DOE rescinds Title IX protections for LGBTQ students: What changed in 2026

On September 29, 2026, the U.S. Department of Education (DOE) put a final rule into effect that repeals its 2024 Title IX regulation and restores the pre-2024 regulatory text, with specified exceptions. The change removes the 2024 rule’s explicit regulatory approach to sex discrimination, including its treatment of gender identity. It does not, by itself, establish that LGBTQ students have no protections under other laws or school policies.

What the 2026 Title IX action does

The final rule, titled “Recodification of Title IX Rules,” was published in the Federal Register and took effect on September 29, 2026. The Department describes the action as a formal rescission of its 2024 rule and says it reinstates the 2020 regulation. More precisely, the final rule returns the Code of Federal Regulations to its pre-2024-rule appearance, subject to exceptions.

The Department says the 2024 rule’s text remained in the Code of Federal Regulations after courts blocked or vacated it, leaving the published text out of step with the rules the Department considered operative. The recodification is intended to make the applicable regulatory text easier for schools, students, and parents to identify.

What changed for LGBTQ students

The 2024 rule set out an explicit regulatory approach to sex discrimination that included gender identity. The 2026 rule removes that text and restores the prior regulatory text. As a result, the explicit protections in the 2024 Title IX regulation are no longer part of the operative federal regulation.

That is a statement about the federal Title IX regulations—not a determination that every LGBTQ student protection has disappeared. The 2026 rule does not resolve the effect of state law, district or school policy, other federal statutes, or separate legal claims. A student’s options in a specific situation depend on the law and facts that apply there.

How the 2024 rule reached this point

The Department’s 2026 rule gives this account of the litigation over the 2024 regulation:

  • Eight courts preliminarily enjoined enforcement of the 2024 rule between June 13 and August 22, 2024, according to the Department.
  • In two cases, courts later vacated the 2024 rule in full in final orders dated January 9 and February 19, 2025, according to the Department.
  • The Department says it had not enforced the 2024 rule for more than a year and a half before the September 2026 final rule. That is the agency’s account, not an independently measured enforcement statistic.

The Department’s stated reason for recodifying the regulations is that the 2024 rule had been vacated and was not enforceable nationwide. These litigation counts describe court actions reported by the Department; they are not measures of student outcomes.

What the restoration does not bring back

The 2026 rule does not restore every element of the pre-2024 text. The Department identifies several exceptions:

  • It does not reinstate obsolete adjustment-period and review provisions.
  • It does not restore an appendix that had since been removed.

The Department characterizes these as minor changes and says it chose not to reintroduce language that was obsolete or had already been vacated.

What students, parents, and schools should take from the change

For understanding a particular complaint or dispute, keep the federal regulation distinct from other possible sources of protection. The 2026 action tells readers what text DOE has placed back in the federal Title IX regulations; it does not answer whether a state rule, school policy, another federal law, or a separate legal theory applies to an individual case.

The Department’s final rule states: “The Department takes this action because the 2024 final rule has been vacated and is not enforceable nationwide.” It also says: “This final action does not reopen debate on the 2020 Rule or the 2024 Rule.”
