E-Way Bill Expiry and GST Penalties: What to Do and What Section 129 Means

If an e-way bill has expired, do not continue moving the goods on the strength of that bill. Check the bill’s status and displayed expiry in the official system; where an exceptional delay qualifies, have the authorized person request an extension and enter accurate current transport details. An expired bill does not, by itself, establish one automatic fixed penalty: contraventions in transit can lead to detention or seizure under section 129 of the CGST Act, with release and payment determined through the statutory process.

What should you do when an e-way bill is about to expire or has expired?

The E-Way Bill System FAQ states: “If validity of the e-way bill expires, the goods are not supposed to be moved.” If the bill is nearing expiry and a genuine exceptional delay is affecting the trip, check whether the extension facility is available and arrange the request before movement becomes unauthorized. If validity has already expired, stop movement until an extension or another compliant document basis is in place.

  1. Check the official record. Confirm the exact status and expiry shown for that consignment in the e-way bill system.
  2. Establish where the goods are. Record the actual current location, approximate distance remaining, and the reason for the delay.
  3. Use the extension facility if eligible. The current transporter should ordinarily submit the request within the permitted window; where no transporter is assigned, the generator may update the bill.
  4. Enter accurate transport details. Provide the required reason and update relevant Part B or mode-specific transport information. Part A cannot be changed through the extension process described in the FAQ.
  5. Retain the record. Keep the extension confirmation and practical evidence of the delay, such as breakdown or disruption records, with the consignment documents.

If the extension option is unavailable or the window has passed, seek advice from a GST professional or the relevant tax authority before restarting movement. Do not assume that creating a new bill or relying on the old one resolves the issue.

When does e-way bill validity start, and how long does it last?

The amended CGST Rules PDF hosted by CBIC provides one day of validity for ordinary covered movement up to 200 km, then one additional day for every further 200 km or part of that distance. For Over Dimensional Cargo (ODC) and a multimodal shipment with at least one leg by ship, the initial band is up to 20 km, followed by one additional day for every further 20 km or part. The 200 km threshold reflects Notification 94/2020, effective 1 January 2021; the cited rules PDF is amended as of 1 January 2022. See the CBIC amended CGST Rules PDF.

The E-Way Bill System FAQ says validity starts when the first transport detail is entered in Part B: vehicle details for road, or the first transport-document number for rail, air or ship. It also says validity expires at midnight on the last validity day and is not recalculated for later Part B entries. Because the official materials do not present the starting point identically, use the particular bill’s displayed expiry in the live system rather than calculating a timestamp from distance alone. The FAQ is available at E-Way Bill System FAQ.

CBIC’s amended PDF reflects the 200 km and 20 km bands, while a separate CBIC HTML rules page has displayed older distance bands. Do not rely on that older table as the current rule; check the bill and the latest official rules or notifications for the applicable date.

Can you extend an expired e-way bill?

Yes, the official FAQ describes extensions for exceptional circumstances, including natural calamity, law-and-order problems, trans-shipment delay, or an accident involving the conveyance. It says the transporter must explain the reason in detail and provide the bill number, current location, approximate remaining distance, and Part B information. The FAQ states: “However, under circumstance of ‘exceptional nature and trans-shipment’, the transporter may extend the validity period after updating reason for the extension and the details in PART-B of FORM GST EWB-01.”

The GSTN/NIC API documentation specifies an extension window from eight hours before to eight hours after expiry. It assigns the extension to the current transporter; if none is assigned, the generator can update. It also describes a technical validation limit against extending a bill beyond 360 days from generation. That limit is not permission to move goods on an expired bill without a valid extension. Technical documentation can change, so confirm the live portal workflow for edge cases. See GSTN/NIC Extend Validity API documentation and the GSTN E-Way Bill API Developer Portal.

The FAQ characterizes the timing option as available “before 8 hours and after 8 hours of expiry of the validity.” For an operational decision, follow the live system’s displayed eligibility and the API documentation’s stated eight-hours-before-to-eight-hours-after window.

Does an expired e-way bill mean an automatic GST penalty?

No single automatic fine for every expiry scenario is established by the cited materials. The practical risk is that moving goods after expiry may amount to transport in contravention of the Act or rules. Section 129 of the CGST Act allows goods and conveyances to be detained or seized in such circumstances. It sets out a notice and opportunity-of-hearing process before the proper officer determines the applicable tax and penalty. Read the CBIC text of the CGST Act.

Section 129 provides different payment-based release calculations depending in part on whether the owner comes forward. Where the owner does, the provision describes payment of applicable tax plus a penalty equal to 100% of the tax payable on the goods; exempt goods have a separate formula. Where the owner does not come forward, another calculation tied to the goods’ value and tax applies. The section also provides for release on furnishing security equivalent to the amount payable under the relevant provision.

Which route or amount applies depends on the goods’ taxable or exempt status, their value and applicable tax, whether the owner claims release, and the facts of the alleged contravention. An individual liability cannot be determined from expiry alone. Do not assume that a short delay guarantees no enforcement, or that every expiry leads to the same amount.

Is confiscation the routine consequence?

No. Section 130 includes confiscation grounds involving specified contraventions with intent to evade payment of tax. The cited provisions do not make confiscation an automatic consequence of an expired e-way bill. Detention, release and any further action depend on the facts and applicable statutory process.

What details should the extension request contain?

  • Reason: a specific and truthful explanation of the exceptional delay, rather than a generic entry.
  • Present location: where the goods and conveyance are when the request is made.
  • Distance remaining: the approximate distance still to be travelled.
  • Transport information: the updated Part B or mode-specific vehicle or transport-document details required by the system.
  • Supporting records: retain relevant evidence of the disruption and the extension record with the consignment papers.

The last item is a prudent recordkeeping practice; the cited portal passages do not identify those supporting records as an additional statutory submission requirement.
