Lawyer Roopesh Singh told RNZ the drugs would have been important evidence; he also said circumstantial evidence could be used. The court, not Singh, would assess the prosecution’s admissible evidence.
What happened to the cocaine exhibits?
RNZ reported on 2 October 2026 that cocaine exhibits held at the Suva High Court for the Rahman case had gone missing, and that forensic testing showed what was believed to be cocaine had been replaced with flour. The charge described by Fiji’s Court of Appeal involved 39.5 kilograms of cocaine found at Caubati. RNZ’s report put the estimated street value at about US$14 million; that is a reported estimate, not an official valuation.

Separately, FijiVillage reported on 29 September 2026 that police confirmed tests on the remaining exhibits returned negative for cocaine. It reported a value of FJ$31 million for the Rahman exhibits. Those figures come from different reports and currencies and should not be treated as interchangeable valuations. FijiVillage’s report
Why the physical evidence matters
Physical exhibits can help establish what a substance was and whether it was seized from, or found in the possession of, an accused person. RNZ quoted Singh, of Patel and Sharma Law Firm in Nadi, saying the drugs would have been important evidence to prove what was seized and found in the accused’s possession.

The reported substitution raises questions about the exhibits’ identity and custody. The available reports do not establish the precise missing quantity, how the substitution occurred, or who may have been responsible. Those details should not be inferred from the fact that flour was reportedly found in place of cocaine.
Could the case rely on other evidence?
Singh told RNZ that circumstantial evidence could be used and that the court would consider the evidence presented by the Office of the Director of Public Prosecutions. Whether any evidence can be admitted, and what weight it carries, depends on the applicable procedure and the court’s assessment.

His remarks are legal commentary, not a ruling on whether the prosecution can proceed or on Rahman’s guilt. The missing exhibits do not, by themselves, establish either outcome.
Where the proceedings stand
The Court of Appeal’s 12 February 2024 ruling described the charge as unlawful possession of 39.5 kilograms of cocaine found at Caubati. It records that Rahman appealed after his High Court conviction, and that the Court of Appeal quashed the conviction and ordered a retrial. Read the Court of Appeal ruling.

FijiVillage reported that the Supreme Court restored Rahman’s conviction and sentence on 28 August 2026. The Office of the Director of Public Prosecutions (ODPP), however, said in a September 2026 statement that proceedings remained ongoing and that it was aware of missing and potentially tampered exhibits. The ODPP’s position was also reported by FBC News. The primary Supreme Court judgment is not available in the sources cited here, so the reported August outcome and the ODPP’s later description of the proceedings should be kept distinct rather than reconciled by assumption.

The ODPP said destruction of exhibits is subject to legal process and that it had been preparing an application to destroy them after proceedings. It also said investigations into missing or potentially tampered exhibits should continue. That statement does not, on its own, identify who handled the exhibits or explain how they went missing.
