Criminal recruiters can reach a legitimate business in two different ways: they may place exploited workers in its labor supply chain, or they may lure job seekers into criminal operations with fake offers. These risks are related, but they are not the same. Labor trafficking involves coercion to compel labor; forced criminality involves coercing a person to commit crimes; and organised labour fraud concerns tax and payroll evasion. Each calls for a different response.
How criminal recruitment can affect a legitimate business
A worker on a company’s payroll may have been recruited through a broker or subcontractor, not directly by the business. That can obscure who set the terms, charged fees, controls wages, or holds identity documents. A legitimate workplace can therefore be part of a labor chain in which workers are exploited, even if the employer did not recruit them directly.

The title also describes a separate danger to job seekers: a fraudulent offer can lead a person into a criminal operation, including a cyber-scam operation. A role that sounds ordinary or skilled does not rule this out. In some cases, the person recruited may be a victim compelled to commit crimes.
Three distinct risks, and why the difference matters
| Risk | What it means | What to watch for |
|---|---|---|
| Labor trafficking | Force, fraud, or coercion used to compel labor and prevent a person from leaving. | Recruitment debt tied to withheld or controlled wages, restricted movement, unusual living conditions, confiscated identity documents, or workplace injuries. The U.S. Department of Labor describes these as possible indicators, not proof by themselves. U.S. Department of Labor guidance. |
| Trafficking for forced criminality | A person is compelled to commit crimes, for example in a cyber-scam operation. | Social-media-only recruitment without an official listing, pressure to decide quickly, vague duties or implausibly high pay, no contract before departure, blocked access to company HR, or controlled dormitory living. OSCE guidance. |
| Organised labour fraud | Criminals arrange labor supply chains to evade VAT, Income Tax, and National Insurance contributions, as described by HM Revenue & Customs in the UK. | Workers may also face consequences for employment rights and benefits. This is a tax and payroll fraud risk; it is not automatically trafficking. HMRC guidance, published 10 June 2026. |
Labor violations or a deceptive offer alone do not establish trafficking. The relevant coercive circumstances must be assessed, and warning signs should prompt careful inquiry rather than a conclusion about a person or employer.

What employers should check across the labor chain
Map every party involved in recruiting and supplying workers, including labor brokers and subcontractors. A direct-hire check is not enough if another business recruited the worker or arranged housing and transport.
- Recruiter identity: establish the legal identity of each recruiter and intermediary, and check licensing or registration where local rules require it.
- Terms workers can understand: provide clear written information on duties, work location, schedule, pay, supervisor, housing, and costs in a language workers understand. Check that the actual conditions match what was promised.
- Fees and deductions: ask who paid recruitment and related costs, and investigate unexplained deductions or debts. The ILO’s fair-recruitment guidance says: “No recruitment fees or related costs should be charged to, or otherwise borne by, workers or jobseekers.” ILO fair-recruitment principles.
- Documents and freedom: workers should retain access to their identity documents and be free to leave or change employer. Check whether a recruiter, employer, or housing provider controls documents, movement, or communication.
- Grievances and access: make safe grievance channels available and confirm workers can use them without needing a recruiter’s permission or being isolated from the employer.
- Warning signs: examine recruitment debt, wage withholding, pressure from recruiters, unusual housing conditions, injuries, or restrictions on movement. Treat these as leads for a careful, safe inquiry, not proof on their own.
Legal duties depend on jurisdiction, industry, and contract. In the specific U.S. federal contracting context, the FAR trafficking-in-persons clause prohibits covered contractors from charging recruitment fees, using specified misleading recruitment practices, or confiscating identity documents; it also requires written job information in applicable circumstances. It is not a universal rule for every employer. FAR clause text at Acquisition.gov.

How job seekers can check an offer before accepting
- Verify the employer independently. Find the company through a source separate from the recruiter’s message, and confirm that the named recruiter is authorized to hire for it. U.S. job seekers can also consult the EEOC’s safety guidance.
- Get specific terms in writing. Ask what the work is, where and when it will be done, who supervises it, how much and when you will be paid, and what costs apply.
- Read the contract before travel. Do not rely on a promise to provide a contract after arrival. Check that the written duties, location, pay, housing, and costs match the offer.
- Do not pay recruitment fees or surrender identity documents. Keep control of your passport and other identity documents, and protect personal and financial information.
- Tell someone you trust. Share details of an in-person meeting or travel plan with a trusted person. Be wary if the recruiter rushes you, blocks contact with the employer’s HR team, gives vague duties, or bundles travel with employer-controlled housing.
The EEOC steps are U.S. public guidance; job seekers elsewhere should consult local labor and trafficking authorities. Fair-recruitment principles from the ILO provide international guidance, but they do not replace local legal advice.

What to do when warning signs appear
For an employer, preserve relevant contracts, pay records, and communications; speak with workers through a safe channel that does not depend on the recruiter; and review the chain for fees, debt, document control, wage deductions, and movement restrictions. Do not treat an indicator as a verdict. Where coercion or immediate danger may be involved, seek help from appropriate local labor, trafficking, or law-enforcement authorities, or a specialist support organization.

For a job seeker who has not accepted an offer, pause before sending money, documents, or travel details, and verify the employer independently. If someone is already in a controlled or unsafe situation, prioritize immediate safety and contact local emergency services or a trafficking support organization where safe to do so.
