The agreement, announced October 13, 2026, also requires new controls under a memorandum with the Drug Enforcement Administration (DEA). The settlement resolves allegations, not a court finding: DOJ said there has been no determination of liability, and CVS has said it strongly disagrees with the claims and admitted no wrongdoing.

What DOJ alleged CVS pharmacies did
The civil complaint covered conduct DOJ said occurred from October 17, 2013, through December 2, 2025. Prosecutors alleged that CVS pharmacies:
Recommended Free Tools
- Filled opioid prescriptions for excessive quantities or filled them before the appropriate time.
- Dispensed so-called “trinity” prescriptions, an abused combination of an opioid, a benzodiazepine and a muscle relaxant.
- Filled large volumes of controlled-substance prescriptions written by prescribers DOJ characterized as “pill mill” operators—prescribers allegedly issuing prescriptions without a legitimate medical purpose.
- Submitted, or caused others to submit, reimbursement claims for many of those prescriptions to Medicare and other federal programs.
The complaint also alleged that corporate production metrics, incentive compensation and staffing practices made it difficult for pharmacists to meet performance expectations while carrying out their legal duties. It further alleged that pharmacists were restricted from sharing some warning information about problematic prescribers. Allegations that patients died after overdosing soon after receiving prescriptions were also included in the complaint; those patient-harm assertions have not been adjudicated.

Why the False Claims Act is part of the case
The government’s case combines the Controlled Substances Act (CSA) with the False Claims Act (FCA). The CSA governs the lawful dispensing of drugs such as opioids, benzodiazepines and muscle relaxants. The FCA allegations concern the separate step of seeking federal reimbursement for prescriptions that prosecutors contend were unlawfully dispensed.

A private individual can bring a qui tam FCA action on behalf of the United States. Former CVS employee Hillary Estright filed this case, and the Justice Department intervened and took over the litigation. DOJ identified the matter as United States ex rel. Hillary Estright v. CVS Health Corporation, et al., No. 22-cv-00222, in the U.S. District Court for the District of Rhode Island. DOJ said the amount, if any, payable to Estright as a whistleblower award had not yet been determined.

- Spring Assisted Open Design. We use the latest design on this weekly pill organizer to achieve one-handed operation with the little rubber strips for the smart "lid spring open" feature. The lids are all beautifully colored and marked clearly with the date, everything is clear at a glance so you may find it easy to choose the pills you need. It's quite nice for easy daily dispensing and big enough to hold 8 fish oils or 12 large vitamins for each dose (size of each compartment: 1.3"x1.18"x0.82")
- Say Goodbye to Dumpage Pills. No worries about unwanted dumpage of pills found by pets and kids for your slightest unintentional or incidental touch on the medicine organizer. The push button stays closed once locked and securely snap shut keeping pills safe. It's small and perfectly suitable for travel and is ideal for storing small jewelry or items such as earrings, beads, nail art tips, ect.
- Premium Screen Printing. To avoid screen-printing fonts and icons falling off from the surface of the pill box, we use high-end screen printing ink and strictly do the Ink Adhesion Test with 3M Tapes before shipment. Thus, no need to be frustrated with the missing fonts of "Tuesday" or icons of "PM", and worry about mistakenly taking the wrong tablets.
- BPA-Free Material. This pill case is pretty safe because of being made of food grade materials. You would be worry-free with the BPA-free pill boxes and organizer when storing multiple pill regimes inside. With the transparent plastic lid, it's quite easy to distinguish the pills in each dose without opening the lids.

- Proactive dispensing surveillance: The company must monitor pharmacy dispensing patterns for warning signs.
- Prescriber review: CVS must create a process for evaluating prescribers suspected of illegal prescribing.

Assistant Attorney General Brett A. Shumate said the agreement requires “additional safeguards to ensure that prescriptions for opioids and other controlled substances are dispensed only when medically appropriate.”

A civil settlement can end the government’s litigation without answering every factual dispute in a trial. It also does not establish that every prescription dispensed by CVS during the alleged period was unlawful, nor does the announcement provide a specific allocation of the payment among the alleged conduct, federal programs or any whistleblower recovery.
What the settlement means for controlled-substance dispensing
The case puts pharmacy controls—not only prescriber behavior—at the center of federal opioid enforcement. DOJ officials said pharmacies dispensing controlled substances must maintain effective systems to identify and respond to warning signs that a prescription may be unlawful or medically unnecessary. In practical terms, the DEA agreement requires CVS to add centralized reporting, pattern monitoring and prescriber evaluation to the safeguards used at its pharmacies.
