Short answer: usually, you do not own a digital game in the same way you own a book, disc, or other physical object. A storefront purchase commonly gives you a personal license to access software under platform and publisher terms. Your ability to keep playing can depend on your account, the storefront’s download service, digital-rights management (DRM), compatible hardware, and the game’s online servers. A physical copy can reduce some of those dependencies, but it is not a guarantee of permanent playability.
The exact result depends on the game, edition, platform contract, territory, and consumer law that applies to you.

What you get when you click “buy”
A purchase label does not, by itself, establish copyright ownership, a transferable copy, or a promise that the game will remain available indefinitely. Copyright in the game normally remains with its publisher or other rights holders. The question for a buyer is what access rights the applicable store and software terms grant, for how long, and under what conditions.

The US Federal Trade Commission (FTC) uses a physical-versus-digital contrast in its consumer guidance published 18 April 2024: “When you buy a physical item, you’ve got it. It’s yours.” The same guidance warns that clicking “buy” for digital content often gives you “merely a license to access the content,” and that access may depend on an active account or the platform continuing to operate. Sony’s US PlayStation Software EULA states, “The Software is licensed to you, not sold.” It describes a limited, non-exclusive, non-transferable, personal license for private, non-commercial use on the intended system or device. Sony’s terms also reserve the ability to stop supporting or discontinue software and terminate online services, which can mean losing access to gameplay, progression, or virtual content. These are contractual terms for the covered PlayStation software, not a universal rule for every platform or country. See the PlayStation Software EULA (US).
Nintendo’s US purchase terms similarly say that some software and digital content are licensed rather than sold. They describe account ties, territory restrictions, possible limits across devices, and subscription features that last only for the subscription term. Nintendo also says data associated with a subscription may be deleted after expiration or termination. Those provisions apply to the purchases and services covered by those terms, not automatically to every Nintendo product or another region. See Nintendo’s US purchase and subscription terms.
Why a digital license does not equal permanent access
“Ownership” and “access” are separate questions. A license may authorize use while several technical and contractual dependencies remain in place:

- Storefront: A console or PC store may control the download files, entitlement checks, redownload process, and compatibility with future system software.
- DRM: Digital-rights management can restrict which devices, accounts, regions, or modes may run the software. The FTC identifies DRM as a restriction on how and where digital content can be used.
- Publisher licensing: A publisher may rely on music, sports, character, or other third-party rights. If those rights end, the publisher’s ability to distribute or support the game can change, even though your purchase record remains.
- Servers: Multiplayer, authentication, cloud saves, progression, economies, and sometimes the entire launch process may require a publisher service.
- Hardware: A license that works on one console generation or device does not necessarily transfer to a future system. Emulation, backward compatibility, or a new purchase may be required.
The FTC specifically cautions that a seller’s own content-licensing problems can affect a buyer’s access. Its guidance is consumer information, not a prediction of the outcome of a particular platform dispute.

Can a store take away a game you paid for?
There is no single worldwide answer. The practical outcome depends on the purchase terms, the reason for the change, local consumer law, and whether the game still has a technical route to run.
Platform terms can reserve suspension, termination, discontinuation, or service changes. Sony’s US software terms are an example: they say Sony may stop supporting or discontinue software and terminate online services. The consequence can be loss of gameplay, progression, or virtual items. Applicable local-law consumer rights are preserved in those terms, including rights for residents in the European Economic Area and other covered regions, but a contractual reservation is not itself a ruling that a particular withdrawal is lawful.
The FTC also notes that digital access may fail when an account is inactive or a platform goes out of business. In other words, payment proves that a transaction occurred; it does not prove that the seller must operate every enabling service forever.
Delisted is not the same as deleted
Delisting means a game is removed from sale or distribution through a storefront. It does not, by itself, answer either of the questions buyers care about most: “Can I still download it?” and “Can I still play it?”

Existing access can remain available when a title disappears from a store, but that is not a universal entitlement established by the sources here. Redownload ability can depend on the account’s entitlement, the storefront’s download infrastructure, the platform’s software support, the license language, and whether the game requires a server that has been retired. A title may therefore be unavailable to new buyers while remaining downloadable for some existing purchasers, or it may become difficult or impossible to retrieve after a service change.
Before assuming that a delisted game is safe, check the platform’s current support information and the title’s own requirements. Keep an installed copy only if the platform permits it, and do not assume that an installed copy will bypass future activation or server checks.
Does owning a disc mean you can always play?
A disc or cartridge gives you a copy of the data held on that medium, which can reduce dependence on a storefront account and future downloads. It still does not guarantee that every feature will work forever.

