Ab dem 18. Februar 2027 müssen Akkus, die unter die EU-Regeln für leichte Verkehrsmittelbatterien fallen, während der Lebensdauer des Produkts von unabhängigen Fachleuten ausgebaut und ersetzt werden können. Für Ersatzakkus gilt eine Verfügbarkeit von mindestens fünf Jahren – gerechnet ab dem Zeitpunkt, zu dem das letzte Exemplar des jeweiligen Gerätemodells auf den Markt gebracht wurde, nicht ab dem Kaufdatum des einzelnen Fahrrads. Das bedeutet weder, dass jeder Besitzer den Akku selbst wechseln darf, noch dass Akkus verschiedener Marken austauschbar werden.
Welche E-Bike-Akkus fallen unter die Regel?
Die EU-Batterieverordnung gilt nicht pauschal für jede Batterie, nur weil sie als E-Bike-Akku verkauft wird. Entscheidend ist die gesetzliche Definition der „Batterie für leichte Verkehrsmittel“ (LMT-Batterie): Sie ist versiegelt, wiegt höchstens 25 kg, liefert Antriebsenergie für ein Fahrzeug mit Rädern, das allein durch einen Elektromotor oder durch Elektromotor und menschliche Kraft bewegt wird, und ist keine Batterie für ein Elektrofahrzeug. Die EU-Kommission nennt Elektrofahrräder ausdrücklich als Beispiel. Im Einzelfall ist die gesetzliche Definition maßgeblich, nicht allein die Produktbezeichnung. Muss der Akku meines E-Bikes ab 2027 wechselbar sein?
Für betroffene Produkte gilt Artikel 11 ab dem 18. Februar 2027. Bei einem Produkt mit LMT-Batterie müssen der Akku und seine einzelnen Zellen so gestaltet sein, dass unabhängige Fachleute sie während der Lebensdauer des Produkts leicht ausbauen und ersetzen können. Die Pflicht gilt für Produkte, die ab diesem Datum auf den Markt gebracht werden; die Kommission stellt klar, dass sie nicht nachträglich für Produkte greift, die vorher auf den Markt kamen. Maßgeblich ist das Bereitstellen des Produkts auf dem Markt, nicht das Jahr, in dem ein Käufer es später erwirbt. Artikel 11 der Verordnung; Kommissionsmitteilung C/2025/214 vom 10. Januar 2025.
Wer darf den E-Bike-Akku wechseln?
Die LMT-Regel verlangt die Austauschbarkeit durch einen unabhängigen Fachmann; sie begründet nicht dieselbe Pflicht zur Entnahme durch den Endnutzer, die Artikel 11 für bestimmte tragbare Batterien vorsieht. Die Kommission beschreibt unabhängige Fachleute als technisch kompetente und qualifizierte Personen, die Reparaturen gewerblich und/oder in gewerblichen Räumen ausführen. Ob sich ein Akku im Alltag einfach herausnehmen lässt, ist daher nicht der rechtliche Maßstab für diese Regel.

Auch Befestigungen gehören zur praktischen Austauschbarkeit: Wiederverwendbare Schrauben oder andere Verschlüsse können erneut verwendet werden. Nicht wiederverwendbare Befestigungsteile, die für Ausbau und Wiedereinbau erforderlich sind, sollen ebenfalls als Ersatzteile verfügbar sein. Wie lange müssen Ersatzakkus verfügbar sein?
Der Hersteller muss Ersatzbatterien für das betreffende Gerätemodell mindestens fünf Jahre lang bereithalten, gerechnet ab dem Zeitpunkt, an dem das letzte Exemplar dieses Modells auf den Markt gebracht wurde. Der Zeitraum beginnt also nicht automatisch mit dem Kauf, dem ersten Verkauf im Laden oder der Registrierung des Fahrrads. Das Gesetz verlangt außerdem einen angemessenen und diskriminierungsfreien Preis für unabhängige Fachleute und Endnutzer; es setzt keinen konkreten Eurobetrag fest. Kann ich jeden passenden E-Bike-Akku verwenden?
Nein. Ein Ersatzakku muss kompatibel sein und darf Funktion, Leistung oder Sicherheit des Produkts nicht beeinträchtigen. Bei typgenehmigten Fahrzeugen darf der Austausch laut Kommissionsauslegung auch die Typgenehmigungsspezifikationen nicht verändern. Die Verordnung schafft damit keine universelle Passform und keine Pflicht zur markenübergreifenden Austauschbarkeit. Vor der Bestellung sollten Besitzer das genaue Fahrradmodell und das verwendete Akkusystem prüfen und die Kompatibilität beim Hersteller oder einer qualifizierten Werkstatt bestätigen lassen.
Auch Software darf einen zulässigen Ersatz nicht vereiteln. Artikel 11 Absatz 8 verbietet es, Software einzusetzen, um den Austausch einer LMT-Batterie oder ihrer wesentlichen Komponenten durch kompatible Teile zu behindern. Softwarekommunikation zur Gewährleistung von Sicherheit und korrekter Funktion bleibt möglich, darf den kompatiblen Austausch aber nicht blockieren.
