Do Recorded Lessons on a 24/7 YouTube Stream Need to Be Public Domain?

No. A recorded lesson does not have to be in the public domain just because you play it on a 24/7 YouTube stream. You do need the rights, permission, license, or a copyright exception that covers the lesson and each included element—such as music, images, slides, and video clips—for the way you plan to stream and archive it.

What rights do you need to stream a recorded lesson?

YouTube’s livestream terms require the person providing the live content to have the necessary rights to use it on Google services, including music rights. You are responsible for checking the rights in the material you stream; the fact that a lesson is educational or prerecorded does not itself clear it. Start by listing everything viewers will hear or see—not just the main lesson recording:

  • The lesson recording, narration, and any guest contributions
  • Slides, photographs, diagrams, illustrations, and screen captures
  • Music, sound effects, readings, and excerpts
  • Third-party video or audio clips embedded in the lesson

Original creative work is generally protected when fixed in a tangible form. Recording a class or broadcast does not mean you own the rights to every work captured in it.

Which routes can authorize the material?

You own or control the rights

If you created the lesson and all its components, and have not transferred or restricted the relevant rights, you may generally use them subject to any applicable agreements. Check contributions by co-creators, guest speakers, employers, schools, or other rights holders rather than assuming the person who pressed record controls everything.

You have permission

Ask for permission that covers the actual plan: live streaming, replay or archive, intended territory and duration, edits, and monetization if relevant. A license for classroom display, a private course, or one event may not necessarily cover continuous public streaming and an archived replay.

A license permits reuse

YouTube’s default upload setting is the Standard YouTube license. Its optional Creative Commons Attribution license is for eligible content; reuse under CC BY requires following its terms and giving attribution. Commercial use is allowed only if the applicable license grants it. A YouTube license setting on your own upload cannot grant rights to material you do not own or control. The work is public domain

Public-domain material can be one valid route, but do not assume a work is public domain because it is old, widely shared, or available online. YouTube says there is no official all-works public-domain list, and copyright rules and terms vary by jurisdiction. The uploader is responsible for checking the status in the relevant places.

A copyright exception applies

In the United States, fair use is assessed case by case using four factors: purpose and character, nature of the work, amount and substantiality used, and effect on the potential market. Courts decide specific cases based on their facts. Other jurisdictions have different exceptions or fair-dealing rules; a US fair-use analysis does not automatically apply elsewhere. Does educational use, credit, or a short excerpt make it safe?

No single one of those facts automatically gives permission. YouTube’s copyright guidance cautions that educational or nonprofit purpose does not by itself authorize use of protected material, credit is not a substitute for permission, and a short excerpt is not automatically safe. Whether an exception applies depends on the specific facts and local law.

What can happen during the stream or afterward?

YouTube scans live streams for third-party content matches. It may show a placeholder and interrupt or terminate a stream if the material remains or a strike is issued. Having a license does not necessarily prevent a match from disrupting the stream: the rights owner may need to add your channel to its Content ID allowlist. If you archive the live stream, Content ID claims for it can be made after the stream ends. Details are in YouTube’s live-stream copyright guidance.

A successful stream is not proof that all rights are cleared. Keep permission records and license terms, and resolve claims through the appropriate rights holder or YouTube process.

Will YouTube keep a 24/7 stream’s archive?

YouTube says it can automatically archive a live stream that is less than 12 hours. A stream longer than 12 hours may not be captured at all, so keep a local recording if the archive matters. You can change archive visibility or delete it in YouTube Studio. These archive controls do not grant rights to the lesson or any material in it. See YouTube’s archive live streams guidance.

A pre-stream rights check

  1. Make an inventory. Note the creator or rights holder for the lesson and every embedded work, including music, images, readings, and clips.
  2. Identify your basis for using each item. Confirm ownership or get permission; check the exact license and its conditions; verify public-domain status for the relevant jurisdiction; or assess whether a local exception plausibly covers the use.
  3. Match the scope to the broadcast. Confirm that the rights cover live streaming and any replay archive, along with territory, duration, edits, and monetization where applicable.
  4. Keep evidence together. Save permission, license terms, attribution details, and correspondence so you can respond if a rights issue arises.
  5. Plan for the archive and interruptions. Keep a local backup of important streams, especially when the broadcast may exceed 12 hours, and be prepared for a match or claim even where you believe you have permission.

If ownership, license scope, or an exception is uncertain in a material way, consult a qualified copyright professional in your jurisdiction. The answer for a particular lesson depends on its ownership chain, contents, intended use, and applicable local law.
