The case concerns the machinery that buys and sells ads across the wider web—not Google Search rankings or every form of digital advertising. Google has appealed, and the eventual remedy, which could include structural separation, remains unresolved.
What the European Commission decided
The Commission found that Google abused a dominant position in online display-advertising intermediation, commonly called adtech. Its decision covered conduct from 2014 onward and focused on the way Google operated at several points in the programmatic advertising chain.
As an Amazon Associate I earn from qualifying purchases.
The relevant chain can be simplified as:
Advertiser tools → ad exchange → publisher ad server
- Advertiser-side tools: Google Ads and Display & Video 360 help advertisers buy programmatic inventory.
- Ad exchange: AdX runs auctions connecting buyers with publishers selling advertising space.
- Publisher ad server: Google’s DoubleClick for Publishers business, now associated with Google Ad Manager, helps publishers manage and sell inventory.
The Commission’s concern was not simply that Google owned products in these categories. It was that Google allegedly used its position across them to give AdX an advantage over rival exchanges.

How regulators say Google favored AdX
Preferential treatment in publisher auctions
According to the Commission, Google’s publisher ad-server business gave AdX preferential treatment when competing for publishers’ inventory. That could make it harder for another exchange to win an impression, even when the rival might have offered a competitive bid.
Advantages from advertiser-side tools
The Commission also found that Google’s buying tools favored AdX. Because Google operated tools used by advertisers as well as the exchange receiving bids, regulators saw a conflict in which the company could influence where demand was directed.
Information and auction rules
Regulators said Google used information and auction mechanisms in ways that reinforced AdX’s position. The legal issue was the alleged use of dominance to favor the exchange, not Google’s mere participation in the market.
This is why describing the case as Google “favoring its own ads” can be misleading. The decision concerns auctions for advertising on publishers’ sites and apps across the open web, where Google supplied infrastructure to buyers, sellers and the exchange between them.

Who could be affected?
Publishers
- Less competition for their advertising inventory could reduce auction proceeds.
- Dependence on Google’s integrated tools can make switching more difficult.
- They may have less visibility into how bids are routed and ranked.
The Commission’s legal conclusion does not establish a single, precisely measured overcharge for every publisher. Actual effects can differ by country, inventory type, audience and demand mix.
Advertisers
- Integrated buying and selling tools can make auctions harder to compare independently.
- Intermediation costs may be less transparent.
- Advertisers may have less ability to evaluate rival exchanges on equal terms.
Rival adtech companies
- Independent exchanges may struggle to obtain enough demand and supply to scale.
- Rivals can face disadvantages in access to data, auction opportunities or Google-connected inventory.
- Smaller firms may find it harder to compete with an incumbent spanning multiple layers of the transaction.
Why the penalty was €2.95 billion
The €2.95 billion penalty was imposed under EU competition law for abuse of dominance. A fine is intended to punish past conduct and deter similar behavior; it is separate from any measures required to change Google’s operations.

The money is not an automatic refund to publishers or advertisers, and the amount does not by itself equal the total economic harm. Individual businesses seeking compensation would generally need separate legal proceedings.
The figure is also not Google’s largest European antitrust penalty. The company has previously received larger EU sanctions, including in the Android case.
Fine versus remedy: the unresolved issue
The Commission required Google to propose measures within 60 days and warned that behavioral changes might not be enough. Its materials left open a structural remedy, such as selling part of the adtech business, if that was necessary to remove the conflict of interest.
Behavioral remedies
Behavioral measures could restrict how Google ranks bids, shares information, routes demand or sets auction rules. They would preserve existing infrastructure and could reduce disruption for publishers and advertisers, but they require continuing monitoring. Rules can be difficult to define and enforce if Google can comply formally while retaining the same economic advantage.

The Commission could seek separation of teams, data, decision-making or auction functions without requiring an immediate sale. That may reduce conflicts while keeping products under common ownership, although regulators would still need access to confidential technical and auction information.
Structural separation
A structural remedy could require Google to sell or divest an adtech business. That directly addresses vertical integration and could create a more independent exchange or publisher tool. It could also disrupt contracts, data systems, identity services and workflows on which publishers and advertisers rely. A divested company might remain dependent on Google demand or infrastructure.
Penalty payments for non-compliance
Periodic penalty payments could add financial pressure if Google fails to implement an accepted remedy. They would be enforcement tools, not a replacement for deciding what the remedy must require.
Google was not ordered to break up its adtech business in the September 2025 decision. A sale remains a possible future remedy, not the immediate outcome.

