That request is not a government finding, and the available reporting does not establish that Anbernic has been added to a final list or banned in the United States.
What the ESA reportedly asked USTR to do
Video Games Chronicle reported on October 13, 2026 that the ESA included Anbernic in recommendations submitted for USTR’s 2026 Notorious Markets List. The ESA’s reported concern is that certain handheld devices are offered or shipped with removable memory cards containing unauthorized copies of games published by ESA members.

This is an allegation made by an industry association, as described in news reporting. The reporting does not independently establish how often such bundles are sold, identify every seller or configuration at issue, or show that every Anbernic device includes games. The underlying ESA filing was linked in the reporting, but the filing itself was not accessible from Regulations.gov in the sources reviewed.
What “superfake” means in this story
“Superfake” is the ESA’s analogy for consumer-ready plug-and-play handhelds that pair polished hardware, packaging, interfaces, or retail listings with an alleged unauthorized game library. VGC quoted the ESA submission as saying: “In the video game sector, illicit plug-and-play consoles and handheld devices are the functional equivalent of superfakes.” This is advocacy language from the ESA, not a formal legal category or a conclusion reached by USTR.

The ESA’s reported argument focuses on games allegedly stored on a removable card or internal drive. It does not establish that emulation hardware by itself is unlawful. An emulator and copyrighted game files distributed without authorization are distinct issues; the sources available for this story do not provide a technical or legal analysis of emulation, particular ROMs, or an individual user’s conduct.
Is Anbernic banned in the United States?
No U.S. ban or current sales restriction is established by the available reporting. The report describes an ESA recommendation to USTR, not a final USTR designation, court ruling, import prohibition, or order directing marketplaces to remove Anbernic listings. The sources reviewed do not verify a final decision on the 2026 recommendation.

The ESA’s reported nomination also does not amount to a finding that all Anbernic products infringe copyright. The allegation concerns game files in certain offerings, and the reporting does not establish model-by-model claims or the status of individual listings.
What the Notorious Markets List does—and does not do
USTR’s annual Notorious Markets List is intended to highlight online and physical markets reported to engage in or facilitate substantial trademark counterfeiting or copyright piracy, raise awareness, and help governments and market operators prioritize enforcement. In its March 3, 2026 release on the 2025 list, USTR said the list is not exhaustive and does not constitute findings of legal violations or the U.S. government’s broader assessment of a country’s intellectual-property climate.

That distinction matters here: a recommendation asks USTR to consider a market for the report; it does not itself establish that the allegation is true or impose a restriction.
