Spot crypto is generally the simpler structure: you buy or sell the asset itself, while a derivative gives you a contract whose value follows an asset without giving you ownership. Derivatives can add leverage, margin calls, financing charges and forced liquidation, so losses can grow faster than with an unleveraged spot purchase. Spot trading is not safe: prices can collapse, wallets can be stolen, addresses can be mistyped and an exchange can fail. In Australia, an AUSTRAC registration is not the same as an Australian financial-services licence. Before trading, identify what you actually hold, verify authorisation for that exact product, calculate every cost and plan how you will secure records and assets.
Spot and derivatives answer different investment questions
With spot trading, your order is for the crypto-asset itself. If the transaction settles, the asset is credited to a wallet controlled by you or held by the platform for you. You may later transfer it, sell it or use it where the asset is accepted. Your result is driven mainly by the asset’s price movement, less trading, custody, transfer and network costs.

A derivative derives its value from an underlying crypto-asset or another reference value. A CFD is a contract with the provider: you speculate on price movement but do not own the underlying coin. Futures and options are other derivative forms, each with its own expiry, settlement and margin rules. Because the contract can represent a position larger than the cash you deposit, a relatively small price move can produce a large gain or loss.
The distinction matters for control, risk, costs, insolvency exposure, tax records and legal protections. Calling an account “crypto trading” does not tell you whether you own coins or have only a contractual claim. Read the product terms and settlement description before depositing money.

How spot trading works in practice
Buying and holding the asset
You place an order against the venue’s order book or quoted price. Once filled, the platform records a balance in the selected asset. Some services let you withdraw to a personal wallet; others keep assets in omnibus or platform-controlled custody. Your economic exposure is normally one-for-one: a 10 per cent fall in the asset’s price reduces the market value of an unleveraged holding by about 10 per cent, before fees. There is no automatic liquidation merely because the price falls, although a platform can have its own terms and a lender can liquidate collateral.
Transferring to a wallet
A withdrawal creates a blockchain transaction. You must select the correct network, copy the recipient address exactly and check whether a memo or tag is required. A wrong address, incompatible network or missing tag can make recovery impossible. The platform may charge a withdrawal fee, while the network may charge a transaction fee that changes with congestion. A personal wallet removes some exchange-custody dependence but transfers responsibility for the device, backup and recovery phrase to you.
Spot risks that remain
- Crypto prices can fluctuate hugely over short periods, and an asset can lose most or all of its value.
- Exchange accounts can be frozen, hacked or affected by insolvency.
- Phishing, fake investment offers and social-engineering scams can take control of accounts or recovery phrases.
- A lost seed phrase, damaged device or mistaken transfer can permanently block access.
- Some assets or trading platforms provide limited or no Australian regulatory recourse.
ASIC MoneySmart describes most crypto as high-risk investments and says you must be prepared to lose what you invest. That warning applies even when no leverage is used.

Margin and leverage
Margin is collateral supporting a position. Leverage lets that collateral control a larger notional amount. If a contract gives you 5:1 exposure, a deposit of $1,000 controls a $5,000 position before fees; the illustration describes the relationship, not a recommendation or a universal product term. A small adverse move consumes collateral faster when leverage is higher. The provider can require more margin or close the position when its maintenance threshold is breached.
Liquidation and forced closure
Liquidation is an automated sale or close-out intended to prevent the account from going further below its collateral. It can occur before the underlying asset reaches zero and may happen during a fast market move when the execution price is worse than the displayed quote. A liquidation charge, spread and market impact can leave less collateral than expected. A stop-loss order is not a guarantee against gaps, outages or a price that jumps through the trigger.
Funding, expiry and settlement
Some perpetual contracts exchange funding payments between long and short traders at intervals; other contracts apply an overnight or rollover charge. Dated futures can expire and settle in cash or an asset. Options have a premium and an expiry, and the holder’s right depends on the contract terms. CFDs usually settle the price difference with the provider rather than delivering coins. Confirm the calculation method, payment timing, index used, trading hours and treatment of a suspended or forked asset.

