DHS rejects watchdog’s call for ICE to use auto-activated body cameras

The Department of Homeland Security has rejected a Government Accountability Office recommendation that Immigration and Customs Enforcement add automated controls—such as activation tied to emergency lights or other events—to ensure officers record incidents under agency policy. DHS accepted six other GAO recommendations but said automatic triggers could record sensitive interactions or protected activity by mistake.

The dispute comes as ICE and Customs and Border Protection expand body-worn-camera programs while GAO finds weak planning, unclear field guidance and limited measurement of whether cameras are actually used when required.

What GAO recommended

GAO recommendation 5 asks ICE to implement additional controls, including automated camera activation, to improve compliance with its body-camera policy. GAO said event-linked activation would provide “better assurance that ICE personnel capture footage in accordance with policy,” particularly when an incident develops too quickly for an officer to press a button.

Possible triggers include activating emergency vehicle lights, drawing or firing a weapon, or other defined enforcement events. The recommendation does not require one specific technology or state that every camera must record continuously. It calls for controls that make missed recordings less likely.

Why DHS rejected automatic activation

DHS did not concur with the automated-activation portion of the recommendation. Its written response cited “operational risks, including inadvertent or false activations during routine movement.” A trigger connected to vehicle equipment or another event could start recording when no enforcement incident is occurring.

The department also warned that false starts could capture sensitive interactions with informants or victims, or protected First Amendment activity. That concern is especially relevant when personnel are moving through public spaces, meeting sources or handling people whose identities and conversations require protection.

AP reported that DHS requires cameras to be turned on at the beginning of pre-planned enforcement activities. That requirement is different from an automatic trigger for an unexpected encounter: an officer can prepare for a scheduled operation, but may still have to activate a camera manually when circumstances change without warning.

How many cameras ICE and CBP have deployed

Agency Deployment start Latest figure in the GAO review Program note
ICE Fiscal year 2024 Approximately 4,800 cameras as of April 2026 Nearly evenly divided between Enforcement and Removal Operations and Homeland Security Investigations
CBP Fiscal year 2021 Approximately 11,500 cameras as of June 2026 Separate from ICE’s inventory and policies

GAO said CBP and ICE paused further camera deployment in February and June 2025, respectively, after program-funding decisions. The figures therefore describe cameras deployed by those dates, not a promise that every officer or field activity had a camera.

Are ICE personnel required to turn cameras on?

ICE policy requires activation in circumstances covered by the agency’s rules, including the start of planned enforcement work. The GAO interviews show that the practical instructions were not consistently clear. Personnel reported uncertainty about activation during vehicle searches and detainee transport—situations that may begin as routine activity and become enforcement events.

At one ICE office, staff had completed training but had not begun using cameras because they were unsure of the rules. That finding matters independently of the technology: an automatic trigger cannot resolve an unclear policy, and a clear policy is difficult to enforce if supervisors do not measure compliance.

The policy choice: reliability versus privacy

Question Automatic or event-linked activation Manual activation under current approach
Capture reliability Could reduce missed recordings when a use-of-force event or unexpected encounter develops quickly. Depends on an officer recognizing the recording requirement and operating the camera in time.
Privacy exposure Could record informants, victims, bystanders or protected activity when a trigger fires accidentally. Allows an officer to avoid recording sensitive interactions when policy permits, but creates a risk of failing to activate.
Operational clarity Requires precise trigger definitions, override rules and safeguards for exceptional situations. Requires situation-specific guidance that personnel can understand and apply under pressure.
Accountability measurement Can be evaluated by comparing trigger events with footage and exceptions. Requires audits of activation decisions, missing footage and supervisor review.
Implementation status GAO recommended additional controls; DHS did not agree to automated activation. Existing policy, training and supervision remain the principal controls.

Neither approach removes the need for retention, access and privacy controls. ICE’s law-enforcement evidence systems and rules are not equivalent to those of a consumer body-worn camera.

What GAO found about program oversight

GAO reviewed program management, policies, deployment data and interviews at 10 field locations. It found that program plans were outdated, agencies lacked results-oriented performance measures, and many offices did not have sufficient operational guidance.

Those gaps make it hard to answer basic oversight questions: whether required encounters are recorded, whether missing footage is investigated, whether recordings improve use-of-force reviews, and whether the programs affect transparency or public trust. GAO’s review examined management and implementation; it did not decide the facts of the high-profile shootings discussed in related news coverage.

Timeline of the dispute

  1. Fiscal year 2021: CBP began deploying body-worn cameras.
  2. Fiscal year 2024: ICE began its deployment.
  3. February and June 2025: CBP and ICE paused additional deployment after funding decisions, according to GAO.
  4. April 2026: ICE had approximately 4,800 cameras deployed.
  5. June 2026: CBP had approximately 11,500 cameras deployed.
  6. September 15, 2026: GAO issued report GAO-26-108157.
  7. October 14, 2026: The Associated Press and congressional lawmakers publicized DHS’s rejection of automated activation.

What happens next

GAO lists its recommendations as open pending confirmation of agency actions. DHS’s response therefore records a current policy position, not a permanent legal ban on automatic activation. ICE could still adopt a different control later, revise its policy, or address the recommendation through non-automated safeguards.

For the dispute to move forward, agencies would need to specify which events require recording, how officers should handle exceptions, how supervisors audit missing footage, and which outcomes they will measure. Without those details, the central question remains unresolved: whether the privacy cost of false activation is greater than the accountability cost of a recording missed during an unexpected encounter.
