Associated Press reporting published October 1, 2026, summarizes a chronology in which a woman’s reported messages about an alleged encounter at Cornell’s Chi Phi fraternity house shifted over the following weeks, as rumors and a rape allegation circulated. The encounter and assault remain allegations: no criminal charges had been filed as of that report, and the investigation was then assigned to the New York Attorney General’s office as special prosecutor.

The chronology below is AP’s summary of records and statements described in a New York Times report. The messages and underlying records were not independently reviewed for this account, so quotations and descriptions are attributed to AP’s reporting.
October 19–20, 2024: An encounter and an initial account
AP reported that a party took place at Cornell’s Chi Phi fraternity house on October 19, 2024. The next day, the woman reportedly told roommates that she had taken ketamine and had sex with multiple men. According to AP, the roommates did not recall her describing the encounter as rape or assault at that point. One roommate reportedly said she did not remember the woman saying yes to anything that happened.
The apology and reply
A fraternity member reportedly texted an apology the following day, saying he regretted that he and another brother had been too intoxicated to stop events from getting out of hand. The woman reportedly replied that “at the end of the day non of the sexual stuff was illegal” and that she had liked being with the two men. Those are words attributed to the messages in the reporting, not a legal determination about what occurred.

October 23: A rape allegation circulates
By October 23, the woman was reportedly upset that word of the encounter had spread. She then saw a forum post asserting that Chi Phi brothers had gang raped a sophomore. AP’s account quotes her telling investigators: “That’s the first time I had ever heard the narrative change that I wasn’t a whore and that I was assaulted.”
November 3: A later message describes non-consent
On November 3, she reportedly texted one of the men: “let’s be clear that 90% of what happened that night was not consensual.” She also wrote, “I know that i told u i felt uncomfortable and i didn’t know anyone in the room.” The “90%” is the wording of the reported message, not a measured or independently verified figure.

What changed—and what the timeline does not establish
The reported sequence shows different descriptions at different times: an initial account to roommates that, as they recalled it, did not identify rape or assault; a reply saying the sexual activity was not illegal and that she had liked being with the men; and later statements describing the encounter as largely non-consensual and saying she felt uncomfortable. The forum post appears in the reported chronology before the October 23 statement about a changed narrative.
That sequence documents what the woman and roommates reportedly said, and when; by itself, it does not establish what happened during the encounter, whether she was able to consent, or why her characterization evolved. Those questions remain matters for the investigations and court proceedings, not conclusions that can be drawn from isolated messages.

Police report, lawsuit, and defendants’ response
AP reported that the woman went to Cornell campus police in November 2024. In September 2026, she sued seven men, Cornell University, Chi Phi, and others. The lawsuit alleges that she was plied with drugs and alcohol and subjected to sex acts while partially or entirely incapacitated. Lawyers for two men denied that their clients participated in a sexual assault, according to AP. A lawsuit states allegations; it is not a court finding.
Why the criminal investigation is active again
The initial criminal investigation was closed without charges in 2024. Tompkins County District Attorney Matthew Van Houten reopened it in late September 2026. On October 1, Gov. Kathy Hochul removed the matter from the local district attorney’s office and appointed the New York Attorney General’s office, led by Letitia James, as special prosecutor. Hochul said the attorney general could present evidence to a grand jury if warranted.

The district attorney’s explanation for the original decision
As AP reported it, Van Houten defended the original decision not to prosecute by saying the accuser’s first account to police did not allege that she had been drugged against her will, incapacitated beyond the ability to consent, or forced into sex. He also said he relied on a campus police officer’s written statement signed by the accuser and had not seen her detailed account. The underlying interview transcript was not reviewed for this article.

AP reported that Cornell indefinitely suspended Chi Phi. The university also conducted a months-long internal investigation that resulted in some students being disciplined or expelled, but did not disclose details, citing student privacy rules. Cornell agreed to bring in outside lawyers to independently investigate its handling of the allegations; AP’s October 1 report did not provide results of that external review.

Case status as of October 1, 2026
As of AP’s October 1 report, the state attorney general’s office had been assigned to investigate as special prosecutor. That assignment is not a criminal charge, grand-jury decision, or finding of guilt. The civil suit and investigations concern allegations that have not been resolved in a final legal finding.
