Crypto Tax Treatment in Latvia vs. Estonia and Lithuania (2026 Guide)

Latvia, Estonia and Lithuania do not tax the same crypto transaction at the same moment. Latvia generally treats an individual’s crypto disposal gain as a capital gain and, from 2025, applies a 25.5% rate. Estonia normally taxes each profitable sale or crypto-to-crypto exchange as a property transfer, but gives qualifying assets acquired through MiCA-authorised providers a financial-asset regime from 2025. Lithuania treats virtual currency as property: incidental gains are sale proceeds minus acquisition cost and allowable expenses, with a cited annual exemption of up to EUR 2,500 for qualifying gains. Mining, staking, airdrops and crypto paid for work can move you out of the simple-investor rules in all three countries.

The practical difference is timing. An Estonian investor can have a tax event when swapping one token for another, while Latvia’s tax authority guidance generally identifies the event when crypto is exchanged for official currency, goods or services. Lithuania applies its property framework to transfers, but the final treatment depends on whether the activity is incidental or an ongoing profit-making activity.

Comparison at a glance

Issue Latvia Estonia Lithuania
Basic classification Individual disposal gain is generally capital gain. Property-transfer gain calculated for each transaction. Virtual currency is property; incidental sale gains use the property-sale calculation.
Individual rate or threshold established in the cited guidance 25.5% from 2025 (20% before 2025). The cited guidance does not provide a single crypto-specific rate. Qualifying annual incidental gains up to EUR 2,500 are exempt under the cited PIT provision; confirm the current 2026 rules.
Crypto-to-crypto exchange SRS guidance generally places the tax point when crypto is ultimately exchanged for official currency, goods or services. A profitable exchange is itself a taxable transfer. Handled as a transfer or sale under the property framework.
Losses No gain where disposal proceeds do not exceed acquisition value; offsets depend on the Latvian capital-asset rules. Losses from non-MiCA transactions are not deductible. Qualifying MiCA financial-asset losses can be deducted and carried forward. Check the latest VMI rules for current loss-offset treatment.
MiCA impact SRS notes that some assets outside MiCA’s scope may be treated differently. From 2025, assets acquired through MiCA-authorised providers or issuers can be financial assets, with investment-account treatment and separate return tables. No equivalent current rule was established in the VMI material used for this comparison.
Mining, staking, remuneration and airdrops Classification depends on the substance of the activity; economic activity or other-income treatment may apply. Mining, staking, remuneration and airdrops are taxable income categories. Continuous autonomous trading or mining for profit can be individual activity; actual or deemed costs may matter.

This table is a decision map, not a substitute for determining your tax residence, activity status and the legal status of each asset.

What counts as a taxable crypto event?

A “taxable event” is the transaction or receipt that creates income for tax purposes. Buying and holding a token is not described in the cited guidance as a disposal. The difficult cases are swaps, spending, rewards and services because the transaction may be both a disposal of one asset and a receipt of another kind of income.

Sale for euros or another fiat currency

For a disposal, calculate the gain as the amount received, less the acquisition cost and directly related expenses where the country’s rules allow them. Keep the euro value and the fee separately: an exchange’s percentage fee, withdrawal charge or broker commission can change the gain even when the token price is unchanged.

Crypto-to-crypto swaps

Timing differs sharply:

  • Estonia: a profitable exchange is a taxable property transfer. The euro value of the asset received at the exchange time is compared with the allocated acquisition cost of the asset given up.
  • Latvia: the State Revenue Service (SRS) guidance generally identifies income when crypto is exchanged for official currency, goods or services. A token-for-token swap therefore does not usually create the same immediate tax point as it does in Estonia, although the later disposal still requires complete cost records.
  • Lithuania: an exchange is treated as a transfer or sale under the virtual-currency-as-property framework. The current VMI position and your facts should be checked before filing.

Do not use the word “swap” as if it had one European meaning. Record what you gave up, what you received, the timestamp, the euro value and every fee.

Latvia: capital-gains treatment for individuals

Rate and calculation

The Latvian SRS states that income earned by an individual from selling crypto-assets (virtual currency) is capital-gain income taxed at 25.5% from 2025; the rate was 20% before 2025. The quoted SRS wording is: Fizisko personu gūtais ienākums no kriptoaktīvu (virtuālās valūtas) pārdošanas ir ienākums no kapitāla pieauguma, kam no 2025. gada piemēro iedzīvotāju ienākuma nodokļa likmi 25,5 % apmērā (iepriekš – 20 %). The statement was updated by the SRS on 18 May 2026.

