Not automatically. The EU Digital Services Act (DSA) does not regulate every website simply because it is small or available online. It applies to covered intermediary services offered to people or organisations located or established in the European Union. Whether a site is covered depends on what the operator’s service does, especially whether it transmits, stores or publicly disseminates information supplied by users.
The short answer: size alone does not decide DSA coverage
The Digital Services Act is a function-based regulation. A small brochure site with pages written and published by its owner is not automatically an intermediary service. A small site that hosts user comments, lets members upload files, operates a marketplace or otherwise stores and distributes recipient-supplied information may provide one or more services covered by the DSA.

Article 2(1) of Regulation (EU) 2022/2065 states: “This Regulation shall apply to intermediary services offered to recipients of the service that have their place of establishment or are located in the Union, irrespective of where the providers of those intermediary services have their place of establishment.” In practice, an operator outside the EU can still be in scope when it offers a covered service to EU recipients.

The word “small” is also easy to misunderstand. A small website is not the same thing as a legally defined micro or small enterprise. Even an enterprise that qualifies under the EU definition receives only targeted exemptions from certain burdensome duties; it does not receive a blanket exemption from the DSA.

What the DSA actually regulates
The DSA covers intermediary services, including services such as hosting and online platforms. The European Commission describes examples that can include hosting providers, marketplaces, social networks, content-sharing services, app stores and travel or accommodation platforms. Those examples do not mean that every webpage in those sectors has identical obligations. The applicable rules depend on the service category and the specific provisions that apply to it.
A domain can contain several different functions. Its editorial articles may be ordinary publisher content, while a comments area, customer listing system or file-upload tool may be a separate intermediary service. Classification should therefore be made feature by feature rather than by assigning one label to the whole domain.
Classify the service by its technical function
The DSA’s categories are based on what the service technically does. The regulation also recognises that a service’s functionality can change over time, so classification is a case-by-case exercise.
| Service category | Core function | Question for a site operator |
|---|---|---|
| Mere conduit | Transmits information or provides access to a communication network. | Is the service mainly carrying information between recipients without selecting or storing it as a user-facing publication? |
| Caching | Automatically, intermediately and temporarily stores information to make onward transmission more efficient. | Is information held temporarily and automatically for transmission efficiency? |
| Hosting | Stores information provided by, and at the request of, a recipient of the service. | Can a user supply information that the service stores? |
| Online platform | A hosting service that, at a recipient’s request, stores and disseminates information to the public. | Does the service make user-supplied information publicly available, rather than keeping it private or limited to a fixed recipient? |
An online platform definition has an important qualification. A feature can be excluded when it is merely minor and ancillary to another service, cannot objectively and technically operate independently, and was not included to evade the DSA rules. The technical and commercial role of the feature matters.
User-content examples
A site that lets visitors submit comments and stores those comments is performing a hosting function. If the comments are then displayed publicly, the feature may also meet the online-platform definition. A newspaper’s comments tool may be considered minor and ancillary to the newspaper’s editorial publication in some circumstances. By contrast, a social network whose central service is storing and publicly distributing user posts is not merely operating an incidental comments feature.

These examples illustrate the analysis; they are not automatic safe harbours. A news site, forum, membership community or business directory must examine how its own feature works, how central it is to the service and who can see the stored information.
Do EU users bring a non-EU small site into scope?
Potentially, yes. The DSA’s territorial rule focuses on recipients whose place of establishment or location is in the EU, not only on the provider’s headquarters. A provider established elsewhere can therefore need to assess its EU-facing intermediary service.
This does not mean that every site receiving an occasional visit from an EU reader automatically becomes a platform provider. The first question remains whether the operator offers an intermediary service at all. The next questions are which recipients are served, what information is handled and which DSA provisions attach to that category.
What micro and small enterprise status changes
The Commission explains that micro and small enterprises are exempt from some rules that could be more burdensome. The relief is targeted. It narrows selected obligations; it does not remove baseline coverage or turn a covered service into an unregulated one.
The clearest statutory relief concerns selected online-platform duties. The relevant section generally does not apply to micro or small platform providers, while a specified reporting obligation remains applicable. The exclusion also does not protect a platform designated as very large. Separate exemptions concern content-moderation transparency reporting and particular marketplace trader-traceability duties.