Retail leverage limits and product classification
ASIC limits leverage for certain retail crypto-derivative products to 2:1. The limit does not make a derivative safe, and it does not apply to every possible product or client category. ASIC’s crypto guidance explains that an asset can be a derivative, security, managed-investment interest or non-cash payment facility depending on its rights and features. Classification is determined by the product’s legal characteristics, not by its marketing label.

| Question | Spot transaction | Derivative position |
|---|---|---|
| What do you hold? | The crypto-asset itself, or a platform-recorded balance representing it. | A contract whose value references an asset; a CFD does not give ownership of the underlying. |
| Leverage | Usually unleveraged unless you borrow separately. | Margin and leverage may make the notional exposure larger than the deposit. |
| Maximum loss | Generally the amount invested, plus fees, if you do not borrow. | Collateral can be consumed quickly; the contract may permit additional margin or a deficit depending on its terms. |
| Liquidation | No contract liquidation solely because market price falls, although platform or lending rules can apply. | Automatic close-out can occur when maintenance margin is breached. |
| Access to coins | Withdrawal may be available, subject to network and platform rules. | Normally no underlying-asset withdrawal from a CFD or cash-settled contract. |
| Time horizon | Can be held indefinitely while custody and network support continue. | May incur recurring funding or rollover charges, or have an expiry. |
| Main operational risk | Wallet security, address errors, custody failure and network fees. | Provider solvency, pricing and margin systems, liquidation and funding calculations. |
Neither column is a safety classification. An unleveraged spot holding can lose its full value, and a carefully sized derivative can still be closed during an abrupt move or provider outage.
Costs: calculate the all-in amount before opening a position
There is no single Australian spot or derivatives fee figure. Charges vary by venue, asset, payment method, account tier and contract. Compare the complete cost of entering, holding and exiting rather than relying on a headline commission.
| Cost category | Spot examples | Derivative examples | What to verify |
|---|---|---|---|
| Quoted spread | Difference between buy and sell quotes. | Difference between bid and offer on the contract; it may widen during volatility. | Displayed spread, execution policy and whether the quote is firm. |
| Trading commission | Per-order or volume-based charge. | Per-contract, percentage or transaction charge. | Maker/taker tiers, minimums and rebates. |
| Deposit and withdrawal | Bank, card or platform charges; blockchain withdrawal fee. | Funding-account charges and any cash withdrawal fee. | Fee currency, minimum amount and processing time. |
| Network fee | Blockchain fee when moving the asset. | Usually not incurred for a cash-settled CFD because no coin is delivered. | Whether the provider passes through a variable network charge. |
| Funding or financing | Not normally charged for an outright holding, unless you borrow. | Perpetual funding, overnight interest, financing or rollover charge. | Rate formula, interval, direction of payment and rate history. |
| Margin and liquidation | Not applicable to a cash purchase. | Initial and maintenance margin, close-out fee and slippage at liquidation. | Thresholds, liquidation engine and whether a deficit is possible. |
| Custody | Platform custody fee or personal-wallet operating cost. | Usually contract-account custody rather than coin storage. | Who controls private keys and what happens during suspension. |
A simple pre-trade calculation
- Write down the cash amount you will deposit and the notional exposure you intend to control.
- Estimate the entry spread and commission using the actual order type and size.
- For spot, add the expected withdrawal and network charges if you plan to self-custody.
- For a derivative, add each funding or overnight charge for the planned holding period, then model an adverse move that triggers margin or liquidation.
- Estimate exit spread, commission and any conversion fee. Treat the result as an estimate because spreads, funding rates and network fees can change.
Australian regulation: ASIC authorisation is not AUSTRAC registration
What ASIC licensing addresses
A provider offering financial services involving derivatives, futures, options, leveraged tokens or binary options needs appropriate Australian licensing when the product and activity fall within the financial-services regime. A platform enabling trading in crypto-assets that are financial products may need an Australian market licence. Licensed providers may have obligations to give retail disclosure, operate internal dispute resolution and provide access to an external scheme such as the Australian Financial Complaints Authority, subject to the product and licence.
What AUSTRAC registration means
AUSTRAC requires a business exchanging virtual assets for money in Australia to register before providing virtual-asset services. Registration is an anti-money-laundering and counter-terrorism-financing control. It is not a promise that an investment will perform, that client assets are protected or that every product is an ASIC-regulated financial product. AUSTRAC chief executive Brendan Thomas said on 8 May 2026 that the agency was checking how well Australian crypto businesses manage money-laundering risks ahead of major new laws.

