Does GST Apply to Software Subscriptions Bought From Overseas Vendors? A Country-by-Country Guide

Sometimes—but there is no worldwide GST rule. The answer depends on the country where the subscription is consumed, whether the buyer is a consumer or a registered business, how the software is supplied, and whether the vendor or the customer is responsible for accounting for tax. An overseas provider may add local GST at checkout, a marketplace may collect it, or a business customer may need to self-assess tax under a reverse-charge or imported-services rule. An invoice with no tax does not, by itself, prove that no tax is payable.

Why the buyer’s country decides the result

“GST” is a general name for a consumption tax, not one global system. Singapore, New Zealand, India, Australia and Canada each set their own rules for cross-border digital supplies. The same annual software plan can therefore be taxed differently for customers in different countries.

Tax authorities usually look at where the customer is located or where the service is treated as consumed, rather than where the vendor’s servers or headquarters are located. Payment currency is also not decisive. For example, India’s tax guidance says the currency used for a transaction does not determine whether the conditions for an imported service are met.

Before deciding whether tax is due, establish four facts:

  • Supply type: automated software access or download, a human-delivered service, or a bundle containing both.
  • Business use: whether the subscription supports taxable business activities and can qualify for any input-tax recovery under local law.

Who may have to account for the tax?

Cross-border digital-tax systems generally assign responsibility to one of three parties. The allocation is jurisdiction-specific, so these categories are a way to analyse a transaction, not a universal hierarchy.

The overseas vendor

Many countries require a non-resident supplier to register once it makes relevant business-to-consumer digital supplies. The vendor then determines the customer’s location, adds the local tax to the checkout price or invoice, files returns and remits the amount. A vendor’s registration status and the transaction’s facts matter; not every overseas provider is required to register.

A marketplace or distribution platform

Where software is sold through an app store, marketplace or other electronic platform, local law can treat the platform as the supplier for tax purposes. The platform may collect GST or a similar tax even when the software developer is outside the country. Check which entity appears as the seller and which tax registration number is shown on the receipt.

The customer under reverse charge

For some business purchases, the recipient—not the overseas supplier—must calculate tax and report it on its own return. This is commonly called reverse charge, recipient accounting or an imported-services rule. A business may also need to determine separately whether the self-assessed amount is eligible for an input-tax credit. Registration alone does not guarantee a credit; the purchase must meet the local rules and be connected with eligible taxable activities.

How selected countries treat overseas software subscriptions

The examples below show why a country and buyer-status analysis is essential. They are not interchangeable rules and do not establish the position in every jurisdiction.

Jurisdiction How software is classified Typical responsibility described by the tax authority Important qualification
Singapore Software and cloud storage are examples of remote services. An overseas vendor may need to register and collect GST on relevant business-to-consumer supplies. Verify that the provider is registered and that the transaction falls within the overseas-vendor regime; not every overseas vendor must charge GST.
New Zealand Software and software maintenance are remote services. A non-resident supplying New Zealand tax-resident customers may have to register, collect and return GST. A supplier does not need to register under this rule when it supplies remote services only to GST-registered New Zealand businesses for their business use.
India Online software and cloud services can fall within “online information and database access or retrieval” (OIDAR). For qualifying OIDAR supplied to an unregistered, non-taxable online recipient, the overseas supplier is assigned registration and payment responsibility. A registered business buyer may instead owe IGST under reverse charge when import-of-service conditions are met. The overseas supplier, Indian recipient and place-of-supply requirements must all be examined; classification and current amendments can change the result.
Australia Software subscriptions can be offshore supplies of intangibles. A recipient-side reverse charge can apply to certain offshore intangible supplies bought by a registered or required-to-register recipient. The connection and purpose requirements must be met, and the rule is excluded to the extent the supply is GST-free or input taxed. Business software is not automatically reverse charged.
Canada Digital products and services are covered by cross-border GST/HST measures. Supplier and distribution-platform obligations depend on the particular supply and regime. Canada uses GST/HST rather than a single GST model; determine the applicable measure for the customer’s province and transaction structure.
United Kingdom Software and updates are treated as digital services for VAT purposes. For many cross-border business-to-business supplies, the customer accounts for VAT due in the customer’s country; business-to-consumer rules focus on consumer location. The UK tax is VAT, not GST. Do not transfer the UK treatment to a GST jurisdiction without checking local law.

Singapore: check whether the overseas provider is GST-registered

Singapore’s tax authority expressly includes software and cloud storage among remote services bought from overseas providers. For relevant business-to-consumer supplies, the overseas-vendor-registration regime can require the non-resident provider to register, charge GST and account for it to Singapore.

That does not mean every overseas software company must add Singapore GST. Review the provider’s account page, invoice and tax registration details. A platform can also be the collecting party. If the receipt is silent, confirm the supplier’s status and the nature of the subscription rather than assuming the purchase is outside GST.

New Zealand: remote-service rules distinguish consumers and registered businesses

New Zealand’s Inland Revenue guidance treats software and software maintenance as remote services. A non-resident supplier serving New Zealand tax-resident customers may have to register, collect and return GST.

There is an important business-customer limitation: a supplier does not need to register under this remote-services rule when it supplies those services only to GST-registered New Zealand businesses for their business use. The customer should be able to substantiate its GST-registration status and business purpose. A mixed customer base, private use or an unregistered business can produce a different result.