Enterprise status is not proved by calling a site “small.” The underlying definition comes from Commission Recommendation 2003/361/EC. An operator must check the applicable micro or small thresholds and consider relevant linked or partner enterprises when determining status. A group of companies may not qualify merely because the individual website has few employees or modest traffic.
Because the exemptions attach to named obligations, an operator should map its service category to each duty rather than assume that one exemption covers everything. A small hosting provider, a small online platform and a small marketplace can face different combinations of requirements.
A practical classification checklist
Use the following sequence before deciding whether a small site is covered:
- Identify the recipient audience. Is the service offered to people or entities located or established in the EU?
- Separate publisher content from intermediary functions. Which parts are written and supplied by the operator, and which parts accept information from recipients?
- Identify the technical activity. Does the operator transmit, cache or store recipient-supplied information?
- Check public dissemination. Is stored information available to the public, or only to a private account, a defined group or a particular recipient?
- Assess whether a public feature is central. Could it objectively and technically operate independently, or is it genuinely minor and ancillary to another service?
- Distinguish provider from infrastructure. Is the business operating the user-facing service, or only using a cloud or web-hosting company underneath it?
- Verify enterprise status. Does the operator meet the EU micro or small definition, including relevant partner and linked enterprises?
- Map the exact duties. For the resulting category, which contact-point, order-compliance, notice-and-action, terms, transparency, marketplace or platform rules apply, and which express exemptions cover them?
This checklist is an orientation tool, not a legal classification. For a service with substantial user content, marketplace activity or cross-border reach, the operator should check the regulation and contact the relevant Digital Services Coordinator or qualified EU counsel.
Do you inherit your hosting company’s DSA duties?
No. The website operator and the infrastructure provider are different actors. Cloud computing and web-hosting services used as the underlying infrastructure for an application, website or platform are not, merely because they supply that infrastructure, treated as disseminating the information stored for the site’s users to the public.

That distinction prevents two opposite mistakes. A site owner should not assume that every obligation imposed on an infrastructure provider automatically transfers to the owner. Conversely, putting a user-content feature on rented servers does not remove the operator’s own responsibilities for the user-facing service it runs. The relevant question is which entity provides each service and performs each function.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Which duties might matter to a small site?
The DSA uses a proportionate approach: requirements vary with the provider’s role, size and impact. A basic publisher site should not be presented with the complete rulebook for a large platform, but a covered intermediary may still need to examine several baseline areas.
- Contact and legal-compliance mechanisms: Depending on the category, providers may need designated contact arrangements and processes for dealing with lawful orders or official requests.
- Notice-and-action procedures: Hosting and platform services may need a mechanism through which people or entities can report allegedly illegal content and a process for handling those notices.
- Terms and moderation information: Providers subject to the relevant rules may need clear terms describing restrictions and information about content-moderation practices.
- Transparency reporting: The DSA contains reporting duties, with targeted relief for certain micro and small providers and separate rules for particular platform categories.
- Advertising safeguards: Platform-level requirements include transparency around advertisements and restrictions on targeting based on sensitive data and on targeting minors, where the relevant provisions apply.
- User complaints and redress: Certain online platforms must provide complaint channels or other means for users to challenge specified decisions.
- Marketplace information: Marketplaces can face additional transparency and trader-traceability obligations, subject to the specific small-enterprise exemptions and exceptions in the Act.
These are category-level examples, not a checklist saying that every small website must implement every item. A site’s classification and any applicable exemption determine which duties are actually triggered.
Who enforces the DSA?
Enforcement is distributed. National Digital Services Coordinators generally supervise providers in their territory. They can request information, order inspections and impose fines under the enforcement framework.

The European Commission has exclusive competence for the enhanced systemic-risk obligations that apply to very large online platforms and very large online search engines. The Commission FAQ uses a threshold of 45 million average monthly users, described as 10% of the EU population, in that very-large-provider context. That figure is not the threshold for ordinary DSA applicability and should not be used to decide whether a small user-content site is covered at all.

Common mistakes small-site operators should avoid
“We are small, so the DSA does not apply.”
Small status can remove selected burdens, particularly some online-platform duties, but it does not erase the regulation. Start with the service function and then apply the specific exemption.
“We publish articles, so comments are outside the DSA.”
Editorial pages and user-content features can be different services. A comments system that stores and publicly displays recipient-supplied information needs its own analysis, even when attached to a publication.
“Our hosting company handles compliance for us.”
Infrastructure hosting and the user-facing service are separate roles. Renting servers does not determine whether the site operator provides hosting or an online platform to its own recipients.

“Any EU visitor means every DSA rule applies.”
The territorial connection is important, but it operates alongside the intermediary-service definitions and category-specific provisions. An ordinary static page is not transformed into an online platform merely by being viewable in the EU.
“The 45-million-user figure is a general exemption.”
That figure relates to the very-large-provider framework. It is not a safe harbour for smaller providers and not the basic test for DSA coverage.
Bottom line for a small website
A small website does not have to comply with the Digital Services Act merely because it is online. It should assess whether it offers an intermediary service to EU recipients, identify whether it transmits, caches, hosts or publicly disseminates recipient-supplied information, and then map the resulting category to the DSA’s exact duties. Micro and small enterprise exemptions can reduce selected obligations, but they are limited, conditional and not a blanket carve-out.
