There is no settled Democratic plan for the legislative filibuster if the party wins control of the U.S. Senate. Some senators have argued for changing the rule or finding ways around its 60-vote hurdle; others defend keeping it. Past votes and newer statements show a debate, not a binding promise about what a future majority would do.
What the filibuster debate is about
The dispute concerns the legislative filibuster: under current Senate practice, most legislation needs 60 votes to end debate and proceed toward a final vote. That threshold is a Senate rule and practice, not a requirement written into the Constitution.
This is separate from the Senate’s rules for nominations, which have changed over time, and from budget reconciliation, a process that can let qualifying legislation advance without the ordinary legislative filibuster when its requirements are met. Using reconciliation or another procedural route is not the same as abolishing the legislative filibuster. Why there is no single Democratic answer
Schumer proposed a limited change in 2022
During the 2022 voting-rights debate, then-majority leader Chuck Schumer proposed a targeted change if Republicans blocked cloture on the bills. He said: “If the Republicans block cloture on the legislation before us, I will put forward a proposal to change the Senate rules to allow for a talking filibuster on this legislation, as recommended by a number of our colleagues who have been working on this reform for a very long time.” The proposal was for those voting-rights bills, not a plan to abolish the filibuster for all legislation. The rules change failed. Senators Joe Manchin and Kyrsten Sinema joined Republicans in opposing it, leaving Democrats short of the votes needed to change the rules. The Washington Post’s March 2026 report revisited that fight and noted that Chris Coons, who had defended Senate institutional practices, supported weakening the rule in the voting-rights debate.
Some senators argue the threshold blocks legislative work
In May 2026, Democratic senators were debating what to do about Republican procedural workarounds and the 60-vote threshold. Dick Durbin said the threshold had shut down most legislative activity. Jeff Merkley said Democrats might wrestle with using a similar procedural strategy if they regained control. Those comments signal openness to considering options; they do not establish that the caucus has adopted a shared plan.

Other senators have changed their minds
Angus King, an independent who caucuses with Democrats and supported the 2022 talking-filibuster effort, later reconsidered. The Washington Post quoted him saying, “They were right, and I was wrong,” referring to his change of view on that proposal. In August 2026, Democratic senator John Fetterman also reversed course: after campaigning to eliminate the filibuster, he said that view was wrong and described the rule as a protection for the minority. Roll Call quoted him: “Upon reflection, the pursuit of those short-term wins clouded the bigger picture and lasting impact of a Senate without the filibuster — a Senate that ignored the voices of the minority and everyday people.” Roll Call reported Fetterman’s reversal in August 2026.
Schumer’s position in a different political context is not a future pledge
In July 2026, Schumer criticized President Trump’s call for Republicans to end the filibuster during a funding dispute. That statement addressed a Republican push in that specific context; it does not settle what Schumer would support if Democrats held the majority. What the main options would mean

A conditional proposal is not party policy
A September 2026 Washington Post opinion suggested keeping the threshold when one party controls both the Senate and the presidency, but dropping it under divided government. That is one commentator’s proposal, not an adopted Senate rule or an announced plan of the Democratic caucus. The opinion piece lays out that conditional approach.

If Democrats win the Senate, control alone will not answer whether the filibuster changes. Senators would still have to agree on a specific proposal and assemble the votes to enact it. Statements, past votes and the outcome of the 2022 fight help explain the divisions, but they do not provide a reliable whip count or prove how a future caucus would vote.
