Could the U.S. Ban Artificial Superintelligence? Legal and Technical Challenges Explained

Yes, Congress could attempt to prohibit defined forms of artificial superintelligence (ASI), but the United States has not enacted a comprehensive federal ASI ban. A workable prohibition would have to define what counts as superintelligence, identify which development or deployment activities are illegal, create measurable tests, and establish evidence, enforcement, jurisdiction and due-process rules.

A September 23, 2026 Associated Press report described a Sanders–Casar proposal that would permanently prohibit ASI, pause some advanced-AI development, create a Department of Artificial Intelligence and require federal approval before deployment. That account describes a proposal, not enacted law; the bill number and subsequent congressional status are not established here.

What the U.S. legal position is today

Congress has the constitutional authority to legislate in areas connected to interstate commerce, national security and federal agencies, so it could write a statute prohibiting specified AI systems or activities. That authority would still be limited by constitutional requirements, statutory jurisdiction and practical enforceability.

The Congressional Research Service (CRS) describes federal AI governance as a combination of existing agency powers, targeted legislation and voluntary commitments rather than a single, comprehensive AI-development or AI-use prohibition. Its account does not identify a federal law that bans ASI.

A proposal is not a prohibition

The AP report published September 23, 2026 says Senators Bernie Sanders and Representative Alexandria Ocasio-Cortez’s colleague Greg Casar unveiled legislation aimed at permanently prohibiting ASI and temporarily pausing development of the most advanced AI systems until federal safety rules are established. The report also describes a proposed Department of Artificial Intelligence, federal approval before advanced systems could be deployed and penalties that could reach 20 years in prison for some violations.

Those are reported terms of a proposal. The available account does not establish a bill number, formal introduction, committee referral, enacted text or later congressional action. Treating the proposal as current law would be inaccurate.

What “artificial superintelligence” would mean in a law

The first obstacle is definitional. CRS says the U.S. government has no official definition of AI. In its emerging-technologies discussion, it describes ASI as a system that could exceed human-level cognition across most tasks, while noting that AGI and ASI do not yet—and may never—exist.

No single official capability threshold

A statute cannot enforce a label alone. It would need a threshold that investigators, developers and courts can apply to a real system. “Exceeds human cognitive ability” could refer to test scores, performance in economically important tasks, scientific discovery, cyber operations, autonomy, speed, reliability or some combination. “Across most tasks” is broader than excelling at a narrow benchmark.

The threshold would also need rules for uncertainty. A model may perform above human averages in one domain and below experts in another. Results can change with prompting, retrieval systems, software tools, additional compute, fine-tuning or a human operator. A law would have to say whether the relevant object is the base model, the complete system offered to users, a coordinated collection of models or an updated version after release.

The reported proposal uses a different formulation

According to AP, the proposed ban would cover a system that exceeds human cognitive ability or has enough capability to plan and execute the destruction or disempowerment of humanity. That formulation is not interchangeable with CRS’s description of ASI as superior cognition across most tasks. The difference matters: one test may capture broad intellectual performance, while the other may focus on a dangerous capability or outcome.

Legislators would need to specify whether both conditions are independent triggers, how “humanity” and “disempowerment” are interpreted, and what evidence proves that a system can plan and execute such conduct. Without those details, regulated parties could face uncertainty about which research or product changes cross the line.

What a federal ban could cover

A prohibition can target different points in the AI lifecycle. Each choice changes what the government can observe and what conduct remains outside the statute.

Control point What it could prohibit or require What it would not automatically stop
Development or training Building, training or materially improving a system above a statutory capability threshold Foreign development, earlier models, or later use of systems created outside U.S. jurisdiction
Release or publication Making model weights, code, documentation or a service available to others Private development, copies already distributed, or overseas publication
Deployment Operating a covered system for customers, government agencies or high-risk tasks without approval Unapproved development that never reaches a regulated deployment channel
Export and assistance Transferring specified models, hardware, services or technical support across borders Every form of foreign research or activity that has no covered U.S. connection
Infrastructure and inputs Providing cloud capacity, specialized hardware, data or other services for a covered run Untracked or foreign infrastructure and activity below reporting thresholds

A statute could combine these approaches. For example, it might prohibit domestic development above a capability level, require approval for deployment below that level in sensitive sectors, and impose reporting or export restrictions on compute and model transfers. Combining controls increases coverage but also increases compliance complexity and the number of definitions that must remain current.

