The usual employer-sponsored green card process has several distinct stages: a Department of Labor (DOL) labor-market certification called PERM when the category requires it, a Form I-140 immigrant petition filed with U.S. Citizenship and Immigration Services (USCIS), and a final application for permanent residence in the United States or through a U.S. consulate abroad. PERM is not the green card petition, an approved I-140 is not a green card, and a priority date does not promise when a visa will be available. The right sequence depends on the employment-based category, the worker’s eligibility, visa availability, and whether the worker can adjust status in the United States.
How the employment-based green card process fits together
Employment-based permanent residence is not one application. It is a sequence of decisions by different agencies, followed by a final step that depends on the applicant’s location and eligibility. In the common PERM-based route, the employer first obtains labor certification from DOL, then asks USCIS to classify the job and worker through Form I-140. The applicant can proceed to the final stage only when the applicable visa-number and filing rules permit it.
There are five employment-based preference categories, and they do not all follow the same route. Some cases require a labor certification; some may proceed without PERM, and in some cases the noncitizen may petition on their own behalf rather than relying on a prospective employer. USCIS’s employment-based green card overview explains the category and final-route framework. Do not assume every employment-based green card begins with PERM or that the steps described below apply identically to every category.

The agencies have different roles. DOL handles the labor-market certification. USCIS handles the I-140 petition and, for eligible applicants inside the United States, the adjustment-of-status application. The Department of State (DOS) publishes the monthly Visa Bulletin and administers immigrant-visa processing through U.S. consulates. A case may involve more than one agency because each stage answers a different question.
What PERM means—and who files it
PERM is the labor certification process administered by DOL. Its purpose is to establish that there are not sufficient U.S. workers who are able, willing, qualified, and available for the permanent job opportunity, and that employing the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers. It is a labor-market assessment, not an immigration petition and not a grant of permanent residence.

The employer is responsible for the PERM application. DOL’s Permanent Labor Certification page states: “The filing of applications is the responsibility of the employer, not the employee.” The worker may need to provide information and documents for the employer’s process, but the employer—not the worker—files the PERM application.
DOL’s PERM program overview describes a process that starts with a permanent, full-time job opportunity. The employer determines the actual duties and minimum requirements for that opportunity, obtains a prevailing wage determination, and then completes the required labor-certification steps before filing. The certification concerns the offered job and the labor market; it does not by itself decide whether the worker meets every immigration requirement for the requested category.

1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesBecause the employer’s job requirements and recruitment steps are central to the certification, PERM should not be treated as a personal application the worker can independently prepare and file. The employer’s role continues after approval: a certified application must support the subsequent I-140 petition within its validity period.
What happens after PERM is approved: Form I-140
After DOL approves a required PERM application, the employer submits the certification with Form I-140, Immigrant Petition for Alien Worker, to USCIS. The I-140 asks USCIS to classify the offered position and worker in the requested employment-based category. It is a petition step, not the worker’s final application for permanent residence.

DOL states that an approved labor certification expires if it is not submitted in support of an I-140 within 180 days. The 180-day period is a filing deadline tied to the certification, not an estimate of how long USCIS will take to decide the I-140. Employers need to coordinate the petition filing with the certification’s validity.
| Stage | What it addresses | Who files or administers it | What it does not do |
|---|---|---|---|
| PERM labor certification, when required | Whether the permanent job opportunity meets the labor-market certification requirements | The employer files with DOL | It does not grant a visa, approve the I-140, or give the worker permanent residence |
| Form I-140 | Whether USCIS should classify the job and worker in the requested employment-based category | Usually the employer files with USCIS after required PERM approval; some categories may have different petitioning rules | It is not the final green card application or, by itself, proof that a visa number is available |
| Form I-485 or immigrant-visa processing | The applicant’s final step to become a permanent resident, subject to eligibility and visa availability | USCIS for adjustment in the United States; DOS and a consulate for immigrant-visa processing abroad | Neither route is available automatically to every applicant at every time |
The table describes the usual PERM-based employer-sponsored route, not a universal checklist for all five employment-based categories. The appropriate petitioning party and whether PERM is required depend on the category and facts of the case.
Priority dates: how the visa queue works
A priority date is a queue marker used to determine when an applicant may move forward under the employment-based visa limits. It is not an approval, a guaranteed wait estimate, or a prediction of the date a green card will be granted. For a case that requires labor certification, DOL identifies the date it receives the labor-certification application as the priority date. In cases without labor certification, USCIS explains that the priority-date rule depends on the case and filing involved.
Visa availability is assessed using the applicant’s preference category, priority date, and chargeability area. The Visa Bulletin is published monthly by DOS, and cut-off dates can move forward, remain unchanged, or move backward. A date that was usable in one month may not be usable in another, so readers should use the current bulletin rather than treating an old date as a standing rule.
The October 2026 Visa Bulletin illustrates why the category and chargeability area matter. Its Dates for Filing chart lists EB-2 as 15MAR26 for all chargeability areas except those separately listed, 01JAN23 for China-mainland born, and 15JAN15 for India. For EB-3, the listed Dates for Filing are 01AUG24 for all chargeability areas except those separately listed, 01APR24 for China-mainland born, 15JAN15 for India, and 01JAN24 for the Philippines. These are dated examples from the October 2026 bulletin, not evergreen cut-off dates.

The bulletin explains: “The ‘C’ listing indicates that the category is current, and that applications may be filed regardless of the applicant’s priority date.” “Current” is a chart designation in the relevant category and chargeability context. It does not remove other eligibility, documentation, or filing requirements.