How to check a provider
- Identify the legal entity named in the terms, not just the trading brand or mobile app.
- Search ASIC’s registers for the entity and confirm the licence covers the exact service: spot custody, dealing, derivatives or market operation.
- Separately check whether an Australian virtual-asset service provider is registered with AUSTRAC where registration is relevant.
- Read the product disclosure statement, client agreement and risk warning. A licence for one service does not automatically authorise another.
- Record the entity’s jurisdiction, dispute process, custody model and contact details before funding the account.
MoneySmart warns that crypto or digital assets that are not financial products may not be regulated by ASIC. An unlicensed investment can be harder to resolve if something goes wrong.

Overseas exchanges and access from Australia
Being able to open an account from Australia does not establish that the provider is authorised to offer the product to Australian retail clients. An overseas platform may be subject to the law of its home jurisdiction, use a foreign contracting entity and provide no access to AFCA or Australian client-money protections. ASIC has warned that users of unlicensed crypto futures lose important rights and protections.
Before using an overseas venue, establish which entity holds your money, where records and assets are kept, which court or ombudsman can hear a dispute and whether Australian residents are accepted under the provider’s terms. Do not assume that an Australian bank transfer, Australian dollar display or local-language website changes the legal status of the service.
What happens if an exchange fails?
Custodial spot balance
If the platform controls the private keys, your account balance may be a contractual claim against the platform rather than coins immediately available to you. Insolvency administrators may need to determine which assets are held for customers, which are commingled and which liabilities rank ahead of customers. Recovery can be delayed, partial or unavailable. The outcome depends on the agreement, corporate structure, records and applicable insolvency law.

A derivative trader generally has a claim under the contract, not a right to withdraw the underlying coin. A provider failure can interrupt pricing, margin calculations and close-outs at the same time that markets are moving. Read whether collateral is segregated, how negative balances are handled and what insolvency process applies.
Practical protections
- Keep only the amount needed for active trading on a platform.
- Withdraw long-term spot holdings to a wallet whose recovery process you understand.
- Save statements, trade confirmations, wallet addresses and transfer transaction IDs outside the exchange.
- Test a small withdrawal before sending a larger amount.
- Know the provider’s outage, suspension and complaints procedures before an emergency.
Security and custody for spot holdings
Account controls
Use a unique password, app-based two-factor authentication and withdrawal-address controls where available. Treat unsolicited messages, urgent “verification” requests and requests for a seed phrase as scams. Bookmark the genuine login page, check the domain before entering credentials and consider a separate email address for financial accounts.
Hardware wallets
A hardware wallet can make remote hacker access harder because signing keys remain on a dedicated device. It does not remove price risk, supply-chain risk, device failure, seed-phrase theft or user error. Write the recovery phrase according to the manufacturer’s instructions, store it offline in a secure location and never photograph or upload it. Make a small test transfer and verify the receiving address on the device screen.