Google’s response and appeal
Google has argued that providing tools to both buyers and sellers is not inherently anticompetitive and that advertisers and publishers have more alternatives than in the past. It has opposed a disruptive breakup, warning that publishers and advertisers could be harmed by losing integrated services.
In November 2025, Google proposed behavioral and technical changes that did not include divesting the adtech business. The Commission must determine whether those measures adequately address the conflict it identified; the proposal was not a final remedy accepted by the Commission.
Google and Alphabet filed a challenge before the EU General Court on November 20, 2025, in Case T-794/25. The court record is available through EUR-Lex. As of August 18, 2026, no final judgment on that challenge had been identified.
What Trump’s threats changed—and what they did not prove
- The Commission had been investigating Google’s adtech conduct since the early 2020s.
- Reporting indicated that the decision’s timing became politically sensitive during U.S.–EU trade negotiations.
- Brussels announced the fine on September 5, 2025.
- Donald Trump then attacked the penalty as unfair or discriminatory and threatened possible retaliation against Europe.
The available reporting supports a story about regulatory enforcement proceeding amid political and trade pressure. It does not establish that Trump’s threats had no effect on the timing, nor does it prove that the decision was made for political reasons. The EU’s position is that competition rules apply to companies operating in its market.
Associated Press coverage, Ars Technica’s analysis and Le Monde’s report describe the political context and chronology.

How the separate U.S. case fits
The U.S. Justice Department has pursued a separate case involving Google’s adtech businesses. The proceedings overlap in subject matter but are not interchangeable.
- The EU matter was decided by the European Commission under EU competition law.
- The U.S. matter is a judicial proceeding with different legal standards, evidence and potential remedies.
- A finding or settlement in one jurisdiction would not automatically decide the other jurisdiction’s remedy.
Similar allegations therefore provide context, not proof that every EU allegation has already been established in the United States.
What happens next for the adtech market
For publishers
Publishers should watch whether any remedy changes auction rules, data access, identity services, reporting or the ability to use multiple exchanges. Greater independence could improve negotiating leverage, but migration, integration and yield-management costs could arrive before any benefit.

Advertisers may see changes first in auction mechanics, reporting and access to inventory rather than an immediate change in campaign prices. More independent paths to publisher supply could improve comparison, while fragmented tools could increase operational complexity.
For rival platforms
Competitors could gain access to opportunities that are currently concentrated in Google’s ecosystem. Their ability to benefit will depend on whether a remedy addresses data, demand quality, latency, identity and switching costs—not just ownership of one product.
For regulators
The Commission must decide whether Google’s proposal is effective and monitor compliance if it is accepted. If behavioral measures do not remove the conflict, the structural option could return to the center of the case.
What this decision does not mean
- It is not a ruling that Google monopolized every form of online advertising.
- It is not an order requiring an immediate breakup.
- It is not a court judgment upholding the Commission’s decision; Google’s appeal remains pending.
- It is not proof that every publisher paid a specific percentage more for ad intermediation.
- It does not automatically determine the outcome of the U.S. Justice Department case.

What publishers and advertisers should evaluate now
Any business considering a change should compare the whole economics of its stack rather than look for a single “Google alternative.” Useful criteria include:
- Net yield or campaign performance after all fees.
- Visibility into auction mechanics and reporting.
- Demand quality and geographic reach, especially for European inventory.
- Identity, consent and privacy controls.
- Contract lock-ins, minimum commitments and data-sharing terms.
- Engineering, migration and ongoing optimization costs.
- Whether the replacement creates another form of platform dependence.
Open-source Prebid, Amazon Publisher Services, Magnite, Equativ and Kevel serve different roles and business sizes; none automatically replaces Google Ad Manager, AdX, Google Ads and Display & Video 360 as a group. Enterprise pricing and onboarding terms vary and should be obtained directly from vendors.