For each disposal, the basic gain is:

Gain = disposal price − acquisition cost − related allowable expenses.

“Acquisition cost” should include the amount paid and documented purchase-related charges that the Latvian rules permit. Keep the calculation in euros, even if the exchange reports in dollars or another currency.

Latvian example

You buy crypto for EUR 10,000 and pay a EUR 100 purchase fee. You later sell it for EUR 14,000 and pay a EUR 100 selling fee. The documented gain is EUR 3,800 (14,000 − 100 − 10,000 − 100). At 25.5%, the illustrative tax on that gain is EUR 969. This example assumes the transaction is within the individual capital-gain regime and does not account for other income, offsets or filing adjustments.

When a crypto-to-crypto exchange matters

SRS guidance generally treats the relevant Latvian income as arising when crypto is exchanged for official currency, goods or services. A token swap can therefore defer the disposal calculation until a later cash sale, purchase of goods or payment for services. Deferral does not eliminate the need to preserve the original acquisition cost and the value path through every wallet and exchange.

Reporting frequency

The SRS uses a EUR 1,000 quarterly threshold for capital-asset income. When total capital-asset income exceeds EUR 1,000 in a quarter, quarterly capital-gains reporting is required; when it does not, the applicable annual filing deadlines apply. The threshold concerns the reporting schedule, not a tax-free amount. Confirm the current SRS filing calendar and form before submitting a return.

High-income additional tax

Latvia’s SRS materials also state a 3% additional personal-income-tax charge on annual income above EUR 200,000 from 2025 onward. Whether the surcharge reaches your crypto gain depends on your total income and the applicable calculation, so do not treat 25.5% as an all-in rate for a high-income year.

Losses and non-investment activity

If the disposal price does not exceed the acquisition value, that transaction does not produce a positive gain. Detailed offset rules are part of Latvia’s wider capital-asset regime; retain losing trades rather than deleting them and verify which losses can be used on your return.

Mining, staking, providing services for tokens or trading as an organised business can be classified by substance as economic activity or another income type instead of a simple passive capital gain. Indicators include regularity, organisation, equipment, customer activity and a profit motive. The classification changes bookkeeping and potentially the deductions available.

Estonia: immediate taxation of profitable transfers, with a MiCA route from 2025

Ordinary property-transfer rule

The Estonian Tax and Customs Board (EMTA) says that profitable sales and exchanges are declared as property transfers. Its guidance states: Only sales or exchange transactions from which gains were derived must be declared. Under this approach, a swap from one cryptocurrency into another is not merely a portfolio change: if the received asset is worth more in euros than the allocated cost of the asset surrendered, the gain is declared for that transaction.

Transaction-by-transaction records

Allocate a cost basis to the units disposed of, value the consideration in euros at the exchange time, and subtract documented transaction costs that the applicable rules recognise. A later sale of the token received in the swap uses its own acquisition value. Without a unit-level ledger, one profitable exchange can be impossible to reconstruct months later.

Losses outside the MiCA financial-asset treatment

Losses from non-MiCA transactions are not deductible under the cited EMTA guidance. A losing trade therefore cannot automatically offset a profitable trade merely because both occurred in the same year. Keep loss records for audit clarity, but do not deduct them unless the rule for your asset and account permits it.

What changes from 2025

From 2025, crypto-assets acquired through a MiCA-authorised provider or issuer are treated as financial assets in the Estonian framework described by EMTA. That treatment can provide two important mechanisms:

  • Investment-account treatment: qualifying activity can be reported through the investment-account system, allowing tax deferral under that system’s contribution-and-withdrawal rules rather than taxing every permitted reinvestment immediately.
  • Loss treatment: qualifying financial-asset losses may be deducted and carried forward, unlike losses from non-MiCA transactions.

These benefits are not triggered by calling a platform “regulated.” Preserve evidence of the provider’s or issuer’s MiCA authorisation, the acquisition date and the asset involved. EMTA uses separate return tables for the relevant financial-asset transactions, so mixing them with ordinary crypto transfers can produce the wrong result.

