Data Center Moratorium vs. Construction Ban: What’s the Difference?

A data-center moratorium is usually a temporary pause on specified government actions, while a construction ban prohibits construction itself or every approval needed to authorize it. The label is not decisive. The enacted ordinance, statute, executive order, or agency notice determines which projects are covered, which steps are blocked, whether existing rights are protected, and when the restriction ends. A moratorium can therefore halt a new facility during its term, but a narrowly written permit pause may leave construction or other approvals untouched.

Moratorium and construction ban: the functional difference

Officials often use “moratorium” and “ban” in headlines as shorthand, but they describe different legal effects. A moratorium is a temporary planning or permitting device. It pauses named government actions while officials study impacts, draft standards, or decide whether to change zoning. A construction ban is defined by an operative prohibition: it bars construction, or bars every permit and approval that would allow construction, for a stated period or indefinitely.

To classify a measure accurately, ask one question first: What governmental decision or physical activity does the text prohibit? A moratorium that blocks filing, review, approval, and issuance of all permits for a new data center may stop construction just as effectively as a ban for the duration of the order. A moratorium limited to one discretionary zoning hearing may not stop site work that already has the required approvals.

What “moratorium” normally means

A moratorium is a time-limited pause in specified governmental actions. The covered action may be:

  • reviewing or processing an application;
  • holding a zoning hearing or making a discretionary land-use decision;
  • approving or issuing a permit, license, certificate, or development order; or
  • granting a particular approval while officials write new rules.

The word does not reveal which of those steps is frozen. Public Evidence Project guidance emphasizes checking the exact text, legal status, scope, exceptions, and sunset date rather than relying on the label. A measure can also be called a moratorium even when its practical effect is a comprehensive approval prohibition.

What a “construction ban” means

A construction ban is defined by what it forbids. The operative language may prohibit physical construction, or it may prohibit every permit, license, approval, contract, or certificate that authorizes construction. Some bans apply only to new facilities; others cover expansions, high-power projects, or facilities above a floor-area threshold. A ban can be permanent or expire on a specified date.

State surveys by the National Conference of State Legislatures show why the word “ban” needs qualification. Measures described that way can combine approval restrictions, construction restrictions, and limits on public incentives. The legal effect depends on the enacted provisions, not on a headline or public statement.

Side-by-side comparison

Question Moratorium Construction ban
Primary purpose Temporarily pause specified approvals while officials study impacts or prepare rules. Prohibit construction or the approvals that would authorize it.
Government action affected May stop filing, acceptance, review, processing, approval, or issuance; the text controls. May stop physical construction and every approval needed to begin it.
Duration Normally temporary, with a stated sunset or extension mechanism. May be temporary or permanent; any end date or renewal authority must appear in the text.
Covered facilities Often limited by use definition, size, power, geography, or application type. Can cover all new facilities or only projects above specified thresholds or in a defined area.
Existing and approved projects May preserve operations, vested rights, complete applications, or permits issued before the effective date. May grandfather earlier permits or rights, but some texts reach expansions or work not yet authorized.
Practical result Could have no effect on construction if it pauses only one discretionary step, or could halt a new project if all required approvals are frozen. Construction cannot lawfully proceed within the prohibited scope unless an exemption, prior right, or other authorization applies.
Controlling law Local ordinance, state statute, executive action, or agency notice, plus state enabling law. The enacted prohibition and the state or constitutional limits on the government’s authority.

Does a moratorium stop construction or only permits?

It depends on the approval path for the particular facility. A city may pause only the acceptance and review of new applications. In that case, an applicant cannot enter the pipeline, but a project with a valid permit may continue unless the measure separately addresses construction. Another ordinance may prohibit zoning approval, and because a building permit cannot be issued without that zoning approval, construction is blocked indirectly.

Read the verbs in the operative section. “No application shall be accepted” is narrower than “no permit shall be issued,” and both are narrower than “no person shall construct.” Also check whether the measure covers:

  • site-plan, special-use, conditional-use, or zoning approvals;
  • building, electrical, utility, environmental, or roadway permits;
  • certificates of occupancy or final inspections;
  • expansions, material modifications, and changes of use;
  • work under permits already issued; and
  • applications filed before, but not completed by, the effective date.

A permit pause can still have a construction-level effect when the paused approval is a legal prerequisite for every later permit. Conversely, a building permit already issued may remain usable if the text does not revoke or suspend it and no other law prevents construction.

