New York Gov. Kathy Hochul appointed the state attorney general’s office, led by Letitia James, as special prosecutor in the investigation of an alleged sexual assault at Cornell University. Announced October 1, 2026, the appointment shifts oversight of the case; it is not a finding that an assault occurred or that anyone is guilty.
Who is investigating the Cornell allegations now?
The New York Attorney General’s Office will investigate as special prosecutor. Hochul made the appointment by executive order, naming the office led by Attorney General Letitia James. The Associated Press reported that the office could present evidence to a grand jury if warranted; the appointment itself did not announce charges.

James said her office would take the responsibility seriously, adding: “Every New Yorker deserves to know that when they report a crime, it will be investigated fully and fairly.”

Hochul said newly released information raised serious questions about Cornell Police Department’s investigation and the Tompkins County district attorney’s 2024 decision not to prosecute. She said that information had “undercut my faith, and the public’s faith, in the District Attorney’s ability to effectively investigate and prosecute the case at this time.”

That was the governor’s stated rationale for changing who oversees the matter, not a court’s finding about the investigation or the underlying allegation. Hochul also said the young woman “deserves to know that every fact will be examined and justice pursued.”
What happened before the appointment?
- October 2024: The investigation concerned an alleged sexual assault at Cornell. The case was initially closed without charges that year.
- Shortly before October 1, 2026: Tompkins County District Attorney Matthew Van Houten reopened the investigation amid renewed public attention and criticism.
- October 1, 2026: Hochul appointed the attorney general’s office as special prosecutor, transferring oversight after the local office had resumed investigative work.
Calling the move a removal of Van Houten from office would overstate what happened. The appointment changed oversight of this case; it did not remove him from his elected position.

What is established—and what remains unresolved?
The case concerns an allegation, not an established finding of criminal conduct. The available reports describe an ongoing investigation and do not establish its eventual findings, whether evidence was presented to a grand jury, or whether charges will be brought. The special prosecutor’s appointment is a procedural step, not a verdict.