Mining, staking, airdrops and remuneration

EMTA identifies mining, staking, remuneration and airdrops as taxable income categories. The receipt is therefore analysed as income when earned or received, rather than being treated automatically as a later capital gain. Keep the date, euro value, payer or protocol, and any costs associated with earning the reward. A later sale also needs its own disposal calculation using the recorded receipt value as the starting reference, subject to the applicable Estonian rules.

Lithuania: virtual currency as property

Incidental sales

The State Tax Inspectorate under the Ministry of Finance (VMI) says that a virtual currency is property; incidental income from selling it is taxed like income from selling other assets or transferring ownership. The basic calculation is sale proceeds minus acquisition price and allowable costs.

“a virtual currency is considered as property; therefore, when incidental income from sales of a virtual currency is received, it is taxable the same as other income from sales of assets or other transfer into ownership.”

State Tax Inspectorate under the Ministry of Finance, virtual-currency guidance

EUR 2,500 annual exemption

The PIT provision cited in the VMI guidance exempts qualifying annual gains from incidental virtual-currency sales up to EUR 2,500. The threshold is not permission to ignore records: you still need proceeds, acquisition prices and allowable costs to establish whether the gains qualify and how much exceeds the exemption. Because the cited material does not establish the complete 2026 rate and threshold schedule, confirm the current VMI rules and return instructions for the year you are filing.

Swaps and other transfers

Under the property framework, exchanging one token for another is treated as a transfer or sale rather than an invisible portfolio event. Record the market value in euros on the transaction date, the cost of the units disposed of and the fees. A current VMI interpretation should be checked where a protocol, derivative, wrapped token or non-cash consideration makes the transfer classification unclear.

When activity becomes individual activity

Continuous, autonomous trading or mining carried out for profit can constitute individual activity rather than incidental asset sales. The distinction is factual: frequency, independence, equipment, organisation and an evident profit purpose all matter. For individual activity, actual or deemed costs may be relevant, and the record set must cover operating expenses as well as token purchases and sales.

Mining, staking, airdrops and crypto salary

Passive investment rules cannot be applied mechanically to tokens received for work or for operating infrastructure.

Receipt or activity Latvia Estonia Lithuania
Mining May be economic activity or another income category depending on substance. Taxable income category identified by EMTA. Regular profit-making mining can be individual activity; cost method becomes relevant.
Staking and protocol rewards Analyse whether the activity is passive capital investment, economic activity or other income. Staking is a taxable income category. Classify under the facts and current VMI guidance; do not assume the incidental-sale exemption covers the reward.
Airdrops Classify the receipt and retain evidence of value and conditions. Airdrops are a taxable income category. Determine whether the receipt is incidental income or part of individual activity.
Salary or service payment in crypto Usually requires analysis as remuneration or economic activity rather than a simple investment disposal. Remuneration is a taxable income category. Employment or self-employed activity rules can apply before any later asset-sale calculation.

For each receipt, record the euro value on the date you obtain control, who paid it, why it was paid and the fees required to earn it. When you later dispose of those units, keep the receipt record separate from the disposal record.

How MiCA changes the comparison

MiCA is not a universal crypto tax exemption. Its practical tax importance in this comparison is strongest in Estonia, where the 2025 rules distinguish assets acquired through MiCA-authorised providers or issuers and can place them in the financial-asset regime. That distinction affects investment-account reporting and the treatment of qualifying losses.

Latvia’s SRS notes that some crypto-assets may be treated differently when they fall outside MiCA’s scope, but the cited material does not establish an Estonian-style blanket investment-account mechanism for Latvian individuals. Lithuania’s cited VMI material likewise does not establish an equivalent current MiCA rule.

Check authorisation at the time of acquisition, not only the platform’s present marketing page. Save the legal entity name, authorisation reference, date, asset and account statement. If a provider later changes status, preserve the historical evidence used for the original classification.

Record-keeping system that works in all three countries

The authorities’ transaction-based approaches make reconstruction the main practical risk. The following is a conservative record-keeping recommendation, not a quoted universal statutory list.