Can an existing data center keep building?

Often, but not automatically. Project status at the effective date is critical. Measures commonly distinguish among an operating facility, a project under construction, a complete application, a vested right, and a permit already issued. They may also treat a new expansion as a separate project even when the original facility is grandfathered.

Existing operations

An operating data center may continue routine use if the measure targets new development approvals. That does not necessarily authorize expansion, a new building, a larger power load, or a change that requires a fresh discretionary approval.

Projects under construction

Work already covered by a valid permit may be protected, especially when the ordinance contains a savings clause. Check whether the permit must be issued, merely applied for, or supported by a vested-rights determination before the effective date.

Pending and complete applications

Some texts stop only new applications; others suspend processing of every pending case. “Complete” can matter because a jurisdiction may preserve an application that met all filing requirements before the cutoff while rejecting an incomplete submission.

Permits issued before the effective date

A model bill from the University of Wisconsin–Milwaukee illustrates an explicit grandfathering approach: counties, municipalities, agencies, and political subdivisions would be barred temporarily from issuing any permit, license, approval, contract, or certificate authorizing data-center construction, but permits or certificates issued before the legislation’s effective date would be exempt.

Ancillary data-center equipment or rooms

An exemption may apply when servers support another principal use. Madison, Wisconsin, for example, excludes a data center serving a principal use such as a research laboratory or office building. A standalone campus and an equipment room inside another permitted use may therefore receive different treatment.

Official examples show why the text matters

Raleigh, North Carolina: a six-month approvals pause

The City of Raleigh’s Data Centers FAQ, updated October 7, 2026, describes a temporary six-month pause on development approvals for data centers. The city says the pause temporarily stops acceptance and review of applications for data-center development approvals. It also states that, under current North Carolina law, the city’s Unified Development Ordinance cannot ban data centers.

“Under current North Carolina law, the City’s Unified Development Ordinance … cannot ban data centers.” — City of Raleigh, Data Centers FAQ, updated 2026.

Raleigh is therefore an example of a moratorium used to create time for study and regulation rather than a permanent prohibition. Whether a particular project is stopped still depends on which approvals the adopted measure covers and how the six-month period is calculated.

Madison, Wisconsin: zoning pause that also blocks building permits

Madison describes its temporary moratorium as a planning tool that “presses pause” on potential proposals. During the moratorium, no zoning approvals may be granted for new principal-use data centers or telecommunications centers larger than 10,000 square feet. Because zoning approval is required before a building permit, the measure also prevents building permits or certificates of occupancy for those covered uses.

“The moratorium is a planning tool that ‘presses pause’ on any potential proposals and will give the City time to set responsible rules for a new land use category.” — City of Madison, Temporary Data Center Moratorium.

Madison demonstrates that a moratorium can have a construction-level effect without being a universal construction ban. The 10,000-square-foot threshold and the exclusion for data centers serving another principal use leave some activities outside the pause.

Larimer County, Colorado: application intake and processing freeze

Larimer County’s January 27, 2026 resolution established a temporary moratorium on accepting and processing land-use applications for new data-center facilities in unincorporated areas. The stated purpose is to develop land-use definitions and standards while reviewing impacts and best practices. This wording focuses on the application pipeline; it does not, by itself, answer how previously issued permits or construction already authorized will be treated.

Model legislative approach: a complete approval prohibition

The University of Wisconsin–Milwaukee model bill takes the broadest approach among these examples. For its temporary term, it would bar counties, municipalities, agencies, and political subdivisions from issuing any permit, license, approval, contract, or certificate that authorizes or allows data-center construction. Its exemption for permits and certificates issued before the effective date shows how a measure can be comprehensive for new approvals while preserving grandfathered projects.

How to determine whether your project is covered

Use the enacted measure and the official action record, not a news headline, hearing notice, or introduced bill. Work through these steps in order:

