Don’t Let a Crypto Inheritance Get Stuck on the Blockchain

Bitcoin and other digital assets do not pass to heirs simply because a person has died. The blockchain records ownership changes, but a self-custodied asset can be moved only with the private key or recovery phrase. If heirs cannot find the right credentials, the asset may remain visible on-chain yet practically inaccessible.

A workable plan has two separate parts: legal authority for someone to act and secure operational instructions that let that person locate and use the accounts. Keep those parts current, and keep secret credentials out of a publicly filed will.

What heirs actually need to inherit crypto

For a self-custodied wallet, control comes from a private key, often represented by a 12- or 24-word recovery phrase, plus any required PIN, passphrase or device. The American Bar Association warns that without the recovery phrase or PIN, access is almost impossible. The U.S. Securities and Exchange Commission describes self-custody as retaining exclusive control of the private keys and assets.

The blockchain itself cannot identify an heir, reset a wallet or recreate a missing phrase. It can show public addresses and transaction history, but those records do not provide signing authority. The IRS has also explained that digital assets are not actually stored in wallets; wallets hold or manage the credentials used to control assets recorded on a distributed ledger.

Start with a complete digital-asset inventory

Make a private inventory that a trusted fiduciary can find and understand. Review paper records, password-manager entries, tax files, email receipts and devices, then update the inventory whenever an account or wallet changes.

Accounts and devices to list

  • Every cryptocurrency exchange and other custodial account.
  • Hardware, desktop, browser-extension and mobile wallets.
  • Public blockchain addresses, NFT marketplaces and domain or naming accounts.
  • Staking, lending, liquidity or validator positions, including the network used.
  • Cloud backups, encrypted drives, phones, computers and authentication devices needed to sign in.
  • Stablecoins, wrapped assets, tokens on less familiar networks and assets held through decentralized applications.

What to record for each item

  • The service or wallet name, account identifier and public addresses.
  • The network and asset type, because an address on one network may not accept an asset from another.
  • Where recovery instructions, passwords, PINs and backup devices are stored, without copying the secrets into a public document.
  • Any two-factor-authentication method, withdrawal whitelist, spending limit or time-lock that could delay a transfer.
  • The date the entry was last checked and the person responsible for updating it.

Do not put a seed phrase, private key or full password in a will that may become part of a public probate file. The inventory should tell the fiduciary where a protected record is held, not reveal the secret itself.

Separate legal authority from operational access

A will, revocable trust, power of attorney or similar instrument can authorize a representative to locate, manage and transfer digital property. None of those documents can generate a missing private key. Conversely, handing someone a seed phrase without legal authority can create disputes over whether that person was permitted to use it.

Coordinate the estate documents with the operational instructions. The documents should identify who may act, what powers they have and how digital assets should be handled. A separate instruction letter can explain where the inventory and backups are stored, how devices are identified and which assets should be held, sold or transferred. Have a lawyer familiar with digital-asset and estate law review the plan under the law of the relevant state.

Determine who controls each asset

The handoff process depends on custody. An exchange or other hosted service controls or administers key access and normally requires its own death, probate, identity and documentation process. In self-custody, the owner or designated keyholders control the credentials; a court cannot recreate a phrase that no one has preserved.

Issue Custodial account Self-custodied wallet
Who controls signing keys The provider controls or administers access under its terms. The owner or named keyholders control the private keys.
After death Heirs follow the provider’s identity, death-notice and probate procedure. The fiduciary must locate the wallet, device and valid recovery credentials.
Provider dependency Access depends on the provider’s systems, records and continued operation. No provider can restore a missing phrase; heirs bear the recovery responsibility.
Privacy and records The provider may hold identity and transaction records and may disclose them under its process. The family may have less centralized documentation and must preserve records themselves.
Insolvency or account restrictions Access can be affected by freezes, terms of service or insolvency proceedings. There is no account administrator to appeal to, but the keys remain under the owner’s control.

Label each holding in the inventory as custodial or self-custodied. Treat a wallet connected to an exchange or application as a separate risk: the wallet keys and the application account may require different credentials and procedures.