DOS publishes two employment-based Visa Bulletin charts with different functions. Final Action Dates indicate when a visa may be issued or a case may receive final approval under the applicable visa-number limits. Dates for Filing can allow an eligible applicant to submit paperwork earlier, but only when USCIS permits adjustment applicants to use that chart for the month. A filing opportunity is not the same thing as a visa being available for final approval.
| Visa Bulletin concept | What it means for the case | What to check |
|---|---|---|
| Final Action Dates | Used to determine whether a visa number is available for final action, subject to the category and other eligibility rules | The applicant’s preference category, priority date, and chargeability area in the current DOS bulletin |
| Dates for Filing | May permit earlier submission of an adjustment application when USCIS designates this chart for use | The current month’s DOS chart and USCIS’s chart designation for adjustment applicants |
DOS instructs applicants adjusting status to check USCIS to learn which chart may be used in a particular month. Do not infer that Dates for Filing governs an I-485 filing just because it appears in the bulletin; confirm USCIS’s current monthly designation. The October 2026 DOS bulletin gives the dated cut-offs above, but the chart-selection rule still needs to be checked for that month before applying those dates to an adjustment filing.
Adjustment of status in the United States
Adjustment of status is the domestic route for an eligible applicant who is physically present in the United States to apply for lawful permanent residence through USCIS. In an employment-based case, the applicant may file Form I-485 when a visa is available and USCIS’s filing rules allow it. Physical presence alone does not establish eligibility, and visa availability alone does not satisfy every requirement for approval.

The I-485 is separate from the employer’s I-140. Applicants must follow the chart USCIS designates for the relevant month and meet the applicable adjustment and category requirements. Depending on the case, USCIS may require biometrics, health information, supporting evidence, and an interview. USCIS’s adjustment-of-status overview describes the process and emphasizes visa availability and priority dates.
Can I file Form I-485 while my I-140 is pending?
Possibly, but it is not an automatic option in every case. The controlling questions are whether a visa is available under the category and priority-date rules, whether USCIS’s current filing chart permits the application, and whether the category’s filing rules allow the I-485 to be submitted at that point. USCIS must make the relevant filing rules clear for the month and category; do not assume that a pending I-140 alone permits an I-485 filing or that filing an I-485 means the I-140 has been approved.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Consular processing abroad
An applicant who completes the final stage outside the United States generally follows the immigrant-visa process through DOS and a U.S. consulate rather than filing an I-485 with USCIS. This route culminates in immigrant-visa issuance and, after admission to the United States as a permanent resident, lawful permanent residence. It has its own agency process and documentation steps; it is not simply an overseas version of Form I-485.
Both adjustment and consular processing depend on visa availability and satisfaction of the applicable category and individual eligibility requirements. The practical choice is not solely a matter of preference: an applicant must be eligible for the route they pursue, and the relevant process depends in part on whether they are applying from inside or outside the United States.
Best Value
| Question | Adjustment of status | Consular processing |
|---|---|---|
| Where is the applicant for the final process? | Physically in the United States and eligible to apply there | Applying through the immigrant-visa process abroad |
| Which agency handles the final application? | USCIS handles Form I-485 | DOS and a U.S. consulate handle immigrant-visa processing |
| How does visa availability affect the route? | A visa must be available and USCIS’s monthly chart and filing rules must allow the application | Visa availability and applicable immigrant-visa requirements still apply |
| What is the final outcome? | Approval of adjustment makes the applicant a lawful permanent resident | Immigrant-visa issuance followed by admission as a permanent resident |
How long does the process take?
There is no single end-to-end wait time established for all employment-based green card cases. The route can depend on the category, whether PERM is required, agency processing, visa-number availability, chargeability area, and the applicant’s eligibility for a particular final route. The Visa Bulletin’s monthly movement is not a personal case estimate, and the DOL queue snapshot is not a prediction of the full process.
DOL’s PERM Processing Times data, current as of October 5, 2026, showed analyst-review cases filed in December 2025 and audit-review cases filed in December 2025. Those dates describe the filing month of cases being reviewed in those DOL queues at that snapshot. They do not mean every case filed in December 2025 will be decided at the same time, and they say nothing by themselves about I-140, visa-number, I-485, or consular processing time.
For practical planning, keep the stages separate: DOL’s PERM processing, the employer’s I-140 filing and USCIS decision, movement of the applicable Visa Bulletin dates, and the final adjustment or consular process. Only the relevant agency’s current status and filing guidance can answer where a particular case stands.
Common mistakes to avoid
- Treating PERM as the green card application. It is a DOL labor-market certification step, required only for certain categories.
- Assuming the employee files PERM. DOL assigns responsibility for filing the application to the employer.
- Letting an approved certification expire. DOL says the certification must be submitted with the I-140 within 180 days.
- Reading the I-140 as final permanent residence approval. It is a classification petition; a separate final stage remains.
- Using a Visa Bulletin date without its month and chargeability area. Dates vary by category and may change monthly.
- Confusing permission to file with permission for final approval. Dates for Filing can provide an earlier filing opportunity when USCIS permits their use, while Final Action Dates concern visa issuance or final action availability.
- Assuming adjustment and consular processing use the same form or eligibility test. USCIS administers adjustment in the United States; DOS and a consulate handle immigrant-visa processing abroad.
Which official guidance to check before acting
Use DOL’s Permanent Labor Certification and PERM program pages for employer responsibilities, certification steps, and validity. Use USCIS’s employment-based green card and adjustment-of-status guidance for category rules, priority-date explanations, and domestic filing instructions. Use DOS’s current monthly Visa Bulletin for cut-off dates, then check USCIS’s current chart designation before relying on Dates for Filing to submit an I-485. These agency materials are the appropriate starting point for a case-specific decision; an overview cannot determine an individual’s eligibility or filing date.
