Definition of a Data Non-Fungible Token (Data NFT): Meaning, Scope and Limits

A data non-fungible token (data NFT) is a unique blockchain token linked to a data asset. The label has no single universal meaning. In Ocean Protocol’s implementation, a Data NFT is an ERC-721 token that represents a claim to the copyright, or an exclusive license against copyright, for a dataset. Ocean calls that claim the asset’s “base IP.” Whether the token carries any real rights therefore depends on the contract and license behind it, not on the name.

What the term means

Start with the general NFT. The NIST CSRC glossary, which attributes its entry to NIST IR 8472, defines a non-fungible token as “An owned, transferable, and indivisible data record that is a digital representation of a physical or virtual linked asset. The data record is created and managed by a smart contract on a blockchain.” That describes NFTs broadly. It is not a standard for data NFTs.

The European Commission’s description of virtual-world transactions takes a similar view. It describes NFTs as unique, non-interchangeable data units on a digital ledger, used as public certificates of authenticity or proof of ownership, and notes that they can be associated with reproducible files.

Adding the word “data” changes the asset being linked, not the underlying standard. Projects use the phrase differently, so when you read it, identify which project’s meaning applies.

Ocean Protocol’s definition

Ocean Protocol’s developer documentation gives the most specific definition of a data NFT that this topic currently turns on. It says: “A data NFT represents the copyright (or exclusive license against copyright) for a data asset on the blockchain — we call this the ‘base IP’.” It describes the token as proof of the publisher’s claim, qualified by the phrase “Assuming a valid claim.”

That qualifier matters. Ocean’s framing holds only if the claim behind the token is valid. Ocean also states that a valid claim entitles the holder to the asset’s revenue by default. Both points describe Ocean’s implementation and should not be read as a legal rule that applies to every data NFT.

According to Ocean’s documentation, the Data NFT contract can do more than record ownership:

  • It can hold metadata describing the dataset.
  • It can store roles, such as which accounts may mint datatokens or control fees.
  • It can provide a key-value store for custom fields.

How ERC-721 fits in

ERC-721 is the Ethereum standard interface that most NFTs, including Ocean’s Data NFT, use. It defines how unique tokens are tracked and transferred. It does not define what a token means, what rights it carries, or where its data lives.

Token identity and transfer

ERC-721 tracks each token separately and defines the ownership and transfer functions. A token’s identity is the combination of its contract and its token ID. Two tokens with the same ID in different contracts are different tokens.

Metadata is optional

The standard’s metadata extension is optional. When a contract implements it, the tokenURI function returns a URI that points to JSON metadata. The standard does not require the dataset to be embedded in the token, and it does not guarantee that the URI or any external file will remain reachable. A token can therefore be valid on-chain while the file it describes cannot be retrieved.

  • Where the dataset is stored.
  • Which license governs the use of the data.

Does owning a data NFT mean owning the data?

Usually not, at least not on the strength of the token alone. Cornell Law School’s Legal Information Institute explains that owning an NFT record does not necessarily mean owning the linked asset, and does not necessarily convey intellectual-property rights in it. Three questions need separate answers:

  1. Who controls the token? Control is the wallet holding the token, plus any roles the contract assigns to other accounts.
  2. What rights does the token claim to represent? In Ocean’s model the claim is a copyright or an exclusive license, and it is valid only if the issuer actually holds it. Check the license terms attached to the dataset rather than inferring them from the token name.
  3. How does an authorized user reach the data? Access is a separate question from ownership of the token. In Ocean’s model, access is controlled through datatokens, covered below.

Where the data is stored

The token record and the dataset file can sit in different places. An ITU workshop presentation describing Ocean lists possible storage locations for data, including cloud services, on-premise storage, Dropbox, IPFS, Arweave and smart contracts. The presentation gives these as examples within that system, not as a universal rule. The practical consequence is that the token and the file have separate availability. Confirm where the file is hosted and whether you can reach it independently of the token.

Data NFT or datatoken?

The two terms are often mentioned together, but they are different tokens with different jobs. The comparison below reflects Ocean’s model as described in its documentation and in the ITU presentation.

Attribute Data NFT (Ocean) Datatoken (Ocean)
Token standard ERC-721, per Ocean documentation ERC-20, per the ITU presentation
What it represents Base-IP claim: copyright or exclusive license against copyright for the dataset Access control to the data or service represented by a Data NFT, per the ITU presentation
Uniqueness Each token is unique, as ERC-721 defines Fungible, as ERC-20 defines
Metadata and roles Can hold metadata, roles and a key-value store Not stated in the ITU presentation
Who can create it The publisher’s claim; roles in the Data NFT contract can include who may mint datatokens Minting is governed by roles set on the Data NFT, per Ocean documentation

Do not treat “datatoken” as a synonym for “data NFT.” A datatoken is one part of a model that may also include a Data NFT.

Checklist before relying on a data NFT

  • Read the contract and its metadata. Confirm whether the token claims copyright, an exclusive license, or something narrower.
  • Read the license attached to the dataset. A token name is not a license.
  • Check whether the issuer holds the rights it claims. In Ocean’s framing, the base-IP claim depends on that validity.
  • Identify where the dataset file is hosted and whether it remains accessible if the token or the hosting service changes.
  • Find out whether access requires a separate token and who can mint it.
  • Remember that ERC-721 defines only the token interface. Everything beyond ownership and transfer comes from the specific implementation.