Operational checklist
- Confirm the asset, network, address and memo before every transfer.
- Keep the device firmware and companion software current through the official channel.
- Maintain a second, secure backup of the recovery information where appropriate.
- Decide in advance who, if anyone, can access the assets if you become incapacitated.
- Separate trading funds from long-term holdings so a compromised exchange account does not expose everything.
Tax records and Australian reporting
Treasury states that tax implications depend on the asset’s underlying rights and obligations and on the investor’s personal circumstances. Spot disposals, swaps, transfers, staking-related activity and derivative settlements can require different analysis. A transfer between wallets you own is not automatically the same as a sale, but you need records that allow the transaction to be classified correctly.
Records to keep
- Date and time of each purchase, sale, swap, derivative opening and closing.
- Asset or contract description, quantity, price, currency and Australian-dollar value at the time.
- Spread, commission, funding, network, withdrawal and liquidation charges.
- Wallet addresses, transaction IDs and records showing transfers between your own wallets.
- Exchange statements, deposits, withdrawals, margin movements and realised profit or loss.
- Provider legal entity, account statements and copies of product terms that applied during the period.
Export data regularly rather than waiting for an exchange to provide an annual report. Keep the original files and a readable backup. Because the correct treatment is fact-specific, obtain qualified Australian tax advice for your circumstances instead of relying on a generic calculator or a platform label.
Scams and warning signs
ASIC MoneySmart reported that cryptocurrency-investment-scam takedowns increased by almost 30 per cent in FY26, with 3,106 scams removed. Common warning signs include guaranteed returns, pressure to deposit immediately, a “broker” who asks for remote access, demands for extra money to release a withdrawal and testimonials that cannot be independently verified.
Check an offer through the regulator’s registers using contact details you find independently. Do not send crypto to an address supplied in a social-media message, and remember that blockchain transfers generally cannot be reversed by a bank. If you have shared credentials or a recovery phrase, move remaining assets to a newly secured wallet, contact the platform through its official channel and report the incident promptly.
Choosing between spot and derivatives
Spot may fit when you need
- Direct ownership and the ability to withdraw the asset.
- No automatic leverage or contract expiry.
- A long-term position where you can tolerate a complete loss without borrowing.
- A custody plan that you can operate safely.
A derivative may be considered only when you understand
- The contract’s reference price, settlement method, expiry or funding schedule.
- Initial and maintenance margin, liquidation triggers and possible losses beyond the deposit.
- The provider’s licence, jurisdiction, collateral arrangements and dispute pathway.
- How volatility, overnight gaps and outages affect execution.
Neither structure is suitable merely because an advertisement promises quick profits. If you cannot explain what happens after a 20 per cent price move, how much funding is charged over a week or where a complaint goes, do not open the position.

A decision process for an Australian retail trader
- Name the exposure. Write “I own the asset” or “I hold a contract referencing the asset.” If the terms do not make this clear, ask the provider before depositing.
- Set a loss limit. Use only money you can afford to lose and avoid borrowing to buy spot or meet derivative margin.
- Model the costs. Calculate spread, commission, deposit, withdrawal, network, funding, financing and liquidation charges for your planned holding period.
- Verify authorisation. Check ASIC authorisation for the exact financial product and AUSTRAC registration separately where relevant.
- Check recourse. Confirm internal and external dispute schemes, client-money treatment, custody and the provider’s country of operation.
- Secure the account. Enable strong authentication, test deposits and withdrawals and separate active trading funds from long-term holdings.
- Prepare records. Export statements and transaction data after each trading period and retain wallet and contract evidence.
- Review regularly. Recheck licensing, fees, product terms and your custody arrangements because they can change.
Bottom-line choice
For an Australian reader deciding between the two structures, spot is usually easier to understand because it represents ownership and does not inherently impose leverage or liquidation. It still carries severe market, custody, scam and platform risks. Derivatives are contracts designed for price exposure and can be useful only for people who understand margin, funding, liquidation and the provider’s legal obligations. The decisive questions are not “Which one is safer?” but “What exactly do I hold, how can I lose money, what will it cost, and which Australian protections actually apply?”
