A credit-card charge-off is an accounting step after serious delinquency, not forgiveness of the balance. A creditor commonly charges off an account after about four to six months of missed minimum payments, but the exact policy depends on the account and creditor. The debt can still be collected, sold, settled, or sued on if the applicable state deadline has not expired.
Three clocks matter: the charge-off and collection timeline, the state statute of limitations for a lawsuit, and the federal credit-reporting period. They do not start or end at the same time. Accurate negative information generally can remain on a credit report for seven years, while a lawsuit deadline is set by state law and often falls somewhere between three and six years.

What a credit-card charge-off means
A charge-off records a seriously delinquent account as a loss on the creditor’s books. It does not cancel the contract, transfer ownership automatically, or make the balance disappear. The original card issuer may continue internal collection, hire a collection agency, assign the account, or sell it to a debt buyer, subject to applicable consumer-protection laws.

The Federal Trade Commission describes four to six months of missed minimum payments as a common point at which a creditor charges off a credit-card account. That is a general practice, not a guaranteed deadline: the account agreement, creditor policy, payment history, and applicable rules can change the timing. Interest, fees, or other amounts may also be governed by the contract and state law.

What happens from the first missed payment onward?
| Stage | What usually happens | Important qualification |
|---|---|---|
| Missed payment | The account becomes delinquent and may incur late fees or other contract charges. | The account’s terms and applicable law control the amounts and notices. |
| Several months delinquent | The creditor may restrict or close the account and pursue internal collection. | Policies differ by issuer; there is no universal charge-off month. |
| About four to six months of missed minimums | A charge-off commonly occurs and the balance may be assigned or sold for collection. | The FTC describes this as common, not mandatory in every case. |
| Third-party collection contact | A covered debt collector generally sends a validation notice identifying the amount and creditor. | The federal Fair Debt Collection Practices Act (FDCPA) gives a 30-day written-dispute period. |
| Credit reporting | The negative account history can continue to appear for the federal reporting period. | The seven-year calculation uses the delinquency and a 180-day rule, not the later collection date. |
How long does a charge-off stay on a credit report?
Under the Fair Credit Reporting Act (FCRA), most accurate negative information can generally be reported for seven years. For an account placed for collection or charged off, FCRA section 605(c) ties that period to the commencement of the delinquency that immediately preceded the collection or charge-off, with a 180-day period following that delinquency built into the calculation. The date a collector later calls, buys the account, or reports a new balance does not create a fresh seven-year period.
Because the calculation depends on the account’s actual payment history, keep statements and notices showing the first missed payment that led to the charge-off. A collector cannot lawfully “restart” the federal reporting period simply by changing the account’s ownership or collection status. If the dates on a report appear inconsistent, dispute the inaccurate information with each reporting company showing the error and with the furnisher that supplied it.
What payment changes on the report
Paying in full or settling can cause the status or balance to be updated, but it does not automatically delete accurate charge-off history. The account may be shown as paid or settled while the reporting period continues. The FTC warns that paying an old debt may not erase it from credit history, and the Consumer Financial Protection Bureau (CFPB) says accurate negative information cannot be removed merely because a company promises “credit repair.”

What must a debt collector tell you?
When a third-party debt collector first communicates about the account, the FDCPA’s validation notice generally must state the amount claimed, identify the creditor, and explain your right to dispute the debt in writing within 30 days. Read the notice before making a payment or agreeing to a plan; the name of the collector may differ from the original card issuer.
How to dispute a debt or amount
- Check the deadline. Send the dispute within the 30-day validation period stated in the notice if you contest the amount, ownership, account identity, or supporting records.
- State the specific problem. Explain whether the balance is wrong, the account is not yours, payments are missing, or the collector has not shown that it owns or is authorized to collect.
- Request verification. Ask for information sufficient to verify the disputed amount and creditor. Keep the request focused on the disputed debt.
- Use a trackable method. Keep a complete copy and proof of delivery, such as certified-mail records or an electronic submission confirmation.
- Watch for the response. A timely written dispute generally requires the collector to obtain verification before continuing collection of the disputed amount.
A dispute does not itself decide whether the debt is valid, erase a lawful balance, or stop every form of reporting. It creates a process for correcting or substantiating the disputed information. Continue preserving statements, correspondence, and payment records.
Can a creditor or collector sue after a charge-off?
Yes, a charge-off does not by itself bar a lawsuit. Whether suit is still possible depends on the governing state statute of limitations, the contract’s choice-of-law terms, the date of default, later payments or written acknowledgments, and procedural facts. The CFPB notes that many states use limitation periods in the three-to-six-year range, but that range is not a deadline for every account.

How to determine whether a lawsuit is time-barred
- Identify the state whose law governs the claim. The consumer’s current state, the state named in the contract, and special rules for the type of agreement can matter.
- Find the date of the default or last required payment under that state’s rule. Do not assume the charge-off date is the start date.
- Check whether a payment or written acknowledgment can revive or restart the period. Some states allow one or both actions to extend the time for suit.
- Confirm whether the collector complied with state licensing, notice, and pleading requirements.
- Obtain legal advice before responding if the amount is large, the dates are disputed, or a complaint has been filed.
A time-barred debt may still be voluntarily collected in many states, but a collector generally cannot sue or threaten suit after the applicable limitation period. If you are served with a lawsuit, attend the hearing or file the required response and raise the statute-of-limitations defense. Courts can enter judgment when a defendant does not appear, even if the claim would have been defensible.

