Employee Monitoring: Why Transparency Matters and What to Tell Your Team

Employees should be told what workplace monitoring takes place, why it is used, and how the resulting information may be used. Clear notice helps people understand what to expect and how monitoring may affect their privacy or performance assessment; in some places, it is also a legal requirement. Telling staff is important, but it does not by itself make a monitoring practice fair or lawful.

What employees need to know about monitoring

“Monitoring” can mean much more than cameras. Depending on the workplace, it may include call records, email and internet logs, screenshots, keystroke tracking, timekeeping, location tools, or productivity software. Employers should explain which methods actually apply and what information each collects. The UK Information Commissioner’s Office (ICO) lists these types of monitoring in its worker-monitoring guidance.

A useful notice answers practical questions: When does monitoring operate? What does it capture? Is it limited to work systems or work time? Why is the information collected, who may see it, and what decisions might it inform? Workers also need to understand any rules for personal use of work devices, including what counts as a reasonable number of personal emails or phone calls.

Why notice matters

It sets expectations and supports trust

Workers can make informed choices about their use of workplace systems when they know what is recorded and how it may be used. The ICO puts the point plainly: “Building trust with your workers starts with transparency.” Notice cannot guarantee trust, but undisclosed or poorly explained monitoring can leave employees uncertain about what is being observed and why.

It helps workers understand decisions that affect them

Monitoring information may feed into performance assessment or other workplace decisions. Explaining its purpose and limits helps employees understand the context in which records, activity logs, or other information may be considered. It also gives workers a route to ask questions or raise concerns about collection or use.

It can be a legal requirement

There is no single monitoring-notice rule that applies everywhere. In the UK, GOV.UK guidance says employers must make staff aware that they are monitored and why. Ontario has a separate written-policy requirement for employers meeting a specific employee threshold. The details and legal effect differ by jurisdiction.

Notice does not make every monitoring practice acceptable

Transparency is one part of responsible monitoring, not a blanket permission to collect whatever an employer can technically capture. Before adopting a tool, an employer should identify a specific business purpose, consider the likely benefits and negative effects, assess workers’ privacy rights, and ask whether a less intrusive method could meet the need. The ICO and Acas guidance on homeworking both emphasize the need to consider justification, impact, and alternatives.

For example, the ICO says using webcam images to check remote workers’ start times would likely be disproportionate if system login records could answer the question with less intrusion. The important distinction is between collecting information because it is available and collecting only what is reasonably needed for a defined purpose.

Homeworking needs particular care

Monitoring a remote worker can reach beyond the workplace. The ICO says workers’ expectations of privacy are likely to be significantly greater at home, where monitoring may capture information about family members or private life. Camera or microphone monitoring can therefore have consequences for people who are not employees as well as for the worker.

Acas recommends consulting employees, setting out a clear policy, considering an impact assessment, and looking for alternatives. Its guidance, last updated 22 May 2025, also warns that excessive monitoring can damage trust, cause stress, reduce productivity, or in some circumstances breach legal and human rights. Employers should assess the actual technology and setting rather than assume that a practice suitable in an office is appropriate in someone’s home.

What a clear monitoring notice should cover

A practical notice or policy should be easy to find, written in terms employees can understand, and updated when practices change. The exact legal requirements depend on the jurisdiction and technology, but these are useful elements to explain:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Methods: Identify the tools in use, such as CCTV, call logging, device logs, location tracking, or productivity software.
  • Information collected: Explain what each method records, including whether it captures content, metadata, screenshots, location, or activity events.
  • When and where it operates: State the circumstances in which monitoring runs, such as on work devices, during work hours, or in particular work areas.
  • Purpose: Give the specific reason for collection rather than a vague statement that monitoring is for business purposes.
  • Use and access: Explain how information may be used, who can access it, and whether it may inform performance or other employment decisions.
  • Personal use: Clarify relevant rules for personal emails, calls, and other personal activity on work systems.
  • Questions and changes: Provide a way to raise concerns and tell workers when monitoring practices change. Consult employees or their representatives before implementation where applicable.

Employers should also keep access, retention, and any later use of collected information tied to the stated purpose. A notice is more useful when it reflects what the technology actually does, rather than describing a broad category that leaves workers guessing.

How the rules differ by location

United Kingdom

GOV.UK says employers must inform staff that they are monitored and explain why. In UK guidance, covert monitoring is exceptional: the employer should suspect law-breaking, advance notice would make detection difficult, and monitoring should be limited to a specific investigation and end when that investigation ends. This is not a basis for routine secret monitoring.

For homeworking, Acas recommends consultation, a clear policy, an impact assessment, and consideration of less intrusive alternatives. The UK ICO’s guidance addresses the broader data-protection considerations, including purpose, fairness, and worker privacy.

Ontario

Ontario employers with at least 25 employees on January 1 must have a written electronic-monitoring policy and provide it to employees within the specified timeframes. The policy must say whether electronic monitoring occurs; if it does, it must describe how and in what circumstances, and the purposes for which information may be used. See the Government of Ontario’s policy guidance for the applicable requirements and timing.

The province expressly says this Employment Standards Act rule does not create a new privacy right or a right not to be electronically monitored. The policy obligation should not be confused with a general prohibition or permission to monitor.

Other jurisdictions

Rules can differ substantially outside these examples. Luxembourg government guidance, for instance, emphasizes using the least intrusive measures and says that, in principle, workers have a right not to be subjected to permanent, constant surveillance. It also sets out national restrictions for video surveillance and retention. Those details apply to Luxembourg and should not be treated as rules for other countries; see Guichet.lu’s workplace-surveillance guidance.

For England, Scotland, and Wales, a UK government consultation on workplace-monitoring technologies was published on 8 July 2026 and is marked closed. Its page says the government will review responses and develop a final policy proposal; it does not establish that a final proposal has since been adopted. See the consultation page for its status and stated focus.

Before introducing a monitoring tool

  1. Define the need. Write down the specific problem or purpose the monitoring is meant to address.
  2. Consider impacts. Weigh likely benefits against effects on privacy, trust, stress, and working relationships, including impacts on people at home.
  3. Check alternatives. Ask whether a less intrusive source of information can meet the same need, such as login records instead of webcam images for checking start times.
  4. Document the decision. Record why the chosen approach is necessary and proportionate and what alternatives were considered. An impact assessment can help even where it is not legally mandatory.
  5. Explain the practice. Give workers an accessible notice covering the methods, circumstances, purposes, and use of information, and consult them or representatives where applicable.
  6. Keep practice aligned with notice. Restrict access and use to the stated purpose, and update the information employees receive if the monitoring changes.

Covert monitoring is not routine monitoring

UK government and Acas guidance treat covert monitoring as a tightly limited exception, such as a specific investigation into suspected criminal conduct where advance notice would compromise detection. The monitoring should be focused on that investigation and end when it concludes. Employers should not use secrecy as a substitute for a clear policy or as a standing way to monitor staff.
