No—the EU has not abandoned “Chat Control.” Denmark’s 2025 Council presidency helped move negotiations away from a simple EU-wide mandatory-scanning model, but the permanent child-sexual-abuse regulation was still unsettled on 18 August 2026. Separately, the EU reinstated a narrower temporary regime allowing voluntary provider detection until 3 April 2028. That interim regime excludes interpersonal communications to which end-to-end encryption “is, has been or will be applied.”
The result is a split status: a temporary, narrower authorization is in force, while the long-term rules on risk assessments, detection orders, encryption and an EU Centre remain under negotiation.
What happened in one minute?
- The original temporary ePrivacy derogation, first adopted in 2021 and extended in 2024, expired on 3 April 2026.
- Parliament rejected the proposed extension on 26 March 2026 by 228 votes to 311, with 92 abstentions.
- Parliament and the Council later agreed on a narrower interim measure. The Council gave final approval on 23 July 2026, and the measure is scheduled to apply until 3 April 2028.
- The permanent regulation on preventing and combating child sexual abuse online has not been finally enacted.
“Chat Control” is an informal campaign label, not the official name of one EU law. It is used for the temporary voluntary-detection rules, the proposed permanent regulation and the wider dispute over automated analysis of messages, grooming detection, judicial orders and encryption. The Council’s overview describes the policy framework and its current status at consilium.europa.eu.

What Denmark actually proposed
Denmark held the rotating presidency of the Council from July through December 2025. In that role, it chaired meetings and circulated compromise texts; it did not enact a Danish law that replaced EU legislation.
The Danish Presidency’s text sought to bridge national-government and Parliament positions by emphasizing continued voluntary provider detection while preserving discussion of targeted detection orders. It also separated public content from non-public interpersonal communications and addressed how encrypted services might be treated. The Presidency document is published at data.consilium.europa.eu.
A later comparison shows the institutional divide. The Council contemplated provider searches for known and new child-sexual-abuse material and solicitation of children. Parliament preferred judicial detection orders aimed at individual users or defined groups where there are reasonable grounds for suspicion, with stronger limits concerning encrypted communications. “Voluntary” means the temporary law does not require every provider to scan every message. It does not mean unregulated activity, user consent, permission to inspect any content, or a guarantee that future rules will remain voluntary. Providers can also face practical pressure from risk-assessment, safety and law-enforcement expectations; describing that as a legal mandate would go beyond the settled text.

What the original permanent proposal was—and was not
The Commission’s permanent proposal was designed to make providers assess and reduce risks, report suspected abuse and comply with detection mechanisms. It was not accurately described as a simple order for every service to scan every message. The scope and mechanism changed across the Commission, Council, Parliament and Presidency texts.
The Commission legislative record is available at eur-lex.europa.eu. Depending on the text, the debate involves:
- provider risk assessments and mitigation measures;
- automated matching of known material;
- attempts to identify previously unknown material or grooming;
- judicial or other detection orders;
- removal, blocking or delisting orders;
- reports to law enforcement and Europol;
- victim assistance and removal requests; and
- a proposed EU Centre to support authorities and handle reports.
Those are policy and negotiating elements, not a final enacted package. The Council’s current policy summary is at consilium.europa.eu.
What the July 2026 interim measure covers
The reinstated measure gives qualifying online providers a temporary legal basis to voluntarily detect, report and remove child-sexual-abuse material. It is narrower than the unresolved permanent framework and is expressly without prejudice to the long-term negotiations.

Its most consequential boundary is encryption: covered interpersonal communications to which end-to-end encryption is, has been or will be applied are excluded. That is a rule for this interim measure—not a permanent EU declaration that encrypted services can never be subject to future detection orders.
Why encryption is the central technical issue
End-to-end encryption is different from ordinary encryption
Encryption in transit or encrypted storage can leave a service able to access message content at an endpoint or on its servers. Properly implemented end-to-end encryption is designed so that only the communicating endpoints can read the plaintext. Inspecting that plaintext generally requires scanning before encryption, after decryption, changing the system’s architecture or adding an access mechanism.
The legal exclusion is narrower than “encrypted messages”
The July rule refers specifically to interpersonal communications covered by end-to-end encryption. It should not be paraphrased as a ban on every form of content analysis involving any encrypted data. Nor does it resolve what a future permanent regulation might require.
What “scanning” can mean
Scanning is not one technical operation. Hash matching against a database of known abuse images is materially different from machine-learning systems seeking unknown material or grooming language. Public posts are also not legally or technically identical to private interpersonal messages.

Parliament’s March 2026 position favored limiting voluntary detection technology primarily to material already identified or flagged as potentially abusive. Its proposal is described at europarl.europa.eu. Claims that the interim measure creates “mass surveillance” or that it is harmless should therefore be treated as advocacy characterizations unless tied to a specific provision and technical implementation.

- Cannot be inferred: the April-to-July legal gap does not prove that no provider scanned content under any other legal basis.
What happens next
Negotiators still have to resolve how risk assessments, mitigation, detection orders, encryption, reporting and the proposed EU Centre fit together. The temporary end date does not automatically terminate the permanent proposal, and the July reinstatement does not predetermine the final compromise.
For users, the practical answer depends on the service, the content surface and the encryption model. A platform’s public-content moderation, its optional safety scanning and a judicial detection order are separate questions. “Encrypted” must likewise be identified as transport encryption, encrypted storage or genuine end-to-end encryption before drawing a legal conclusion.

Can providers scan end-to-end-encrypted private messages under the July 2026 interim rules?
The reinstated interim measure excludes interpersonal communications to which end-to-end encryption is, has been or will be applied. That exclusion does not decide the permanent regulation.
Did Denmark pass a voluntary Chat Control law?
No. Denmark chaired the Council in 2025 and circulated compromise texts. The EU institutions adopted the temporary measure.
The Bottom Line
The EU did not abandon Chat Control. It restored a narrower voluntary-detection framework through 3 April 2028, excluding covered end-to-end-encrypted interpersonal communications, while negotiations over the permanent child-sexual-abuse regulation continue.
