Before renting out a driveway, garage or allocated parking bay, check that you have the right to let someone else use it, whether a landlord, lender, freeholder or building rules require consent, what local rules apply, and whether your insurer covers paid parking and third-party access. The answer depends on your location, property rights and policy wording; there is no universal permission or insurance rule.
First, make sure you have the right to offer the space
Owning or using a parking space does not always mean you can rent it to someone else. Your authority may depend on how the space is held and on restrictions attached to the property. In England, leasehold conditions are set out in the lease, and failing to follow them can have legal consequences. GOV.UK explains leasehold property and lease terms.

- Owner-occupied home: Check whether a mortgage or other property agreement restricts letting or commercial use. GOV.UK notes that permission for a home business may depend on circumstances and may involve a mortgage provider or landlord. Read the GOV.UK guidance on running a business from home.
- Rented home: Check your tenancy and ask your landlord if it restricts subletting, business activity, access or use of the property. Do not assume that being allowed to park there lets you grant someone else access.
- Leasehold or shared building: Check the lease, parking allocation and building rules. Ask the freeholder, managing agent or building manager if the documents require consent or do not clearly give you authority to let the bay.
- Separately owned or controlled space: Confirm that your ownership or other rights include the ability to let it, and check for local restrictions and any relevant access arrangements.
Look specifically for clauses about subletting, business use, parking, visitors, access, nuisance and insurance. If authority is unclear, obtain written clarification before advertising or accepting payment.

In England, government guidance says renting out an existing parking space should be possible without planning permission if there are no substantive planning concerns. That is a qualified, England-specific baseline, not a rule for every country or property. The local planning authority decides whether a particular use amounts to a material change and whether other planning restrictions apply. See the GOV.UK planning guidance.

The circumstances matter: the scale and character of the use, nuisance to neighbours and any existing planning conditions can affect the answer. Ask your local planning authority about your particular space and proposed arrangement. Outside England, check the relevant local authority’s rules rather than relying on this guidance.
Will your insurance cover it?
Do not assume standard home or building insurance covers paid parking or a driver’s access to your property. GOV.UK warns that home insurance may not cover business activity. Its home-business guidance also advises checking with your insurer. A London borough’s guidance in a subletting context cautions that building insurance might not cover accidental damage and advises informing the authority so cover can be checked. See the Royal Borough of Kensington and Chelsea’s subletting guidance.

Contact your insurer or broker before the first booking. Describe that you will receive payment for third-party use, how often it will happen, how drivers access the space and what kind of space it is. Ask specifically about damage to the property, liability if someone is injured, and whether the arrangement changes your cover or requires an endorsement. Request the answer in writing. The sources do not establish a universal legal duty to buy a particular insurance product; coverage depends on your policy and circumstances.
What to check before accepting a booking
- Identify your rights. Establish whether you own the space, rent it, hold a lease or have an allocated bay, and confirm that your documents let you give a driver use of it.
- Check restrictions and obtain any required consent. Review the tenancy, lease, mortgage terms and building rules. Ask the landlord, lender, freeholder or building manager where necessary.
- Ask the local authority about local requirements. Check planning, licensing, access and any property-specific restrictions. In England, use the qualified planning guidance above and ask the local planning authority if your proposal raises concerns.
- Confirm insurance cover in writing. Explain the paid arrangement and third-party access to your insurer or broker; keep their response and any policy changes.
- Write down the arrangement. Record the exact space, permitted use, access method, hours, payment, duration, cancellation terms and responsibility for damage or obstruction. Keep any permissions and insurance confirmation with it.
A listing on a parking platform does not prove you have the right to offer the space. For example, a public-sector contract for JustPark places responsibility for obtaining required permissions on the client. See the published contract document. Treat this as an example of contract terms, not a statement about every platform’s agreement.

Tax and other local rules depend on the arrangement
Permission and insurance are not the only checks. Tax treatment can vary by country and by the type and duration of the parking arrangement. For example, the Canada Revenue Agency’s treatment of parking supplies depends on the arrangement and its relationship to a residential unit. Read the CRA’s parking guidance. Check the tax authority and local rules where the space is located; that Canadian guidance is not a general rule for other jurisdictions.
