EU Market Access for Indian MSMEs: Tariffs, Rules of Origin and Trade Agreements Compared

Indian MSMEs should not price an EU shipment on the negotiated EU-India FTA tariff yet. For each shipment, check the EU duty that applies on its import date, whether the product can claim the EU’s current GSP preference, and whether it meets that route’s origin and documentation requirements. Negotiations on the FTA concluded on 27 January 2026, but its published terms are not a currently claimable preference: the agreement remains subject to legal and entry-into-force steps.

Can an Indian MSME use the EU-India FTA now?

No—not on the basis of the negotiated text alone. The European Commission describes the published agreement text as informational and subject to legal revision; it becomes final upon signature and binding only after both parties complete their internal procedures for entry into force. The official status reflected in the Commission and EUR-Lex material for this comparison does not establish that the FTA is in force. Check the official status and final text before relying on any FTA rate for a shipment.

Until the agreement is in force and its relevant tariff schedule is applicable, compare the ordinary EU tariff with any GSP preference available to the specific Indian-origin product. The EU-India FTA is reciprocal; the EU GSP is a unilateral, non-reciprocal preference granted by the EU. Neither route provides one rate for all goods from India.

What do the FTA headline figures mean for an Indian exporter?

The Commission’s summary of the negotiated outcome says the EU will eliminate tariffs on over 90% of tariff lines, representing 91% by value, while India will eliminate tariffs on 86% of tariff lines, representing 93% by value. Including partial liberalisation of additional lines, the stated overall coverage is 99.3% for the EU and 96.6% for India. These are aggregate negotiated figures, not a guarantee that a particular Indian export will enter the EU duty-free, and they are not currently claimable FTA rates.

Direction matters. Examples in the Commission’s summary—such as Indian tariff reductions on textiles and apparel, ceramics, chemicals, machinery and processed food—describe EU goods entering India. They do not tell an Indian exporter what duty an Indian-origin product will face in the EU. For that, use the EU schedule for imports from India, the product’s classification and the applicable tariff staging.

The Commission also reported €120 billion in EU-India trade in goods in 2024, equivalent to 11.5% of India’s total trade. Its estimated annual duty savings of around €4 billion from tariff reductions concern European products, not a savings estimate for Indian MSME exports to the EU.

How do ordinary EU tariffs, GSP and the FTA compare?

Route When it can be used What determines the duty Origin and evidence
Ordinary EU tariff For the import date, where no preference is available or the shipment does not meet preference conditions. The product’s tariff classification and the rate applicable on the date of import. A rate cannot be determined from a broad industry label alone. No preferential origin claim is needed for an ordinary rate; customs classification and other import documentation still matter.
EU GSP Potentially available now for eligible Indian-origin products, subject to the product and applicable rules. Product-specific eligibility, the applicable tariff line and the GSP rate in force on the import date. The goods must meet the applicable GSP origin and procedural requirements, including the relevant administrative cooperation conditions.
EU-India FTA Only once the agreement has entered into force and the relevant schedule is applicable. The negotiated text alone is not sufficient to claim it. The EU tariff schedule for the product, including its staging and any applicable restrictions. The negotiated rules include product-specific origin requirements, origin documentation and customs verification.

In practice, compare more than the headline percentage. For each route, check its legal availability on the planned import date, the exact tariff line and staging, the product-specific origin test, the evidence and verification process, any exclusion or quota, and relevant non-tariff requirements.

How can an MSME check the EU duty on a product?

  1. Classify the goods. Identify the product’s HS/CN code. A description such as “textiles,” “food” or “machinery” is not precise enough to establish the tariff line.
  2. Check the import-date tariff. Use the European Commission’s Access2Markets information for the destination and planned import date to check the ordinary EU tariff and any available GSP rate for that code.
  3. Check GSP eligibility and exclusions. Confirm that the specific product line is eligible under the applicable period and that the shipment meets its origin and procedural conditions.
  4. Assess the origin facts. Record the origin of materials and the processing done in India and elsewhere. Compare those facts with the specific origin rule for the preference being considered.
  5. Compare the net benefit. Weigh any duty saving against the cost of meeting the origin test, preparing evidence and retaining records. If preference conditions are not met, do not claim the preferential rate.
  6. Check the FTA again before a future claim. Confirm entry into force, the final EU schedule, product staging and restrictions, origin requirements and documentation for the shipment date.

The official sources do not establish a rate for an unspecified product. It cannot be calculated reliably without the tariff code, origin facts, destination and import date.

What Indian products are excluded from GSP?

The Commission’s Access2Markets update for 2026–2028 lists Indian-origin GSP exclusions. It identifies three sections newly excluded for India compared with 2023–2025: S-5 minerals, S-7b rubber, and S-17b motor vehicles and other means of transport. These are section-level references, not a complete list of every affected tariff line or every Indian exclusion. Check the full current list and the precise product code rather than assuming a sector is wholly included or excluded.

The Commission describes GSP as a preference granted unilaterally by donor countries and says it is non-reciprocal. Eligibility also depends on the applicable origin rules and administrative cooperation; Indian dispatch, by itself, does not establish that goods qualify for Indian preferential origin.

What changes for GSP from 2027?

The Commission’s guidance identifies Regulation (EU) 2026/1395 as the new GSP framework applying from 1 January 2027 for ten years. It replaces Regulation (EU) No 978/2012, which runs through 31 December 2026. Because this transition is close and product lists and rates can change, verify the GSP framework, eligibility and tariff for the actual import date rather than carrying a 2026 conclusion into a 2027 shipment.

What processing qualifies a product as Indian origin?

There is no single processing threshold that can be applied to every product or preference route. Origin is tested against the product-specific rule under the scheme being claimed. The Commission’s summary says the negotiated FTA rules are closely aligned with rules in recent EU FTAs and are intended to reserve preference for goods significantly processed in a party. That description does not substitute for the product-specific rule in the final agreement.

Do not assume that shipping goods from India, simple repacking or another minimal operation automatically makes them Indian-origin for preferential purposes. Keep records of input origins and manufacturing or processing steps so they can be checked against the relevant rule. Under the negotiated FTA summary, businesses would self-certify origin and upload a separate statement on origin for verification; customs authorities may contact the importer and cooperate administratively before refusing a preference claim. Those are descriptions of the negotiated arrangement, not instructions for claiming an FTA preference before it enters into force.

What else must an EU-bound shipment satisfy?

A tariff preference does not waive EU import requirements. Check the relevant product-safety rules, sanitary or phytosanitary requirements where applicable, and customs documentation separately from tariff and origin eligibility. Classification, regulatory compliance and origin evidence address different questions; meeting one does not establish the others.
