Epic Games v. Google: What the Play Store Verdict Means for Android in 2026

Google lost the antitrust trial brought by Epic Games, but the important story in 2026 is implementation—not a new verdict. A December 2023 jury found that Google unlawfully maintained monopolies in Android app distribution and in-app billing. Judge James Donato’s October 2024 injunction ordered Google to open parts of Google Play to rival app stores and alternative payment systems. Google and Epic later announced a settlement, yet they withdrew their request to replace the injunction, and the judge is still examining whether Google’s rollout gives rivals meaningful access.

That could weaken Google’s traditional “one store, one billing system” model in the United States. It does not break up Google Play, guarantee that every app will appear in every rival store, or make all Android phones worldwide behave the same way.

The short version

  • The jury verdict was delivered in December 2023, not 2026.
  • The October 7, 2024 permanent injunction requires Google to support rival-store distribution, provide qualifying catalog access, and stop forcing Google Play Billing or blocking alternative billing communications during the principal three-year period ending November 1, 2027. What Epic actually won

Epic’s case was about the structure of Android’s app marketplace, not simply Fortnite’s removal from Google Play. Epic introduced Fortnite’s own payment option in 2020, Google removed the game, and Epic sued. The jury later found Google liable on Epic’s principal antitrust claims involving Android app distribution and in-app billing. The findings also covered Google’s contracts and commercial arrangements with developers, handset makers and game distributors. See the district-court order describing the verdict.

That distinction matters. The remedy is not a simple order to put Fortnite back in the Play Store. It targets the advantages that made Google Play the default gateway: the size of its catalog, agreements that discouraged rival stores, and rules that tied Play distribution to Google Play Billing.

What Judge Donato’s injunction requires

The permanent injunction entered October 7, 2024, principally runs from November 1, 2024, through November 1, 2027. Its requirements include:

  • Rival-store distribution: Google may not prohibit third-party Android app stores from being distributed through Google Play during the injunction period.
  • Catalog access: qualifying rival stores must be able to access the Google Play catalog under the order’s terms. Developers retain opt-out rights, so access is not automatically the same as receiving every Play listing.
  • Alternative billing: Google may not require developers using Google Play distribution to use Google Play Billing, nor prohibit them from using or communicating about other billing systems.
  • Limits on exclusivity: Google may not use specified preinstallation or exclusivity arrangements to suppress competing stores.

The order does not require Google to divest Google Play or abandon Android security controls. It also does not say that every store must be prominently listed, that every device must offer identical options, or that every developer must participate.

What the Ninth Circuit changed—and what it did not

Google challenged both the jury’s market analysis and the injunction. The Ninth Circuit upheld the verdict and the major catalog-access and app-store-distribution remedies in 2025. The court accepted the reasoning that catalog access can counteract network effects: developers go where users are, and users tend to remain where the largest catalog already exists. Without access to enough applications, a technically permitted rival store could remain commercially irrelevant.

What Google and Epic agreed to in March 2026

Epic said the March 4 settlement would reduce Google’s effective fees, permit alternative payment systems, allow links to external purchasing pages and create a framework for third-party Android app stores. Epic also described the changes as applying beyond the United States in various jurisdictions and said they would support Fortnite’s return to Google Play worldwide. Read Epic’s announcement.

A settlement announcement and a court injunction are different things. The proposed revised remedy still required court consideration, including whether replacing the existing order served the public interest and adequately addressed the jury’s findings. Google and Epic withdrew their renewed request to modify the U.S. injunction in July 2026. The commercial changes may continue under their own terms, but the existing court order remains the central enforceable U.S. remedy.

What is changing for U.S. Android users

Google’s current developer guidance describes U.S.-specific programs that let developers communicate outside-Play prices and availability, link to external content or transactions, and use alternative billing. Third-party stores can apply for Catalog Access and Google’s Third-party App Store on Play Program. Developers may opt out of having their listings supplied to third-party U.S. stores. Reporting and service-fee obligations for applicable alternative-billing and external-content programs begin October 1, 2026. The exact requirements depend on the program and transaction.

Users should expect a more varied marketplace rather than a single replacement for Google Play:

  • Rival stores such as the Epic Games Store may become easier to obtain, subject to availability and Google’s technical and security requirements.
  • Some digital purchases may use a store’s or developer’s payment system instead of Google Play Billing.
  • Different stores may use separate accounts, wallets, refund processes, parental controls and subscription tools.
  • An app installed from one store may not have identical update, support or purchase behavior when another store is involved.
  • Security warnings and review practices may differ outside Google Play. Greater choice does not mean Google must accept malicious or incompatible software.

Lower platform costs could produce lower prices, but developers may also retain the savings. The legal changes create an opportunity for price competition; they do not guarantee it.

Why rival-store access is the real test

“Open” can mean several different things:

  1. Legal access: Google permits a rival store to exist.
  2. Technical access: the store can obtain catalog information and distribute applications.
  3. Discoverability: ordinary users can find it.
  4. Installability: installation does not require unreasonable warnings, workarounds or confusing manual steps.
  5. Commercial viability: enough users and developers participate to support a genuine competitor.

The first two do not guarantee the last three. Recent August 2026 reporting says Judge Donato questioned whether Google is doing enough to help users find and install rival stores through ordinary Play Store use, rather than relying on a website download and manual APK installation. That report is secondary coverage; the available material does not establish a final order prescribing a particular search result or interface.

What developers need to evaluate

Payment and pricing choices

Developers can gain control over payment processing, communicate external purchasing options and potentially reduce platform costs. Alternative billing can also bring integration, tax, fraud, refund, customer-support and reporting work. Google may still charge a service or billing-related fee when it does not process the payment, depending on the applicable program.

Distribution and catalog participation

Catalog access can reduce the need to rebuild a complete storefront, but it does not guarantee placement, downloads or featuring. Developers can opt out of distribution to third-party U.S. stores under Google’s policy. Rival stores still need to solve discovery and user acquisition.

Geography and product scope

Rules differ by country, device, app category, transaction type and install source. The U.S. injunction should not be presented as a worldwide rule. Epic’s settlement announcement describes broader changes, while local requirements in the European Union, United Kingdom, Australia and elsewhere may operate separately. Who gains—and who faces new pressure

Key questions that remain unresolved

  • Will users see the Epic Games Store in Play search? The current material reports judicial concern about discoverability but does not verify a final mandated search placement.
  • Will every Play app appear in rival stores? No. Developers may opt out of third-party U.S. distribution.
  • Will existing purchases transfer? The available orders and policy guidance do not establish a universal transfer mechanism for purchases or subscriptions.
  • Who handles refunds? Responsibility can vary by billing system and store; there is no single cross-store rule established here.
  • Does this cover every Android product? The documented programs are geography- and eligibility-specific. The material does not establish identical treatment for Android TV, cars, Wear OS or every tablet.
  • Can Google charge on outside transactions? Potential charges and reporting duties depend on the applicable program, transaction type, geography and effective date; there is no universal rate.
  • Does this affect iPhone users? No. This case concerns Google’s Android and Google Play ecosystem.

What happens next

Implementation will determine whether the case produces a durable competitive shift or only formal permission on paper. The immediate checkpoints are Google’s October 1, 2026 reporting and service-fee date for applicable U.S. programs, compliance monitoring under the existing injunction, and disputes over search visibility, installation friction, security requirements, catalog opt-outs and fees.

The injunction’s stated principal period ends November 1, 2027, although further court proceedings, appeals or modification requests could affect what follows. By then, the decisive question will be practical: have rival stores attracted enough users and developers to challenge Google Play, or has Google preserved its gatekeeper position while technically complying?