Existing federal tools are narrower than an ASI ban

Executive Order 14409

Executive Order 14409, issued June 2, 2026, directs federal agencies to create classified benchmarking of advanced AI cyber capabilities and establishes a voluntary process for developers to engage with the government before releasing covered frontier models. The order expressly says it does not authorize mandatory government licensing, preclearance or permitting of AI model development, publication, release or distribution.

That makes the order a security and coordination measure, not a statutory prohibition on ASI. It directs agencies to act under existing law and available appropriations. A later Congress could enact mandatory requirements, but the executive order itself does not create them.

Export-control authority

Section 4817 of Title 50 of the United States Code establishes an interagency process for identifying emerging and foundational technologies considered essential to national security and for controlling exports of technologies that are identified. Export rules can restrict defined transfers, services or transactions under the applicable regulations.

Export controls are not equivalent to a blanket ban on domestic AI research or development. They may limit a particular transfer to a foreign person or destination while leaving lawful domestic experimentation untouched. They also do not, by themselves, establish that every overseas training effort can be detected or stopped.

How enforcement would have to work

1. A reproducible capability test

Agencies would need evaluation protocols that produce evidence a court can understand and a developer can anticipate. The law would have to identify approved tests, treatment of confidence intervals and false positives, testing frequency, independent validation and the effect of tools or human assistance.

Keeping the test current is another challenge. A benchmark can become obsolete as systems improve, and developers can optimize for a published test without acquiring the broader capability lawmakers intended to regulate. Delegating updates to an agency could provide flexibility, but the delegation would need clear standards and procedural safeguards.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Covered people, organizations and infrastructure

The statute would have to say whether it applies to companies, universities, individuals, government laboratories, contractors, cloud providers, chip suppliers or investors. It would also need rules for joint ventures, subsidiaries, contractors and users who combine multiple models into a larger system.

Cloud access and distributed training create evidentiary questions. A qualifying run may use rented capacity in several regions, different providers and multiple organizations. Reporting duties could require records of compute use, model checkpoints, data sources, safety evaluations and transfers. The available sources do not establish that any particular compute-monitoring system can reliably identify every qualifying run or prevent evasion.

3. Evidence, audits and due process

Enforcement would require more than a model’s reputation. Investigators might rely on training logs, hardware allocations, model evaluations, deployment records, contracts, communications or exported artifacts. A law should specify retention periods, audit authority, confidentiality protections and how classified information is handled.

Criminal penalties, especially the up-to-20-year penalties described by AP for some proposal violations, would make precise definitions and fair notice essential. Developers would need a way to challenge an agency determination, correct an erroneous classification and obtain judicial review. The statute would also have to distinguish intentional circumvention from an honest failure to predict a model’s capability after an update.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Open weights, code and technical knowledge

Once model weights, source code or detailed methods circulate, copies can be stored and modified outside the original developer’s control. A domestic law could still regulate domestic possession, services, transfers, deployment or assistance, but it would be harder to retract every copy or prevent independent work abroad.

That is a serious enforcement concern, not proof that a ban is categorically impossible. The practical reach would depend on the conduct covered and on whether the government can identify a U.S. person, service provider, transaction or other jurisdictional connection.

5. Jurisdiction and international cooperation

A U.S. statute would generally govern conduct within its legal reach, not every developer in the world. The AP account says the proposal contemplates international cooperation, while export-control law offers a mechanism for selected cross-border transfers. Neither fact establishes that international agreement is achievable or that unilateral controls would prevent all foreign development.

International coordination could align definitions, testing and restrictions, but it could also slow negotiations while capabilities change. A U.S. law might therefore combine domestic rules with diplomatic efforts, information sharing and controls on specific transfers rather than assume a global prohibition follows automatically from a U.S. statute.

