Federal prosecutors allege that Abdulrahman Alfozan, a 35-year-old OpenAI engineer, planted an encrypted audio-recording device in the company’s San Francisco executive conference room and used a chatbot account associated with his wife to work out how to build and conceal it. He was arrested on October 9, 2026, and charged under the federal statute covering interception of oral communications.
The public record describes allegations, not a conviction. It also does not identify the chatbot service as ChatGPT.

What the Justice Department says happened
The arrest and charge
The U.S. Department of Justice announced the case on October 13, 2026. The complaint alleges that Alfozan, a Saudi national employed by OpenAI since July 2025, used or attempted to use an electronic, mechanical or other device to intercept oral communications. The FBI investigation remains open, and the public record reports no conviction.

OpenAI personnel allegedly discovered a covert audio recorder on or about September 30. According to the complaint, someone had inserted it into a USB port on the back of a television in an executive conference room and hidden it in toilet paper. Investigators believe it was installed around September 28. The contents were encrypted.

The room was used for conversations about proprietary research, product plans, technical capabilities, business-development opportunities, government engagements and other confidential strategy. FBI Director Kash Patel described the allegation this way: “According to the complaint unsealed today, Abdulrahman Alfozan allegedly concealed a covert recording device inside his employer’s executive conference room to secretly capture sensitive communications about the company’s super intelligence technology.”
Physical-access evidence
The complaint says security-camera footage placed Alfozan near the room on several dates even though he was not authorized to enter it or attend its meetings. On October 5, footage allegedly showed him looking behind the television. Security staff also allegedly found a second similar recorder in an unattended bag that he had left in another OpenAI room.

Prompts about constructing and hiding a recorder
Between September 24 and September 30, an account associated with Alfozan’s spouse allegedly submitted prompts about building, customizing, installing, testing, concealing and remotely accessing a recording device. The topics quoted by the DOJ included building a “continuous audio recorder,” customizing Wi-Fi connectivity, improving audio and live listening, and encrypting an SD card.

The account allegedly referred to the recovered device’s custom header and unique MAC address on September 27 and 28. Those references are significant because they appear, according to the complaint, to connect the account’s technical discussions with a particular piece of hardware rather than with a generic question about surveillance equipment.
Why “ChatGPT” is not established
The DOJ release calls it a “chatbot account” and does not name the service. Independent reporting likewise says the provider has not been identified. The public record therefore supports describing it as a spouse-associated chatbot account, but not claiming that it was definitely ChatGPT or any other named product.
How OpenAI says its models helped identify an employee
OpenAI said it used its own models to analyze the device and determine where it came from. The company’s statement was: “We used our models to understand the device and where it had come from, identifying that a specific employee had planted it a few days earlier.” OpenAI said it terminated the employee and referred the matter to the FBI.

That account presents AI as part of the detection and attribution process. The allegations separately describe a chatbot account being used for technical planning. The available statements do not establish that the same model, service or workflow was involved in both activities, and they do not show that AI independently proved who planted the recorder without conventional evidence such as camera footage, account records and hardware analysis.

Why the evidence matters in an insider-threat case
The allegations combine several evidence types rather than relying on the chatbot prompts alone:
- Physical access: CCTV allegedly placed Alfozan near a room he was not authorized to enter, including footage of him looking behind the television.
- Device forensics: Investigators allegedly recovered an encrypted recorder, identified its custom header and matched a unique MAC address.
- Account metadata and prompts: A spouse-associated account allegedly discussed the same functions found in the device and referenced its identifying details.
- Additional physical evidence: A second similar device was allegedly found in a bag left in another OpenAI room.
- Legal posture: These facts appear in a criminal complaint supporting an arrest and charge, not in a final judgment.
Together, those categories could help investigators connect planning, hardware and opportunity. They still do not resolve questions that only further investigation or court proceedings can answer, including intent, authorization, the destination of any recordings and whether anyone else participated.

Potential penalty and next steps
The DOJ says a conviction on the charged offense carries a maximum sentence of five years in prison, a $250,000 fine and three years of supervised release. “Maximum” penalties are statutory limits, not a prediction of the sentence in this case. The FBI investigation is ongoing, and the allegations may be contested as the case proceeds.
For now, the narrowest accurate summary is that prosecutors allege an OpenAI engineer planted a concealed recorder in a sensitive conference room and that a chatbot account associated with his wife generated prompts matching the device’s capabilities and identifiers. OpenAI says its models helped trace the device to an employee, while also saying it found no indication of improper access to model weights, source code or customer data.
