,468.56 would be required to resume the requests. DSM also says EPD denied its fee-waiver request, charged $588 for both requests, and required payment before beginning searches. The publication reported that it paid, accidentally paid one request twice, and later had that error corrected.
What Oregon law says about public-records fees
Oregon Revised Statutes § 192.324 permits public bodies to set fees reasonably calculated to reimburse the actual cost of making records available. The statute allows charges for certain work, including summarizing, compiling, tailoring, attorney review, redaction, and segregation. It also gives custodians discretion to waive or substantially reduce fees when disclosure primarily benefits the general public:

“The custodian of a public record may furnish copies without charge or at a substantially reduced fee if the custodian determines that the waiver or reduction of fees is in the public interest because making the record available primarily benefits the general public.”
The law provides a route to challenge a waiver or reduction denial: a requester who believes that denial was unreasonable may petition the Oregon Attorney General or the relevant district attorney. These provisions do not, by themselves, determine whether Eugene’s estimate is reasonable or whether DSM qualifies for a waiver. See Oregon Revised Statutes § 192.324.

DSM characterized the fee as “fees bullying,” attributing that phrase to Seth Stern of the Freedom of the Press Foundation. The cited account does not independently confirm Stern’s statement. No verified direct quotation from a Eugene official appears in the available reporting.