Constitutional and legal questions lawmakers would face

Any prohibition would have to provide clear notice of forbidden conduct. A vague line between “advanced” and “superintelligent” systems could invite challenges if people cannot determine what is illegal before acting. The more severe the penalty, the more important precise statutory language, published rules and a review process become.

Congress would also need to connect each requirement to a valid federal power and define the limits of agency discretion. A licensing or approval system would need standards, timelines and appeal rights rather than an open-ended power to deny any model release. Requirements affecting publication of code, weights or scientific papers could raise speech and prior-restraint questions, depending on the conduct and the government’s justification. Those questions would be resolved through the statute’s exact wording and later court decisions; they cannot be answered by the label ASI alone.

Policy choices: ban, pause, approval or targeted controls

The major options differ in what they regulate and how much discretion they give agencies.

Option Primary trigger Potential advantage Principal difficulty
Permanent capability ban Development or operation above a defined ASI threshold Sets a bright policy boundary around the highest-risk systems Defining and updating the threshold; proving a violation
Temporary development pause Training or improving specified advanced systems until safety rules exist Creates time for standards and institutions Deciding which projects are covered and when the pause ends
Pre-deployment approval Release or operation of systems meeting risk criteria Creates a government checkpoint before public use Does not necessarily stop private development or foreign release; review capacity could become a bottleneck
Voluntary engagement Developer consultation and information sharing Lower legal and administrative burden; can begin quickly Participation is optional and may not reach actors who pose the greatest risk
Targeted export controls Specified transfers of models, hardware, software or services Uses an existing cross-border national-security tool Does not create a general domestic ban or govern all foreign work
Sector-specific rules Use in areas such as critical infrastructure, defense or public services Focuses restrictions where harms are most immediate Leaves other development and uses outside the rule

Safety, innovation and national-security trade-offs

CRS describes three broad positions in the policy debate. Advocates of broad rules argue that common requirements can reduce uncertainty and build public trust. Critics warn that additional regulation could slow innovation and weaken national security during international competition. A middle position favors targeted, flexible rules matched to particular technologies and uses.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Those trade-offs make the design more consequential than the word “ban.” A permanent prohibition might reduce the chance that a covered system is deployed, but it could also move development into less transparent jurisdictions or make U.S. researchers less able to evaluate systems created elsewhere. A pause could provide time for testing, but only if its scope, exemptions and end conditions are clear. Approval systems can create accountability while still allowing deployment, but they require qualified reviewers and predictable standards.

Do autonomous weapons prove that ASI can be banned?

No. CRS separately discusses lethal autonomous weapon systems (LAWS), not ASI. It reports that approximately 30 countries had called for a preemptive ban on LAWS, a figure that should not be presented as support for an ASI ban. The technologies, definitions and legal questions are different.

CRS also quotes then–Vice Chairman of the Joint Chiefs of Staff General Paul Selva, who said in 2017 Senate testimony: “I do not think it is reasonable for us to put robots in charge of whether or not we take a human life.” That statement concerns delegating lethal decisions and does not establish a position on superintelligence or the 2026 Sanders–Casar proposal.

What to watch as the issue develops

  • Whether the reported Sanders–Casar proposal receives a formal bill number, text, committee action or a revised definition.
  • Whether Congress creates an agency with authority to test, license or prohibit systems, and what appeal rights it provides.
  • Whether any rule targets development, deployment, release, export, infrastructure or a combination.
  • How lawmakers define capability, account for tool use and updates, and authorize benchmark changes.
  • Whether federal agencies publish reporting, audit and record-retention requirements for covered training runs.
  • Whether the United States coordinates definitions and controls with other governments.

Bottom line

The U.S. could legally attempt to ban artificial superintelligence, but a durable ban would depend on details that no current comprehensive federal law supplies: a measurable threshold, covered conduct and actors, evidence rules, agency authority, penalties, due process and a realistic jurisdictional strategy. The United States has no established comprehensive ASI prohibition in the sources considered here. Executive Order 14409 provides classified benchmarking and voluntary engagement, while export-control law addresses selected technology transfers. A domestic statute could constrain U.S.-connected development or deployment, yet it would not automatically control foreign research or every copy of an openly distributed system.
