Envirodigm Inc., not Apple, is appealing after Apple won summary judgment in a California dispute over an alleged anodization formula for a colored aluminum iPhone body. The California Court of Appeal heard argument on October 15, 2026, in Envirodigm Inc. v. Apple Inc., case H052479. No appellate decision had been reported by October 16, 2026.

What the appeal is about

Envirodigm claims Apple used proprietary anodizing chemistry after an August 2013 meeting covered by a nondisclosure agreement (NDA). The alleged process was intended to color an aluminum iPhone enclosure and was associated in court reporting with a 2015 iPhone model, including the iPhone 6s and 6s Plus product context.

The lawsuit began in Santa Clara County Superior Court under case number 20CV373138. Apple obtained summary judgment there, meaning the trial court entered judgment without sending the disputed claims to a full trial. Envirodigm is asking the California Court of Appeal to overturn that result, or at least allow its contract theory under the NDA to continue.

The appellate hearing was conducted by Justices Daniel H. Bromberg, Cynthia C. Lie and Charles E. Wilson. A September 10, 2026 superior-court record lists a granted motion, but the associated tentative ruling was provided to the parties under seal, so the public record does not disclose the trial court’s full reasoning.

What Envirodigm says Apple did

The alleged disclosure and process

Envirodigm says the parties met in August 2013 and exchanged information under an NDA. Its lawyers contend that Apple then used a formula for anodizing aluminum so the phone body could carry a color while retaining the finish and durability expected of a consumer device.

At oral argument, Envirodigm lawyer Benjamin Siminou said: “Apple has conceded that it used that two-to-one ratio of organic to inorganic acid in order to anodize” the aluminum iPhone body. He also said Apple began experimenting within two months of the meeting and used the process to manufacture iPhones from 2015 onward.

Those statements describe Envirodigm’s advocacy and the way its lawyer characterized Apple’s position; they are not a final appellate finding that Apple misappropriated a trade secret or breached the NDA. The public material reports no damages award, settlement amount or trial verdict.

Why the chemical formula disclosure matters

California trade-secret litigation generally requires the claimant to identify the secret with enough specificity for the court and the opposing party to know what information is actually protected. A broad description of a manufacturing result, without identifying the protected combination of ingredients or operating parameters, may be insufficient to support a misappropriation claim.

Apple lawyer Michael von Loewenfeldt argued that Envirodigm’s required trade-secret disclosure was too vague and did not identify the formula in sufficient detail. Apple’s position is that a claimant cannot proceed on a trade-secret theory based on an undisclosed or inadequately defined secret.

The dispute is therefore not simply whether a two-to-one ratio appeared in a manufacturing process. It is whether Envirodigm clearly identified that information as its protectable secret in the manner California procedure requires, and whether the record supports a claim that Apple obtained or used it improperly.

Trade-secret claim versus NDA contract claim

Envirodigm argues that the confidentiality agreement creates a separate path to liability. Its position is that Apple’s promise to keep information confidential can be enforced as a breach-of-contract claim even if the court rejects the trade-secret misappropriation theory.

Justice Bromberg questioned at argument why failure to disclose the formula as a trade secret should necessarily defeat the contract claim. That question highlights the appeal’s central legal fork: a trade-secret claim depends on statutory protection for qualifying secret information, while an NDA claim depends on the parties’ contractual promises, scope of the agreement and proof of a breach.

Issue Apple’s position Envirodigm’s position What the appeal must address
Disclosure specificity The alleged formula was not identified precisely enough. The confidentiality obligations protect the information independently. Whether the disclosure met the legal standard for the asserted claims.
Claim type The trade-secret theory cannot proceed without a sufficiently defined secret. The NDA-based breach-of-contract claim can survive even if the trade-secret claim fails. Whether contract and trade-secret theories must rise or fall together on this record.
Procedural posture Apple seeks affirmance of summary judgment. Envirodigm seeks reversal or continuation of its contract theory. Whether the trial court correctly ended the case at the summary-judgment stage.
Evidence status Apple relies on the alleged lack of a specific disclosure. Envirodigm relies on the NDA, the alleged two-to-one ratio and claimed post-meeting experimentation. How those assertions should be treated before any final merits ruling.

Timeline of the allegations and case

  1. Early 2011: A separate California appellate history records that Apple had decided to replace a stainless-steel iPhone body with a thinner, lighter extruded anodized aluminum alloy and sought aluminum manufacturing information from Constellium.
  2. August 2013: Envirodigm says it met with Apple under an NDA and disclosed confidential anodizing information.
  3. Within two months, according to Envirodigm’s counsel: Apple began experimenting with the process.
  4. 2015 onward, according to the same argument: The process was used to manufacture colored aluminum iPhone bodies. Reporting connects the product context with the iPhone 6s and iPhone 6s Plus.
  5. Santa Clara County case 20CV373138: Apple won summary judgment in the trial court.
  6. September 10, 2026: A court record listed a granted motion; the tentative ruling remained under seal.
  7. October 15, 2026: The California Court of Appeal heard oral argument in H052479.
  8. October 16, 2026: No appellate disposition had been reported.

Has the appeals court ruled?

No. The hearing has occurred, but the panel had not issued a published or otherwise reported disposition by October 16, 2026. Oral-argument questions are not a judgment, and the panel’s questioning does not establish that either side has won.

The court could affirm the summary judgment, reverse it, or send some claims back for further proceedings. It could also treat the trade-secret and NDA theories differently, depending on the pleadings, disclosure documents, agreement language and evidence in the sealed or nonpublic record.

What this does—and does not—establish about Apple

The appeal does not currently establish that Apple stole Envirodigm’s formula. It establishes that Envirodigm has made that allegation, that Apple disputes the legal sufficiency of the alleged disclosure, and that the appellate court is reviewing whether the trial court properly entered judgment for Apple.

The reported statement that Apple “conceded” use of a two-to-one organic-to-inorganic acid ratio is attributed to Envirodigm’s counsel at argument. It should not be read as a judicial finding that Apple copied confidential information, violated the NDA or owes damages.

What to watch for next

  • The appellate disposition: The key document will say whether the judgment is affirmed, reversed or remanded.
  • Claim-by-claim treatment: The opinion may distinguish the statutory trade-secret claim from the NDA contract claim.
  • Specificity analysis: The court’s treatment of the required disclosure will indicate how precisely manufacturing chemistry must be identified in a California trade-secret case.
  • Unsealed reasoning: If sealed trial-court material becomes public, it may clarify why summary judgment was granted.
