At Cork District Court on 1 October 2026, Judge David Waters struck out three criminal-damage charges against James Spillane and rejected remanding him in prison as a substitute for psychiatric care. The Irish Examiner reported that concerns had been raised about Spillane’s ability to engage with the plea process, but no psychiatric report was available at the hearing.
What happened at Cork District Court
According to the Irish Examiner report by Liam Heylin, Spillane, 35, of no fixed address, had been in custody since 25 September. He appeared by video link at the 1 October hearing, facing three counts of criminal damage involving parked cars at Kyrl’s Quay in Cork City. The alleged damage took place at about 10:30 p.m. on 2 September.
The report said there was concern about whether Spillane could plead, and that a psychiatric report was not available after only a week in custody. Garda Jane Delahunty told the court she believed he was a danger to the public, gardaí and himself, and described him as vulnerable. Solicitor Eddie Burke said Spillane would begin answering questions and then trail off into murmured, irrelevant comments; Judge Waters agreed with that description based on his interaction with Spillane. These were accounts reported from the hearing, not an independent clinical assessment.
Why the judge rejected prison remand as a substitute for care
Judge Waters said he would strike out the three charges and would not engage in “some kind of preventative detention”. As reported by the Irish Examiner, he said: “I am not going to plug the gap for the State by remanding him in prison”. He also said he would not remand Spillane in custody as an alternative if psychiatric services were so poor that they could not provide care.

The remarks describe the judge’s decision in this case. They should not be read as a general rule that courts cannot remand an accused person in custody, or as a ruling that determines what must happen in other cases.
What Irish law says about fitness to be tried
The Criminal Law (Insanity) Act 2006 sets out how fitness to be tried is assessed. Under section 4, a person is unfit if, because of a mental disorder, they cannot understand the nature or course of proceedings sufficiently to plead, instruct a legal representative, make a proper defence, or understand the evidence.

For summary proceedings in the District Court, the court determines fitness. If it finds an accused unfit, the Act provides for adjournment and, subject to statutory conditions and medical evidence, orders for care or treatment in a designated centre. The reported account does not establish that Judge Waters made a formal finding under this fitness procedure.
How the Act addresses care for a prisoner
Section 15 of the Act provides a separate mechanism for transferring a prisoner from prison to a designated centre for care or treatment. It requires written certification that appropriate care or treatment cannot be provided in the prison. The Irish Examiner report does not say that this transfer route was sought or assessed in Spillane’s case, so it cannot explain the reported outcome.

What remains unknown
The available report does not establish whether there were later proceedings, what ultimately happened to the charges, whether Spillane received an independent diagnosis, or what care arrangements he may have had after the hearing. The accounts of his presentation in court and the concerns expressed there do not, on their own, establish a diagnosis.
