A district attorney is generally the public prosecutor who represents the state in criminal cases, while a county attorney may prosecute certain offenses, represent county government in civil matters, advise county officials, or perform a combination of those jobs. State statutes, a county charter, and court rules—not the job title alone—determine who has authority.
That is why a county attorney can prosecute misdemeanors in one state yet serve mainly as civil counsel in another. The safest way to identify the correct office for a live matter is to check the current law and the official offices for the county and court involved.

The difference at a glance
Both offices are government law offices, but they may represent different governmental clients, appear in different courts, and handle different kinds of cases. The table below describes the usual pattern and the limits of that generalization.
| Question | District attorney | County attorney | Why the distinction matters |
|---|---|---|---|
| Primary client | Usually the state or the public in criminal prosecutions | May represent the county government, the state in lower-level criminal cases, or both | The office’s legal client determines whose interests it may advance |
| Main work | Charging and trying criminal cases, appeals, grand-jury work, and related prosecution duties | May prosecute crimes, advise county officials, draft or review contracts, collect debts, or defend the county in civil litigation | “County attorney” is not a nationally standardized assignment |
| Typical court connection | Often a designated criminal trial court, such as a district or county court, depending on state law | May handle other trial courts, lower-level offenses, or county civil proceedings | The offense level and court can decide which office has authority |
| Geographic reach | A prosecutorial district, county, or group of counties defined by state law | Usually one county, although duties can be shared or assigned differently by statute or charter | Boundaries do not follow one national model |
| Investigation | May direct or request further investigation; police and other agencies usually conduct the underlying investigation | May assist with investigations when prosecuting, but generally does not replace law-enforcement agencies | Prosecutorial authority is different from police authority |
| Appointment and funding | Election, appointment, terms, and budgets vary by state | Election, appointment, supervision, and county funding vary by state and county | Local administrative rules can affect how an office operates |
These are functional descriptions, not universal definitions. A state may use “district attorney” for a prosecutor whose territory is one county, while another state may assign a district attorney responsibility for several counties. A county attorney may be a criminal prosecutor, a civil lawyer for the county, or both.

Why the titles do not have one national meaning
Prosecutor titles are created and defined by state constitutions, statutes, court rules, and sometimes county charters. Those legal instruments answer questions that a title cannot answer by itself:
- Which court levels the office serves.
- Whether the office represents the state, the county, or both.
- Which crimes and infractions the office may charge and try.
- Whether civil lawsuits involving the county belong to a county counsel, county attorney, or another government lawyer.
- Who may participate in grand-jury proceedings and criminal appeals.
- How the office is elected or appointed, supervised, and funded.
For example, Texas assigns district-court criminal cases to district attorneys and other trial-court criminal cases to county attorneys. In a California general-law county with a county counsel, the county counsel generally handles the county’s civil legal work while the district attorney remains the public prosecutor. Nevada law gives the district attorney both public-prosecutor functions and specified county civil and debt-recovery duties. These arrangements are all lawful, but they are not interchangeable.
What a district attorney usually does
Represents the public in criminal cases
A district attorney generally represents the state in criminal prosecutions. The office reviews referrals from law enforcement, decides whether charges are legally and ethically supportable, files or presents charging documents, and litigates the case through trial or another lawful resolution. The office may recommend a sentence, subject to statutory requirements, court authority, and professional duties.
Cornell’s Legal Information Institute describes a state’s attorney in general terms as presenting criminal cases, directing further investigation, deciding charges, recommending sentences, and participating in grand-jury proceedings. That description is a starting point only; the local statute controls the actual assignment.
Controls charging and plea decisions within legal limits
Police may investigate and submit a case, but a prosecutor decides whether the available evidence and applicable law justify a charge. A district attorney may decline a referral, file a different charge, seek additional evidence, negotiate a plea, or take a case to trial. Those decisions are constrained by constitutional rights, discovery obligations, statutes of limitation, evidentiary rules, victims’ rights laws, and professional-conduct rules.
Handles court proceedings and appeals
The office appears for the state at arraignments, hearings, trials, sentencing, and other criminal proceedings assigned to it. In some jurisdictions, the same office handles appeals from those cases. Texas Code of Criminal Procedure article 2A.102(a), for example, states that each district attorney represents the state in all criminal cases in the district courts of the attorney’s district and in appeals from those cases. The same provision also addresses certain examining-court and habeas proceedings.

Participates in grand-jury and investigative work
A district attorney may present evidence to a grand jury, advise investigators about warrants or charging options, and request additional investigation. That does not make the prosecutor the police department. Law-enforcement agencies normally gather evidence, interview witnesses, make arrests, and preserve physical evidence; the prosecutor evaluates and uses that evidence in a legally proper case.

