Short answer: Microsoft owns several U.S. trademark registrations involving X, but that does not mean it owns the letter for every use or can automatically stop Elon Musk’s X Corp. from using X for a social network. U.S. trademark rights depend on the goods or services covered and whether consumers are likely to confuse the businesses.
What does it mean to own an “X” trademark?
A trademark identifies the source of particular goods or services. A registration is tied to the goods or services listed for that mark; it does not grant general ownership of a word or letter in every context. The U.S. Patent and Trademark Office puts it plainly: “However, you don’t have rights to the word or phrase in general, only to how that word or phrase is used with your specific goods or services.” USPTO: What is a trademark?

That is why different businesses can sometimes use the same short mark. A mark used for software, for example, does not automatically block an unrelated business from using the same word for a distinct offering. The important question is not only whether the names match, but whether the relevant goods or services and marketplace circumstances make consumer confusion likely.

The USPTO describes the central issue as likelihood of confusion: whether consumers could mistakenly believe that the goods or services come from the same source or from affiliated businesses. Its analysis considers factors including how similar the marks look, sound, or convey meaning, and whether the parties’ goods or services are related. For a dispute involving X, the comparison would therefore need to account for the exact wording or design, the registration and its listed goods or services, and the relationship between the parties’ offerings. A registration for one kind of product or service is not, by itself, proof that every other use of X infringes.
What Microsoft’s trademark record establishes
Microsoft has multiple U.S. registrations involving X, including X and Series X marks. The USPTO Trademark Trial and Appeal Board record for proceeding 91294464 shows Microsoft opposed an X application by Thoth Holdings. That record concerns Thoth Holdings’ application. It is not a ruling that X Corp.’s social-network branding infringes Microsoft’s marks, and it does not establish that Microsoft sued Musk over the rebrand. The reviewed official record does not establish a final merits decision between Microsoft and X Corp. on this issue.
What X Corp. says about the rebrand
In a pleading filed December 16, 2025, X Corp. says Twitter rebranded to X in 2023 and asserts that it continues to use and maintain rights in TWITTER marks. Could Microsoft’s brand rules decide the issue?
Microsoft’s published brand guidance says wordmarks may generally be used truthfully when the use does not confuse the public about affiliation or endorsement. That is Microsoft’s own usage guidance; it is not a court decision about X Corp.’s specific branding or a substitute for the legal analysis of a particular dispute. Why geography and the exact mark matter
