Data-center property tax depends on what a jurisdiction treats as taxable real property, fixtures or business personal property—and how it values each category. In Virginia, the statutory definition of data-center fixtures reaches much of the power and cooling plant, while computer equipment can be assessed separately under local depreciation schedules. That distinction can make property tax a material operating-cost and public-finance issue, but the available evidence does not establish a national tax burden, a typical effective rate or that operators universally overlook it.
How are data centers taxed?
There is no single nationwide data-center property-tax formula. Local rules determine which assets are taxable, how they are classified and valued, when they are assessed, and what rate applies. A project can have several distinct tax bases: land and buildings; equipment treated as real-property fixtures; and business personal property such as computer hardware. The same physical asset may not receive the same treatment in every jurisdiction.

Property tax is also distinct from sales and use tax. A sales-tax exemption on qualifying purchases does not, by itself, establish that land, buildings or equipment are exempt from recurring property tax.

A data center is more than its servers. Power delivery, backup generation, cooling, water and building systems can be substantial parts of the facility. If a jurisdiction treats those assets as taxable real property or fixtures, their assessed value may remain relevant even as computer hardware is depreciated under a separate schedule. The actual tax bill still depends on the jurisdiction’s valuation rules, assessment, applicable rate and any valid exemption or agreement.

Which data-center assets may be taxed as fixtures?
Virginia Code § 58.1-3295.3 provides a concrete, jurisdiction-specific example. For qualifying data centers, it defines fixtures to include extensive power, cooling and facility infrastructure. The statute also excludes certain computer and security equipment from that fixture definition. These definitions do not automatically apply elsewhere.
| Virginia statutory category | Examples specified in the statute |
|---|---|
| Included data-center fixtures | Generators, radiators, exhaust fans, fuel storage tanks, substations, power-distribution and cogeneration equipment, batteries, chillers, computer-room air conditioners, cooling towers, HVAC, water systems, monitoring systems, and transmission and distribution equipment. |
| Excluded from that fixture definition | Computer equipment and peripherals; external surveillance and security equipment; and fire and burglar alarm systems. |
The exclusions are exclusions from Virginia’s statutory fixture definition; they should not be read as a blanket exemption from every form of tax. Another jurisdiction may define fixtures or personal property differently, and an asset excluded from one category may still be subject to another assessment rule.
How Virginia values qualifying fixtures
The Virginia law requires qualifying fixtures taxed under the real-property chapter to be assessed using the cost approach. Under the statute, that means determining reproduction cost or suitable replacement cost and deducting physical, functional and economic depreciation. This is a legal valuation method for the qualifying fixtures within the statute’s scope, not a universal rule for data centers.

Do data centers pay property tax on servers?
Servers and related computer equipment may be assessed as business personal property rather than as real-property fixtures. That does not mean they are automatically tax-free. The assessor’s classification and the applicable personal-property rules determine whether and how they are assessed.
Loudoun County, Virginia, says its business personal-property assessments are based on a percentage of original cost. The county includes capitalized costs to place an item into service in that original cost. For tax year 2026, its data-center computer-equipment schedule assigns the following percentages by acquisition year:
| Acquisition year | Loudoun County 2026 assessment percentage |
|---|---|
| 2025 | 60% |
| 2024 | 45% |
| 2023 | 30% |
| 2022 | 15% |
| 2021 | 10% |
| 2020 and earlier | 5% |
These percentages are Loudoun County’s 2026 schedule, not national depreciation rates or tax rates. Beginning with tax year 2026, the county requires taxpayers to summarize capitalized costs by acquisition year for the most recent year and prior five years. Taxpayers should use the county’s current filing instructions for the required format and deadlines.