Design Strength Main failure mode Maintenance needed
Single hardware or cold wallet with documented recovery Simple ownership and a clear recovery path when the device and backups are protected. One lost or exposed phrase can make recovery impossible or allow theft. Keep instructions, firmware notes and backup locations current; test recovery safely.
Multisignature wallet Several keys can provide resilience and reduce dependence on one person or location. Heirs may not know which participants, devices or signing rules are required. Maintain keyholder contact information, quorum rules and replacement procedures.
Separate instruction letter Explains discovery, sequence and contacts without placing secrets in the will. Instructions can become stale or reveal too much if stored insecurely. Review after every wallet, device, address or fiduciary change.
Automated dead-man’s switch May alert a chosen person after missed check-ins. False triggers, service failure, forgotten passwords or premature disclosure can expose assets. Frequent monitoring, reliable contacts and a tested cancellation process.

A hardware wallet is only a storage and signing device; it does not create legal authority or substitute for a recovery plan. Multisignature arrangements can improve resilience, but they also require precise documentation and coordination among keyholders. Automated release systems carry substantial maintenance risk and should not be treated as set-and-forget estate planning.

Protect recovery records without making them impossible to find

Use a durable, confidential backup for seed phrases and PINs, with geographic redundancy appropriate to the value and threat model. Keep access instructions separate from the secret where practical. A backup that is fireproof but no one can locate is not a recovery plan; a backup that is easy to photograph or copy is a security liability.

Checks for a physical or encrypted backup

  • Can the designated fiduciary identify the container or encrypted file without seeing the secret in the will?
  • Are there two independent locations in case of fire, flood, theft or a single-custodian failure?
  • Does the plan document an additional passphrase, PIN or derivation setting, if one is used?
  • Has recovery been tested on a spare or wiped device without broadcasting a transaction?
  • Are instructions updated after a wallet migration, firmware change or replacement of a keyholder?

Do not email an unencrypted phrase, photograph it to a shared photo library or enter it into an unknown website claiming to provide recovery help. Anyone who obtains the phrase may be able to move the assets without further approval.

Preserve the records needed for taxes

Inheritance planning is also recordkeeping. Maintain acquisition dates, purchase amounts, cost basis, wallet-to-wallet transfers, staking or mining income, forks, airdrops and disposition history. Keep transaction exports and notes that explain transfers between addresses controlled by the same person; otherwise an heir or tax preparer may mistake an internal transfer for a sale.

IRS guidance addresses basis allocation among wallets and accounts and reporting obligations for digital-asset transactions. Under 26 U.S.C. §1014, inherited property generally receives a basis equal to fair market value at the decedent’s death, subject to exceptions and other tax rules. The exact result can depend on the asset, the estate, the beneficiary and the jurisdiction, so preserve valuation evidence and obtain current tax advice rather than assuming every token follows one treatment.

What the fiduciary should do after death

  1. Secure the environment. Preserve phones, computers, hardware wallets, written records and encrypted drives. Do not reset a device, erase a password manager or install untrusted recovery software.
  2. Establish authority. Obtain the death certificate and the documents proving the fiduciary’s authority. Notify custodial providers through their published estate process and follow their identity and probate requirements.
  3. Map the holdings. Match the inventory to public addresses, account statements and tax records. Treat unfamiliar addresses as leads, not proof of ownership.
  4. Recover cautiously. Use the documented device and recovery procedure. Verify the network, destination address and transaction details on a trusted screen before signing.
  5. Preserve evidence. Save statements, transaction IDs, valuations at the date of death and copies of provider correspondence. Keep an audit trail for the estate and tax return.
  6. Get specialist help when anything is unclear. If a phrase is incomplete, a PIN is uncertain, a device is damaged or ownership is disputed, stop guessing and consult professionals experienced in digital-asset recovery and estate administration.

Common mistakes that make recovery harder

  • Relying on the blockchain as a backup: Public transaction history cannot replace a signing key.
  • Putting secrets in the will: Probate filings may expose the phrase to people who should never see it.
  • Listing only an exchange: A separate self-custodied wallet, NFT account or staking position can be missed.
  • Ignoring passphrases and PINs: A seed phrase alone may not recreate the wallet configuration.
  • Failing to update after a move: An old address or obsolete device instruction can send heirs down the wrong path.
  • Guessing credentials: Repeated PIN attempts, firmware resets or improvised software can trigger lockouts or destroy evidence.
  • Skipping tax documentation: Without basis and transfer records, the estate may face avoidable reporting errors or an inability to substantiate a valuation.

Limits of a U.S.-centered plan

Probate, privacy, unclaimed-property, securities and estate-tax rules vary by state and country. Exchange terms and IRS reporting requirements can change. Review the operational instructions and provider procedures periodically, and obtain advice from a qualified estate attorney and tax professional for the jurisdictions involved.