India: import of services, OIDAR and reverse charge

When a subscription is an imported service

Under India’s Integrated Goods and Services Tax framework, an import of services requires an overseas supplier, a recipient in India and a place of supply in India. When those conditions are met, an Indian GST-registered business buying foreign software for its firm can owe IGST under reverse charge, according to the Central Board of Indirect Taxes and Customs FAQ.

The payment currency does not change that analysis. Paying in US dollars, euros or another currency is not a substitute for checking the supplier, recipient and place-of-supply conditions.

When OIDAR rules place the obligation on the supplier

The OIDAR definition covers software and cloud services delivered online, and the supply is generally located at the recipient’s location. For a qualifying OIDAR supply to an unregistered, non-taxable online recipient, the statutory mechanism assigns registration and payment responsibility to the overseas supplier. An individual subscriber may therefore see IGST collected by the provider, while a registered business may need to evaluate reverse charge instead.

  • Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft

Service classification, the recipient’s registration status and amendments to the law still matter. Keep the contract, invoice, evidence of the customer’s Indian location and records showing whether the account is used for business.

Australia: reverse charge is conditional, not automatic

Australia’s ATO ruling describes a reverse-charge rule for certain offshore supplies of intangibles. Recipient-side GST applies only when the recipient is registered or required to register, the statutory connection requirement is satisfied and the purpose requirement is met.

The supply is excluded to the extent it is GST-free or input taxed. Consequently, “the subscription is for business” is not enough on its own. Determine the entity’s registration position, how and where the service is connected with Australia, and the extent to which it supports the required business purpose before self-assessing.

Canada and the United Kingdom: useful comparisons, different taxes

Canada’s CRA has measures for cross-border digital products and services under the GST/HST system. Depending on the supply and the regime, obligations can rest with the non-resident supplier or a distribution platform. The province connected with the customer and the way the subscription is sold can affect the applicable treatment.

The United Kingdom uses VAT. HMRC identifies software and updates as digital services. For cross-border business-to-business transactions, HMRC states that the customer is responsible for accounting for VAT due in the customer’s country, while business-to-consumer rules focus on the consumer’s location. These are comparative examples only: UK VAT terminology and procedures should not be presented as a GST rule for another country.

A practical decision process for any overseas subscription

  1. Locate the customer. Use the country where the individual resides or where the business receives and uses the subscription. Check whether local rules use billing address, business establishment, usual residence or another evidence standard.
  2. Confirm the customer’s status. Decide whether the purchaser is a private consumer, GST-registered business or unregistered business. A company email address or company card does not, by itself, prove tax registration.
  3. Read the contract description. Separate automated access or downloads from human consulting, implementation or support. A bundle can contain more than one taxable supply.
  4. Inspect the checkout and invoice. Look for the vendor or platform’s legal name, tax registration number, tax rate, tax amount and wording such as “reverse charge.” Save the invoice and the account details used to establish location.
  5. Test vendor or platform collection. If local law uses an overseas-vendor or marketplace regime, determine whether the seller is registered and whether the charge shown is the local consumption tax.
  6. Test reverse charge for a business. Check the local imported-services rule, registration threshold, connection or place-of-supply test, business-purpose test and any GST-free or input-taxed exclusion.
  7. Assess input-tax recovery separately. A tax amount shown on an invoice or self-assessed under reverse charge does not automatically become recoverable. Confirm the customer’s taxable activities, documentation and apportionment requirements.
  8. Check the period covered. Tax rules and registration positions can change. Verify current guidance for the country and the subscription period, especially for annual plans renewed after a law change.
  9. Escalate uncertain cases. Ask a qualified local tax professional when the subscription is bundled, used partly privately, purchased through a platform, or material enough that a classification or credit error would be costly.

Common mistakes and how to correct them

“The vendor is overseas, so no GST applies.”

Cross-border digital-service regimes are designed precisely to address non-resident suppliers. Re-check the customer’s country, supplier registration and consumer-versus-business rules.

“No tax appears on the invoice, so the purchase is tax-free.”

An overseas supplier may not be required to collect the tax, or the customer may have a reverse-charge obligation. Ask whether recipient accounting applies before closing the transaction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“It is software, so every country treats it the same way.”

Singapore and New Zealand expressly include software in remote services; India’s OIDAR framework and Australia’s intangible-supply rules use their own tests. Classification and place of supply must be checked locally.

“A business purchase always produces an input credit.”

Credit entitlement is a separate question from liability. Local law may require taxable business use, valid records, apportionment or other conditions, and some supplies can be excluded as input taxed.

“The billing currency determines the tax.”

Currency is not a substitute for the legal tests. India’s CBIC FAQ specifically states that currency is immaterial to whether the import-of-service conditions are met.

Records to retain

  • The order confirmation, subscription agreement and renewal notices.
  • Invoices or receipts showing the seller, platform, tax number and tax amount.
  • Evidence of the customer’s country and, for businesses, GST/VAT registration details.
  • Notes describing whether the software is automated, bundled with services, or used partly privately.
  • Reverse-charge calculations, tax-return entries and input-credit apportionment workpapers where applicable.
  • The tax authority guidance relied on for the relevant country and accounting period.

Bottom line for buyers

Do not decide from the vendor’s location or the presence of a tax line alone. Identify the customer’s country and status, classify the subscription, establish whether the vendor or platform must collect tax, and then test any reverse-charge and input-credit rules that apply to the buyer. Singapore, New Zealand, India, Australia and Canada demonstrate different outcomes; a country-specific answer is required before recording the purchase or filing a return.