A physical release may require a large installation download, a day-one patch, an account sign-in, online activation, or servers for single-player features. Multiplayer, live events, cloud saves, leaderboards, and virtual economies are especially likely to stop working when the publisher shuts down the relevant service. A damaged disc, a failed optical drive, regional restrictions, or hardware that no longer supports the format can also end practical access.
Digital and physical versions: compare the dependencies
| Question | Digital purchase | Physical disc or cartridge |
|---|---|---|
| What is obtained? | Usually a personal license tied to an account and platform terms; the store’s “buy” label does not itself establish copyright ownership or transferability. | A copy of the game data on media, while the software remains subject to copyright and any included license terms. |
| Redownloads | Normally depend on the account entitlement and the storefront’s download service continuing to operate. | The medium can supply some or all data, but patches, installation files, or activation may still come from a service. |
| Offline play | Depends on DRM, account checks, and whether the game’s modes run without publisher servers. | Can reduce storefront dependence, but offline operation must be verified for the exact title and edition. |
| Online features | Depend on the publisher’s servers and platform network. | Depend on the same servers; having a disc does not preserve multiplayer or live services after shutdown. |
| Transferability | Often restricted by the platform license and account rules. | The physical item can generally be handed to another person, but that does not transfer an account-bound entitlement, downloadable content, or online rights. |
| Future hardware | Requires supported hardware, backward compatibility, emulation, or a new license arrangement. | Requires a working compatible drive or cartridge slot; a newer console may not accept the medium. |
How to check a game before buying it
Use this checklist for the exact platform, region, edition, and release you intend to use. Store descriptions and box art are not enough to answer every item.
- Read the applicable terms. Identify whether the store calls the software licensed, whether the license is personal or transferable, its duration, termination language, territory limits, and account requirements. Save a copy of the terms and your receipt.
- Confirm the account path. Check whether the game can be launched from a different account, whether family-sharing rules apply, and what happens if the purchasing account is closed or inaccessible.
- Check redownload conditions. Find out whether previously purchased software remains in the account library after delisting and whether the platform requires an active online service to download it.
- Separate installation from play. Determine whether the disc or cartridge contains a playable build or only a license key and installer. Note the size of required patches and whether the first launch requires an internet connection.
- Test the offline modes. Look for an explicit offline or single-player mode. Verify whether authentication, a launcher, cloud service, or periodic check is required after installation.
- Map server dependencies. List multiplayer, progression, saves, economies, user-generated content, and any single-player systems that call a publisher server. A shutdown can disable each one independently.
- Check hardware support. Verify the console generation, operating-system support, backward compatibility, region, disc format, and whether your intended future hardware can read the release.
- Check add-ons separately. Downloadable content, season passes, subscriptions, virtual currency, and music or sports licenses may have different terms and expiry conditions from the base game.
What happens when a game’s servers shut down?
Server shutdown is a technical event whose effects vary by design. A fully offline build may continue to run from an installed digital copy or physical medium. A game that performs an online entitlement check at startup may stop launching. A hybrid game may retain its campaign while losing multiplayer, cloud saves, leaderboards, events, or progression that was stored remotely.
Do not infer the result from the presence of a single-player label. Check whether the title has an offline mode, whether it can be started after signing out, and whether the publisher has documented an offline patch or end-of-service change. No individual game has been verified here, so a general “works forever” conclusion would be unreliable.

What consumer law can do
United States
The FTC guidance explains the practical risks of digital purchases, but it does not create a universal promise that every digital game remains playable or downloadable indefinitely. The contract, the facts of the transaction, and the law of the relevant state and country control a particular dispute. Do not treat the FTC’s educational examples as a decision about your platform account.
European Union
In its 17 June 2026 response to the “Stop Destroying Videogames” citizens’ initiative, the European Commission said modern games often rely on publisher servers and can become partly or wholly unplayable when support ends. It stated: “The Commission considers that at this stage it cannot propose a legal obligation to keep video games playable after they stop being provided commercially.” The statement is an EU-level policy position, not a ruling on an individual shutdown. Read the Commission’s 17 June 2026 announcement.
The Commission also says EU providers must tell consumers before signup about duration and termination conditions. Under the EU digital-content and digital-services rules, consumers may have remedies when supplied content or a service fails to conform to the contract or reasonable expectations, including bringing it into conformity or, in the circumstances described, receiving a proportionate price reduction or ending the contract. A Commission answer from 2024 discusses those Directive 2019/770 remedies in more detail; it does not settle every server-shutdown claim. Read the 2024 Commission answer.

Your residence, the seller’s location, the contract, and mandatory local protections all matter. A practical strategy for keeping playable games
- Prefer releases that clearly document offline operation when long-term access matters more than convenience.
- For a physical copy, confirm that the medium contains a usable build and identify every required download, account, activation, and server.
- For a digital copy, maintain the purchasing account, enable its recovery methods, and avoid assuming that an installed file removes future DRM checks.
- Download permitted patches and add-ons while they are available, but remember that downloaded data may still require authentication or a live service.
- Record the exact edition, region, platform, and terms that applied when you bought it; different editions can have different dependencies.
- Before a planned shutdown, read the publisher’s notice for offline patches, save migration, refunds, or end-of-service dates. Those remedies are title-specific rather than automatic.
The decision in one sentence
Choose digital when account-based convenience and redownload access are acceptable; choose a physical game copy when reducing storefront dependence matters, but verify offline functionality, installation requirements, online activation, and hardware compatibility for the exact release. Neither format is “forever-proof,” because the license, technology, servers, and local law can all determine how long the game remains usable.