  1. Export raw data: download CSV or PDF statements from every exchange, broker, wallet and protocol. Keep the original files unchanged.
  2. Build a transaction ledger: include date and time, asset and quantity sent, asset and quantity received, euro value, fees, wallet addresses, platform and transaction ID.
  3. Track acquisition lots: record purchase price, purchase fee, allocation method and the units remaining after each disposal.
  4. Separate event types: label purchases, sales, swaps, spending, mining, staking, airdrops, salary, service income and transfers between your own wallets.
  5. Document euro conversion: note the exchange-rate source and timestamp used when a platform reports in another currency.
  6. Prove MiCA status: retain evidence that a provider or issuer was authorised where you intend to use Estonia’s financial-asset treatment.
  7. Reconcile balances: compare wallet balances with exchange statements and investigate unexplained deposits, withdrawals and duplicate records.
  8. Archive filings: store submitted returns, calculations and supporting documents for the retention period required by your national rules.

Worked comparison: one investor, three systems

Assume an investor buys Token A for EUR 6,000 plus EUR 60 fees. When its value reaches EUR 9,000, the investor swaps it for Token B and later sells Token B for EUR 10,000, paying EUR 100 to sell.

Country Likely timing under the cited guidance What must be measured
Latvia The SRS approach generally points to the later exchange for official currency, goods or services rather than the initial token swap. Preserve the EUR 6,060 acquisition basis, the EUR 9,000 swap valuation and the later sale proceeds and fees so the final disposal can be calculated.
Estonia, ordinary non-MiCA treatment The EUR 9,000 Token A-to-Token B exchange is a taxable transfer if profitable; the later Token B sale is a separate transaction. Calculate the first EUR 2,940 gain (9,000 − 6,060) and establish Token B’s acquisition value from the exchange, then calculate the second disposal.
Estonia, qualifying MiCA financial asset If the acquisition and account qualify, investment-account rules and financial-asset loss provisions may apply instead of ordinary transaction treatment. Keep authorisation evidence and use the separate return tables required for the financial-asset regime.
Lithuania The swap is treated as a transfer or sale under the property framework; confirm the current VMI application to the facts. Record the EUR 9,000 transfer value, EUR 6,060 basis, subsequent EUR 10,000 sale and allowable costs, then test the annual EUR 2,500 qualifying exemption.

The figures illustrate why identical trading activity can produce different filing years and why a single end-of-year cash-out report is not reliable for Estonia.

Filing checklist

  • Identify your tax residence and the country whose return you must file; this comparison does not resolve treaty or multi-country residence questions.
  • Classify each item as a disposal, exchange, spending transaction, reward, airdrop, salary or service payment.
  • Calculate euro values and documented costs for every relevant event.
  • For Latvia, check whether capital-asset income exceeded EUR 1,000 in any quarter and whether total annual income triggers the 3% surcharge above EUR 200,000.
  • For Estonia, separate ordinary crypto transfers from assets acquired through MiCA-authorised providers or issuers, and apply the correct return tables.
  • For Lithuania, test whether the activity is incidental or individual activity and whether qualifying annual incidental gains fall within the EUR 2,500 exemption.
  • Review the current 2026 forms, rates and deadlines published by the relevant tax authority before filing.

Common mistakes and how to correct them

“I never withdrew euros, so there is no tax.”

This is unsafe in Estonia, where a profitable crypto-to-crypto exchange is taxable, and it can fail in Lithuania where transfers are analysed as property sales. Latvia is more closely tied to an exchange for money, goods or services under the cited SRS guidance, but later disposal still requires the full history.

“Every loss offsets a gain.”

Estonia expressly disallows losses from non-MiCA transactions, while MiCA financial-asset losses can receive different treatment. Latvia and Lithuania require their own capital-asset or property-activity analysis. Keep losses, but deduct them only under a rule that applies to your transaction class.

“A regulated exchange automatically qualifies for MiCA treatment.”

Estonia’s rule concerns acquisition through a MiCA-authorised provider or issuer. Obtain evidence of the specific authorisation and the date; generic regulatory language is not enough.

“Staking is just a sale later.”

Rewards can be income when received. Estonia explicitly lists staking, mining, remuneration and airdrops as taxable income categories, and Latvia and Lithuania may classify organised or remunerated activity outside passive investing.

“The EUR 2,500 Lithuanian amount means no records are needed.”

The exemption applies only to qualifying annual incidental gains. You must calculate the gain and establish that the activity is incidental before relying on it.