Texas Code of Criminal Procedure article 2A.101(a) states: “The primary duty of an attorney representing the state, including a special prosecutor, is not to convict but to see that justice is done.” Comparable ethical principles apply elsewhere even when the statutory wording differs. A prosecutor must disclose exculpatory information, avoid charging unsupported claims, correct material errors, and protect the fairness of the proceeding.
What a county attorney may do
Criminal prosecution in a Texas-style system
Texas demonstrates why it is unsafe to assume that a county attorney is only civil counsel. Article 2A.103(a) provides that each county attorney attends the terms of court for trial courts other than district courts in the county and represents the state in all criminal cases under examination or prosecution there. In that structure, the county attorney can be a criminal prosecutor, while the district attorney handles district-court criminal cases.
The practical result is that the felony-versus-misdemeanor question cannot be answered from the title alone. A Texas county attorney’s criminal jurisdiction follows the courts and proceedings assigned by statute, not a universal rule that applies in every state.
Civil counsel for county government
In other jurisdictions, a county attorney primarily advises the county as a governmental entity. The work can include reviewing contracts, advising elected boards and departments, handling public-records or employment questions, drafting ordinances, and prosecuting or defending civil actions involving county property or operations. Some states call this office county counsel rather than county attorney.

California Attorney General Opinion No. 81-117 explains that, in a general-law county with a county counsel, the district attorney has no authority to perform duties that the law assigns to county counsel, while the district attorney remains the public prosecutor. Charter counties may organize these responsibilities differently.

Mixed criminal and civil assignments
Some county attorneys perform both functions. Nevada’s Chapter 252, for example, describes the district attorney as the county’s public prosecutor while also listing duties such as drawing indictments, defending suits brought against the county, and recovering county debts, fines, penalties, and forfeitures. Elsewhere, those civil tasks may belong to a separate county counsel or county civil division.
Advises county officials but does not become their personal lawyer
When a county attorney represents the county, the client is the governmental entity or an authorized county body—not every individual employee or elected official personally. Conflicts, privilege, public-meeting laws, and open-records requirements can affect the advice. An official who needs personal legal advice may need separate counsel.
Criminal and civil authority are different questions
“Who prosecutes?” and “Who represents the county in a lawsuit?” may have completely different answers. Use the following map to separate the issues.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors| Situation | Likely office to investigate first | What must be verified |
|---|---|---|
| State criminal offense | District attorney, county attorney, or another statutory prosecutor | The charging statute, prosecutorial district, and court level |
| County sued over a contract, injury, land, or employment dispute | County counsel or county attorney in a civil role | The county charter, state law, and any assigned outside counsel |
| County seeking to recover fines, penalties, or debts | County attorney, district attorney, county counsel, or another collection office | The statute creating the debt and the office’s delegated authority |
| Appeal from a criminal conviction | The prosecutor assigned to the trial court or the state appellate office | Appellate jurisdiction and filing deadlines |
| Police misconduct or a complaint about an investigation | The agency’s internal process, an inspector general, civil-rights authority, or prosecutor where authorized | Whether the prosecutor has an independent conflict and whether a different agency must investigate |
A prosecutor can decide whether to bring a criminal case, but cannot order a judge to convict, impose a sentence outside the law, or provide legal representation to a criminal defendant. A county civil lawyer can advise the county, but cannot privately represent a resident merely because the resident’s dispute involves county government.
Which office handles misdemeanors and felonies?
There is no nationwide misdemeanor-versus-felony rule. The decisive factors may include the court in which the case is filed, the maximum authorized sentence, the subject matter, and a statute assigning prosecution to a particular office.
Texas supplies a clear example. Article 2A.102(a) assigns district-court criminal cases and appeals to district attorneys. Article 2A.103(a) assigns criminal cases in other trial courts, including cases under examination or prosecution in the county, to county attorneys. A reader in another state should not transfer that division to their own county.

In New York, County Law §700 says the district attorney conducts prosecutions for crimes and offenses cognizable by the county courts and performs related duties prescribed by law. The phrase “cognizable by the county courts” ties the assignment to the court structure rather than to a simple felony label.
North Carolina uses prosecutorial districts. Under §7A-61, the district attorney prepares trial dockets, prosecutes criminal actions and infractions in the prosecutorial district, advises justice officers, and represents the state in specified juvenile cases. The statute also requires full-time service and prohibits private practice. A county in that system may not have a separately empowered county attorney for criminal prosecution.
Is a district attorney a county official or a state official?
The answer depends on the legal function being discussed. A district attorney usually represents the state in court, but the office may be elected by voters in a county or prosecutorial district, funded partly through local government, and limited to a defined geographic area. That combination makes the office locally based while its courtroom client is the state.
Election method, appointment authority, term length, removal procedures, staffing, and budget rules differ across jurisdictions. Do not infer an office’s independence or reporting line from the fact that its name includes “district” or “county.” Read the enabling statute and any county charter provisions.