  1. Obtain the final text. Get the signed ordinance, enacted statute, executive order, or agency notice, including attachments and definitions.
  2. Confirm legal status. Verify the vote, signature, publication, effective date, and whether a court order or later amendment changes its operation.
  3. Copy the definition of “data center.” Note floor-area, electrical-load, power, technology, ownership, use, and campus definitions. A threshold may exclude a smaller facility or include an expansion that crosses it.
  4. Map every approval. List zoning, site-plan, building, electrical, utility, environmental, roadway, water, and occupancy approvals. Mark which one the measure pauses or prohibits.
  5. Check the verbs. Determine whether the text blocks filing, acceptance, review, processing, approval, issuance, construction, expansion, occupancy, or only one discretionary step.
  6. Establish the project’s status on the cutoff date. Record when the application became complete, when each permit was issued, whether construction began, and whether a vested-rights determination exists.
  7. Read every exemption and savings clause. Look for existing facilities, complete applications, vested rights, permits already issued, projects under construction, ancillary uses, and previously approved expansions.
  8. Calculate the time limit. Identify the exact sunset date, any extension authority, and conditions tied to a study, report, rulemaking, or replacement ordinance.
  9. Confirm geography and decision-maker. A county measure may cover only unincorporated land; a city measure may not control a state or regional approval. Identify which government actually issues the paused authorization.
  10. Get a written determination when stakes are high. Ask the permitting authority to identify the affected approval and grandfathering rule in writing, then obtain jurisdiction-specific legal advice before spending on irreversible work.

Geography, state law, and legal authority

There is no nationwide definition that makes every local “moratorium” or “ban” operate the same way. Local governments act under state enabling statutes, home-rule provisions, zoning law, and procedural requirements. Definitions, size or power thresholds, use classifications, and geographic boundaries can all vary.

Columbia Law School’s analysis identifies statutes in New Hampshire, Oregon, and Minnesota that authorize moratoria or land-use limitations for defined periods, with different conditions in each state. A local government without clear statutory authority may need another legal basis, and state preemption can limit what a city or county may regulate.

Authority is separate from policy disagreement. A community may oppose new data centers, but opposition does not itself create legal power to stop them. Officials must follow required notice, hearing, adoption, and effective-date procedures. An introduced bill, draft ordinance, or press release is not an enforceable ban.

Temporary does not mean legally risk-free

A broad temporary prohibition can raise authority and constitutional takings questions. Columbia’s analysis notes that even a temporary total ban on a land use may require review of the government’s legal authority and the effect on property rights. Relevant factors can include the duration of the restriction, its economic impact, the owner’s investment-backed expectations, and whether the measure is authorized by state law.

Those factors do not decide any particular claim. They explain why a project owner should not assume that a short duration eliminates legal risk, or that a label such as “moratorium” immunizes the measure from challenge. The answer depends on the jurisdiction, text, timing, and facts of the affected property.

Common mistakes when reading a data-center restriction

  • Treating the title as the rule. “Moratorium” may conceal a complete approval freeze, while “ban” may cover only facilities above a threshold.
  • Assuming every permit is paused. The text may stop zoning review but leave building, utility, or environmental work governed by separate rules.
  • Ignoring the effective date. A vote or announcement before effectiveness may not change an applicant’s rights.
  • Assuming an existing facility is fully protected. Operations may continue while expansions, new buildings, or increased power capacity require new approvals.
  • Overlooking geography. A city ordinance may not apply in unincorporated county territory, and a county measure may not control state-issued approvals.
  • Missing the definition. Floor area, electrical capacity, principal-use status, or technology criteria can determine whether a project is covered.
  • Calling a proposal a ban. Only final, effective text establishes an enforceable prohibition.

Practical scenarios

Project situation Likely question to resolve Why the answer varies
New facility with no application filed Can the jurisdiction accept the application? A moratorium may stop filing or acceptance; a ban may prohibit every approval.
Complete application filed before the cutoff Is it processed under the old rules? Some measures grandfather complete applications; others suspend all pending cases.
Building permit issued before the effective date Can permitted construction continue? Savings clauses may protect issued permits, but the text may address work, expansion, or occupancy separately.
Operating facility seeking an expansion Is the expansion treated as new development? Existing use may be exempt while a larger building, power load, or new discretionary approval is covered.
Server room inside a research or office building Does the principal-use exception apply? Madison excludes data centers serving another principal use, unlike a standalone principal-use facility.
Project in unincorporated county land Which government’s restriction controls? A county resolution may apply there while a city ordinance does not.

Bottom line for applicants and officials

Use “moratorium” for a temporary pause in identified governmental actions and “construction ban” only when the operative text prohibits construction or all approvals that would authorize it. Then state the jurisdiction, covered definition, effective date, duration, exemptions, and project status. A moratorium can stop a new data center, but only the enacted text tells you whether it stops applications, permits, construction, occupancy, expansions, or some combination of those steps.