How do depreciation schedules account for aging computer equipment?
Personal-property schedules can recognize that computer hardware loses value through age and obsolescence. Utah’s 2026 recommended personal-property schedule classifies computer hardware as data-processing equipment and peripherals subject to rapid functional and economic obsolescence. Its recommended acquisition-year percent-good factors are:

| Acquisition year | Utah 2026 recommended percent-good factor |
|---|---|
| 2025 | 62% |
| 2024 | 46% |
| 2023 | 21% |
| 2022 | 9% |
| 2021 and earlier | 7% |
Utah’s figures are recommended factors for that schedule, not a universal standard, guaranteed assessment or tax-bill estimate. They are not directly interchangeable with Loudoun’s schedule: each is a jurisdiction-specific method, and the governing rules, reporting requirements and assessment context differ.
Do data-center tax breaks reduce property taxes?
Not necessarily. Incentives must be identified by tax type, eligibility, term and exclusions. The Texas Comptroller describes sales and use tax exemptions for qualifying data centers and qualifying large data-center projects, with facility and operator requirements that include specified investment and job commitments. Texas also states that facilities with agreements limiting appraised value under Tax Code Chapter 313 do not qualify for that sales/use tax exemption. That program description is not evidence of a general property-tax exemption.

Washington’s Department of Revenue describes its own sales/use tax incentive rules and eligibility limits, including an eligibility change in 2026. Those rules are Washington-specific; they should not be treated as a blanket reduction in property taxes or assumed to apply to a different project, tax year or jurisdiction.
For a project, check the actual statute, incentive agreement and tax type. A purchase-related exemption, a limit on appraised value and a recurring property-tax exemption are different mechanisms with different eligibility conditions.

Can a data-center assessment be appealed?
Assessment appeals can affect a property’s assessed value, but local outcomes do not establish a national pattern. In a July 24, 2026, account of the 2025 appeals cycle, the Cook County Assessor’s Office said several data centers received only minor reductions after the office defended assessments. The report also listed a 28.94% assessment reduction for Digital Realty ORD-15.

That 28.94% figure is an assessment reduction for one named property in that local appeals context—not a tax-rate change, a typical reduction, or evidence of what another data center will receive. The office’s account describes its own appeal-defense effort; it should not be generalized into a finding about assessment fairness nationwide.
What evidence matters in an appeal?
The relevant evidence and appeal route depend on local law and the issue being challenged. A taxpayer should first identify whether the dispute concerns classification, reported cost, depreciation, valuation method or another assessment input. The assessor’s instructions and the jurisdiction’s appeal procedures determine what documentation is accepted and when it must be filed.
How should a developer compare property-tax exposure between locations?
Compare the rules and records for the specific jurisdiction and project rather than applying a generic data-center tax estimate. Useful questions include:
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problems- Asset classification: Which components are land, buildings, real-property fixtures or business personal property?
- Valuation and depreciation: What method applies to each category, and how are physical condition, functional obsolescence and economic obsolescence treated?
- Assessment timing and reporting: What is the assessment date, and what cost detail or acquisition-year reporting is required?
- Tax rate and local practice: What rate applies to the relevant property class, and how does the local assessor document valuations?
- Appeal path: Where and by when can a classification or value be challenged, and what evidence is required?
- Incentives: Which tax does the incentive affect, what are its eligibility conditions and duration, and what exclusions apply?
California’s State Board of Equalization maintains state-assessment manuals and valuation materials, illustrating that assessment systems and guidance are jurisdictional. Its program is not a data-center-specific local property-tax guide. For a proposed facility, the relevant county assessor, state statutes, applicable rate, incentive agreement and current assessment and appeal records are the more direct sources.
What can be concluded about the “overlooked” value driver?
The evidence supports a practical warning, not a nationwide verdict: data-center tax analysis should account for the taxable value and classification of infrastructure as well as servers. Virginia’s fixture law shows how broad power and cooling systems can fall within a real-property framework; Loudoun County and Utah illustrate that computer equipment can use separate, age-sensitive schedules. Incentives and appeals add further jurisdiction-specific conditions.
The available sources do not quantify a national property-tax burden, establish a typical effective rate or per-megawatt tax amount, show that property tax is the largest cost driver, or prove that all operators or policymakers overlook it. A reliable estimate requires a named project’s asset inventory, local classification and valuation rules, tax rate, incentive terms and appeal record.