Start with the type of action you want, not the title you remember.
- Immediate danger or an active crime: contact the appropriate emergency or law-enforcement service first. A prosecutor’s office is not a substitute for emergency dispatch.
- Request for criminal charges: report the facts and evidence to the investigating agency and ask which prosecutor handles that court and offense in your jurisdiction. Prosecutors generally cannot open a case without a lawful referral or sufficient admissible evidence.
- County contract, property, employment, or tort dispute: identify the county’s civil counsel or county attorney and follow any claim-presentation deadline. Sending a criminal complaint to a civil office does not begin a civil lawsuit.
- Concern about a prosecutor’s conflict or decision: ask the office about its written procedure, then check state law for special-prosecutor, ethics, appellate, or supervisory remedies. A private citizen ordinarily cannot force a prosecutor to file a charge.
- Pending criminal case: communicate through the assigned prosecutor’s victim-services or court process and observe filing, hearing, and appeal deadlines. Do not send confidential defense information to the opposing prosecution office.
How to verify the correct office in your jurisdiction
Use this checklist before relying on a title shown on a website, letterhead, or social-media post.
Best Value
- Identify the exact location: state, county, municipality, and—if known—the court where the matter is pending.
- Classify the matter: criminal prosecution, civil claim against the county, county contract or advice, debt recovery, juvenile case, appeal, or records request.
- Read the current state code: search for the statutory sections defining the district attorney, county attorney, county counsel, public prosecutor, and relevant court.
- Check the county charter and ordinances: charter counties can assign civil and administrative duties differently from general-law counties.
- Confirm court jurisdiction: the court’s subject-matter jurisdiction may determine which prosecutor appears, especially where trial courts are divided by level.
- Use the official office directory: confirm the current filing address, intake method, victim-services contact, and records procedure.
- Ask the clerk or civil-claims office about procedure: clerks can identify forms, filing locations, and deadlines, but generally cannot give legal advice.
- Protect evidence and deadlines: preserve original documents, note report numbers, and calendar limitation, notice, claim-presentation, and appeal dates.
For a live dispute, a licensed lawyer in the relevant jurisdiction can interpret the statutes and conflicts rules. An online description of an office is not a substitute for current local law.
State examples that show the range
Texas
Texas Code of Criminal Procedure article 2A.102(a) assigns district-court criminal cases and appeals to the district attorney. Article 2A.103(a) assigns the county attorney to trial courts other than district courts and to criminal cases under examination or prosecution in the county. Article 2A.101(a) states the justice-centered duty of attorneys representing the state. Texas therefore shows a county attorney operating as a criminal prosecutor rather than merely as county civil counsel.
New York
New York County Law §700 defines the district attorney’s role as conducting prosecutions for crimes and offenses cognizable by the county courts and performing related legal duties. The court-based wording means that the scope must be read with New York’s court structure and other statutes.
North Carolina
North Carolina General Statutes §7A-61 gives the district attorney responsibility for trial dockets, criminal actions and infractions in the prosecutorial district, advice to justice officers, and specified juvenile matters. It also requires full-time service and bars private practice, illustrating how a statute can define both substantive duties and professional restrictions.
Nevada
Nevada Revised Statutes Chapter 252 identifies the district attorney as the county’s public prosecutor and includes duties involving indictments, defense of suits against the county, and recovery of county debts, fines, penalties, and forfeitures. Nevada demonstrates that a district attorney may have expressly stated civil responsibilities in addition to criminal prosecution.
California
California Attorney General Opinion No. 81-117 distinguishes the district attorney’s public-prosecutor role from county counsel’s civil responsibilities in general-law counties. Charter-county arrangements can differ, so a California reader must check the county’s charter and current office assignments rather than assuming every county has the same structure.
Common mistakes to avoid
- Assuming every county attorney is civil counsel: Texas and other jurisdictions may give the office criminal authority.
- Assuming every district attorney prosecutes every offense: court-level assignments can divide responsibility among prosecutors.
- Confusing prosecution with investigation: a prosecutor may direct or request investigative steps, but police or another agency normally gathers the evidence.
- Confusing prosecution with adjudication: judges decide motions, guilt, and lawful sentences; prosecutors advocate for the state.
- Treating a prosecutor as personal counsel: a public prosecutor represents the state, and county counsel represents the county entity, not an individual resident or employee.
- Relying on an outdated web page: statutes, charters, office names, and filing procedures can change.
- Ignoring conflicts: when a county or prosecutor is a party, special counsel or another office may be required.
Bottom line
A district attorney is usually the public criminal prosecutor, while a county attorney is a variable office that may prosecute lower-level or court-specific crimes, represent county government in civil matters, or do both. The reliable comparison is not the title; it is the governing law, the court, the geographic district, and the governmental client. Before filing, reporting, or directing a complaint, verify those four points in the current state code, county charter, court rules, and official office instructions.