No single option is correct for every charged-off account. Compare the legal risk, total cost, reporting outcome, documentation, and tax consequences before sending money.
| Option | When it may fit | What it does not guarantee |
|---|---|---|
| Pay in full | You can afford the verified balance and want the account resolved without negotiating a reduced amount. | It does not automatically remove accurate history or end the seven-year reporting period. |
| Settle for less | The collector has authority to settle, the amount is affordable, and the agreement is documented. | It may be reported as settled or not paid in full and may create taxable canceled-debt income. |
| Dispute | The amount, ownership, identity, or records are inaccurate and you are within the validation process or correcting reporting errors. | A dispute does not guarantee deletion or eliminate a valid debt. |
| Wait and seek advice | The debt may be old, the limitation period is uncertain, or payment could revive a claim under state law. | Waiting does not stop collection calls in every situation and does not erase accurate reporting before its lawful expiration. |
Before choosing, answer six questions: Is a lawsuit still legally possible in the governing state? What will you pay in total, including fees and possible taxes? How will the furnisher report the result? Can the balance and ownership be verified? Do you have enforceable written terms? Do the facts justify legal or tax advice?

How to negotiate and document a settlement
- Verify the claimant. Match the account number, original creditor, balance, and collector’s authority to your records and the validation notice.
- Ask for written terms first. The agreement should identify the account, state the exact payment or payment schedule, say that it satisfies the entire account, and state that no remaining balance will be pursued after timely payment.
- Clarify reporting. Ask how the furnisher will describe the account, but do not assume it will delete accurate history. A promise to remove accurate information may be unenforceable or inconsistent with reporting rules.
- Sign and retain the agreement. Keep the signed document, payment confirmations, account statements, and every related message.
- Check the update. After payment, review the account at the reporting companies and dispute any inaccurate balance, status, or dates.
Do not rely on a telephone promise that is not reflected in the written agreement. If the collector will not identify the debt or refuses to state whether the payment resolves the account, pause and obtain advice before paying.
Could canceled debt create a tax bill?
The Internal Revenue Service identifies cancellation or extinguishment of debt as a possible Form 1099-C event. A settlement that eliminates part of the balance can therefore raise an income-tax question. Whether the canceled amount is taxable depends on facts and exceptions, including circumstances that are not evident from the collection letter. Keep the settlement agreement and any tax form, and consult a tax professional for a large, complicated, or financially significant settlement.
How to correct a charge-off or collection entry
Accurate negative information generally cannot be removed just because you paid a company offering credit-repair services. You can, however, dispute information that is inaccurate, incomplete, duplicated, or attached to the wrong person.
Best Value
- Obtain reports from each reporting company and identify the exact account, balance, status, and dates that are wrong.
- Gather account statements, canceled checks, settlement documents, identity-theft records, or other evidence supporting the correction.
- File a clear dispute with the reporting company and separately with the furnisher, describing each error and attaching copies rather than originals.
- Keep submission and delivery proof, then review the investigation result and updated report.
- If the information remains wrong, add evidence in a follow-up dispute and consider a consumer-law attorney or regulator complaint.
A correct update may change the account to paid, settled, or zero balance while leaving the historical charge-off visible until the lawful reporting period ends. The goal of a dispute is accurate reporting, not guaranteed deletion.
Practical examples
A recent charge-off with a new collector
You receive a validation notice months after the account was charged off. Compare the stated balance with your statements, send a written dispute within 30 days if anything is wrong, and request verification before negotiating. Do not make a token payment until you understand whether your state treats a payment as reviving the lawsuit period.
An old debt with an uncertain date
The collector says the account is several years old, but the report shows different delinquency dates. Obtain the original payment history, determine the governing state law, and get legal advice before acknowledging the debt or paying. The reporting clock and lawsuit clock are separate; an old report entry does not prove that a lawsuit is barred, and a time-barred lawsuit does not require immediate deletion of accurate reporting.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesA settlement already paid
Keep the signed settlement and proof of payment. Check that the account shows the agreed balance and status. If a remaining balance appears despite a full-settlement clause, dispute the reporting and send the collector the agreement. Also watch for a Form 1099-C and ask a tax professional how the transaction applies to your circumstances.
Quick Recap
Key takeaways
- Charge-off is an accounting treatment after serious delinquency, not cancellation of the debt.
- Four to six months is a common FTC-described charge-off timeframe, but creditor policies differ.
- Accurate negative information generally remains up to seven years under the FCRA calculation, including its 180-day rule.
- A collector’s validation notice gives 30 days to dispute in writing; timely disputes require verification before continued collection of the disputed amount.
- Lawsuit deadlines are state-specific, often three to six years in many states, and payments or written acknowledgments can affect them.
- Get settlement terms in writing, preserve proof, and consider possible Form 1099-C tax consequences.
