The board says manufacturers and connected services should use conspicuous, dependable signals—such as bright lights, sounds, voice cues, phone notifications or distinctive designs—so people can tell when video or audio capture is taking place. The statement is a regulatory recommendation, not a blanket rule that every pair of glasses is already legally required to meet.
What the EDPB is asking manufacturers to do
The EDPB’s statement accompanies its expert report, The connected gaze. Video recording, surveillance and administering evidence in the age of smart glasses. It describes smart glasses as ordinary-looking eyewear that may contain cameras and microphones and connect to the internet. That combination can let a wearer record people who do not realise a device is active.

Chair Anu Talus said smart glasses should make recording obvious, naming several possible approaches:
- Bright LED indicators
- Audio signals
- Voice-activation cues
- Privacy-friendly notifications on a paired smartphone
- Unique designs that make the recording capability apparent
The EDPB says warnings should be reliable, hard to ignore and always up to date. A tiny light that is difficult to see, easy to cover or disabled by a software change would not meet the principle of an obvious warning.

Why discreet cameras create a privacy problem
Conventional cameras usually provide a visible cue: a person points a phone or operates a clearly identifiable camera. Smart glasses can look like normal eyewear while capturing both images and sound. The EDPB says this can turn them into tools for interpersonal surveillance and evidence handling, while creating a power imbalance between the wearer and people being recorded.
The board highlights heightened risks in:
- Hospitals: patients, visitors and staff may be recorded during sensitive medical encounters.
- Schools: children and teachers may be captured without a meaningful opportunity to object.
- Workplaces: recording can affect colleagues, customers, confidential information and employment rights.
- Public spaces: bystanders may be filmed without knowing who is collecting the footage or why.
- Social-media sharing: footage can move rapidly from a private device to a public audience.
An earlier European Data Protection Supervisor technology report, published on 18 January 2019, identified the same underlying concerns: discreet audio and video capture, recording without bystanders’ knowledge and possible cloud sharing with third parties.

Are recording LEDs on smart glasses visible enough?
The EDPB does not set a universal brightness level or prescribe one hardware design. Instead, it says the signal must work in the conditions in which people encounter the glasses and must be difficult to miss or defeat. When assessing a product, look beyond whether an LED exists:
- Can a person standing beside the wearer see the indicator from normal angles?
- Does it remain active for the entire recording session?
- Can the wearer cover, switch off or quietly bypass it?
- Is there an additional sound, voice cue or phone notification?
- Does the companion app clearly show recording status and storage or sharing choices?
Multiple cues can reduce the chance that a warning is missed, particularly in noisy, crowded or poorly lit environments. The EDPB’s examples are design options rather than an endorsement of a particular brand or model.

When GDPR applies to recordings made with smart glasses
Responsibility depends on the purpose and setting of the recording. The EDPB explains the main distinction as follows:

The exemption is not automatic merely because a device is worn personally. Purpose, audience and the circumstances of capture matter. A recording that begins as private can move outside the exemption when it is made available to an indefinite public audience or used for professional purposes.

Manufacturers, app developers and other linked service providers retain their own data-protection responsibilities. They cannot transfer those obligations to the wearer. The EDPB also says new processing must remain compatible with the purpose for which data was originally collected.

Luxembourg’s National Commission for Data Protection (CNPD) published smart-glasses guidance on 26 August 2026 and updated it on 1 September. It covers how the devices work, privacy risks, obligations for manufacturers and suppliers, professional use and responsible GDPR-compliant practices.

The Dutch Data Protection Authority says secretly filming other people with camera glasses in public is generally prohibited and says it is coordinating with European regulators. Local law can therefore impose restrictions even where a particular recording does not clearly fall under GDPR.
A practical checklist for buyers and users
- Confirm the recording signal before purchase. Check whether people nearby can see or hear it, rather than relying on a specification that merely says “LED indicator.”
- Test ordinary viewing angles. Have someone stand beside, in front of and behind the wearer in daylight and indoor lighting.
- Check tamper resistance. Review whether the indicator can be covered, disabled or bypassed without an unmistakable warning.
- Review audio and phone cues. Look for voice-activation feedback and notifications that do not expose unnecessary personal data.
- Inspect storage and sharing controls. Find out where recordings go, how long they remain there and which services can access them.
- Set boundaries for sensitive places. Avoid recording in hospitals, schools, workplaces or other restricted areas unless there is a clear legal and organisational basis.
- Decide the audience before recording. Private use, professional use and public posting can trigger different responsibilities.
- Respect objections and local rules. Stop recording when people object and check applicable criminal, civil, labour or sector-specific restrictions.
What the statement does—and does not—change
The EDPB’s 13 October 2026 statement sets a clear direction for product design and responsible use: people should not have to guess whether ordinary-looking glasses are recording them. It does not create one EU-wide technical specification, certify a particular model or provide a numerical threshold for indicator brightness.
The available European materials are qualitative and regulatory; they do not establish a prevalence rate for covert recording or a single test proving that a warning is visible enough in every situation. Buyers and organisations should therefore evaluate the complete combination of indicators, controls, data handling and context rather than treating one light as proof of compliance.
