Did the U.S. House Ban DJI Drones? What the 2024 Vote and 2026 FCC Rules Mean

No—not by itself. The U.S. House passed the Countering CCP Drones Act (H.R. 2864) on September 9, 2024, but that vote did not immediately make every DJI drone illegal to own or fly. The bill proposed putting DJI equipment and services on the Federal Communications Commission (FCC) Covered List. A broader FCC action on December 22, 2025, added foreign-produced uncrewed aircraft systems (UAS) and critical components to that list, mainly blocking new FCC authorization for covered products. Previously authorized aircraft may still be usable under FCC rules, although aviation, procurement, contract, state, local and agency restrictions can apply.

What the House actually passed

H.R. 2864, the Countering CCP Drones Act, was introduced by Rep. Elise Stefanik on April 25, 2023. The House Energy and Commerce Committee considered it on March 20, 2024, reported it with an amendment on May 7, and the full House passed it by voice vote on September 9, 2024. The Senate received and referred the bill to the Senate Commerce Committee on September 10, 2024.

The bill’s proposed mechanism was specific: direct the FCC to add telecommunications and video-surveillance equipment and services produced by DJI, its subsidiaries or affiliates—including related software—to the Covered List. The text did not simply say that all DJI aircraft would immediately become illegal. Read the House-passed text, the bill status and the committee report.

Congress.gov identifies Senate referral—not presidential enactment—as the bill’s latest action. House passage was therefore an important legislative step, not a standalone nationwide grounding order.

What the FCC Covered List does

The Covered List is maintained under the Secure and Trusted Communications Networks Act of 2019 for communications equipment and services judged to pose an unacceptable risk to U.S. national security or the safety and security of U.S. persons. For listed equipment, the key consequence is loss of eligibility for a new FCC equipment authorization.

Radio transmitters in drones generally need FCC authorization before a new model can lawfully enter the U.S. market. Without that authorization, a covered model generally cannot be newly imported, marketed, sold or used in the United States. This is primarily a market-access rule. It is not automatically an instruction to disable every previously authorized aircraft.

What changed after December 22, 2025

On December 22, 2025, the FCC’s Public Safety and Homeland Security Bureau added foreign-produced UAS, foreign-produced UAS critical components and specified equipment and services listed in Section 1709 of the FY2025 National Defense Authorization Act. The action followed a national-security determination by an executive-branch interagency body. See the FCC notice at DA-25-1086A1 and the Congressional Research Service explanation at IF12955.

That rule is broader than a DJI-only measure. DJI and Autel remain especially relevant, but the category is framed around foreign-produced aircraft and components, with exceptions and conditional approvals. The live list and each product’s status matter more than a brand-only assumption.

Exceptions and later changes

  • UAS and critical components on the Defense Contract Management Agency Blue UAS Cleared List received temporary treatment.
  • Products qualifying as domestic end products under the Buy American standard received temporary treatment.
  • The Department of War or Department of Homeland Security can provide conditional approvals for specified devices.
  • On June 15, 2026, the FCC removed toy drones and toy drones containing foreign-produced components from the Covered List after a Department of War determination. The FCC notice is DA-26-673A1; the toy-drone action is also described in DA-26-588A1.

Some exceptions are temporary, conditional or product-specific. Check the current FCC Covered List and applicable expiration dates before buying or deploying equipment.

Can existing DJI owners still fly?

Under the FCC framework summarized by CRS, previously authorized drones may continue to be used. “Previously authorized” refers to the specific aircraft and radio equipment, not automatically every DJI model ever sold or every imported configuration.

FCC status is only one legal layer. FAA registration, Remote ID and operating rules still apply. A federal agency, state or local government, employer, customer, insurer or contract may prohibit a DJI aircraft even when FCC rules do not. Firmware, mobile-app access, cloud services, privacy requirements, repair support and replacement parts are separate operational issues.

Can you still buy a DJI drone in the United States?

There is no responsible unconditional yes or no. A previously authorized model may remain available from existing inventory or through resale, subject to seller and marketplace policies. A newly covered model cannot lawfully enter the U.S. market without the required FCC authorization. Imported aircraft and accessories can raise separate customs, FCC and marketplace questions.

Before purchasing, verify:

  1. The exact model and regional version.
  2. The FCC ID and authorization record for the aircraft, controller and relevant transmission equipment.
  3. Whether authorization predates the applicable restriction.
  4. Whether the seller is offering a U.S.-market unit rather than an import.
  5. Whether batteries, controllers or other critical components are separately covered.
  6. Whether your employer, customer, insurer or government contract permits the platform.
  7. Whether the intended work involves federal funding or procurement rules.

Ownership or resale does not override a prohibition on introducing a new covered product into the U.S. market.

Different rules apply to government and commercial users

Federal agencies and contractors

The American Security Drone Act and related federal provisions restrict federal procurement or use of covered foreign-entity drone systems, while allowing specified exceptions and waiver mechanisms. Federal contractors can also be bound by contract clauses or agency security requirements. Relevant statutory text is available through Title 41 and the American Security Drone Act provisions.

State, local and public-safety agencies

State, local and territorial law-enforcement or emergency-service agencies may have approval or waiver routes in specified circumstances. Grant terms, procurement rules and the particular agency policy can still restrict purchases or operations. Continued possession does not prove that a department may buy a successor model or use federal funds for it.

Private operators

A private photographer, surveyor, farmer, utility or small business is not automatically subject to a federal procurement ban merely because it owns DJI equipment. It must still comply with FAA rules and any customer, insurance, workplace, data-security or site-specific requirement.

Why supporters seek restrictions

Supporters argue that DJI’s market position and connections to China create risks involving data security, surveillance, communications, supply-chain dependence and possible access by the Chinese government or Chinese Communist Party. The House Select Committee on the Chinese Communist Party described DJI as a national-security risk and characterized the House vote as placing DJI on the Covered List. That is the committee’s advocacy position, not an uncontested judicial finding; its statement appears at this committee page.

Why critics object

  • A foreign-production rule can affect manufacturers and components beyond DJI.
  • Small businesses, photographers, farms, utilities and public-safety organizations may face expensive retraining, software migration and replacement costs.
  • Reduced competition could raise prices or narrow capabilities.
  • Legacy devices may continue operating, so a market-access rule may not eliminate the underlying cybersecurity concern.
  • The public record may not detail all evidence behind national-security determinations, making proportionality difficult to assess.

The dispute is therefore about national-security assessments, commercial dependence, replacement capacity and evidentiary transparency—not a settled finding that every DJI product is either safe or unsafe.

How to assess a specific aircraft

  1. Record the exact aircraft, controller, radio module and battery models.
  2. Find each FCC ID and authorization record; do not rely on the DJI brand alone.
  3. Check whether the authorization was issued before the relevant Covered List action.
  4. Confirm that the unit is a U.S. version and that import or resale conditions are satisfied.
  5. Review the current FCC list, temporary exceptions and conditional approvals.
  6. Check FAA operating obligations, including registration and Remote ID where applicable.
  7. Obtain written confirmation from the customer, employer, insurer or contracting agency for restricted work.
  8. For federal or grant-funded projects, check procurement statutes, waivers and grant conditions before deployment.

If you are replacing a fleet

Evaluate total lifecycle compliance rather than aircraft price alone: controllers, batteries, payloads, software subscriptions, cloud dependence, data export, training, repairs, insurance, U.S.-based support and documented product-lifecycle commitments all matter.
