Consumers Sue Starbucks Over ‘Sugar-Free’ Drinks Containing Up to 21g of Sugar

A proposed consumer class action filed in Seattle alleges that eight Starbucks drinks marketed as “Sugar-Free” contain 13–21 grams of sugar in a venti serving. Starbucks disputes the claims, saying it adds no sugar and that the sugar comes from protein-boosted milk. The case remains unresolved: the reporting available as of October 7, 2026, establishes no ruling, class certification, or settlement.

Which Starbucks drinks are named in the lawsuit?

The complaint names eight protein drinks: hot and iced versions of the Sugar-Free Vanilla Protein Latte, Sugar-Free Caramel Protein Latte, Sugar-Free Vanilla Protein Matcha, and Sugar-Free Caramel Protein Matcha. Plaintiffs allege that venti servings contain 13–21 grams of sugar. That range is an allegation in the complaint, not an independent laboratory finding. Hagens Berman’s case announcement describes the allegations.

How much sugar do the drinks contain?

A dated menu example gives a more specific comparison. The Associated Press reported on October 5, 2026, that Starbucks’ U.S. menu listed 16 grams of sugar for a 16-ounce Sugar-Free Caramel Protein Matcha and 21 grams for its 20-ounce version. These are two sizes of one drink, not a complete nutrition table for all eight products; menu values and availability may change. The AP report provides the menu snapshot.

What do the plaintiffs and Starbucks say?

The plaintiffs’ position

The plaintiffs argue that “Sugar-Free” in a product name describes the finished beverage, which they allege contains sugar contributed by milk. The complaint alleges violations of federal labeling rules and state consumer-protection laws. Plaintiffs’ counsel says the case seeks repayment and corrective relief. Those are claims by the plaintiffs, not findings by a court. The plaintiffs’ counsel’s announcement outlines their position.

Starbucks’ response

Starbucks says it does not add sugar to these drinks, that the sugar comes from protein-boosted milk, and that the flavor syrups are sugar-free. A company spokesperson told the AP, “We believe these claims have no merit,” and said Starbucks intends to defend itself. The disagreement is partly about whether a name describing a drink as “Sugar-Free” can be reconciled with sugar naturally present in an ingredient, even if the company says it did not add sugar.

What do federal rules mean by “sugar free” and “no added sugar”?

They are distinct claims, and one does not automatically establish the other. Under the current text of 21 CFR § 101.60, a “sugar free” claim generally is permitted only when a food contains less than 0.5 gram of sugars per reference amount customarily consumed and per labeled serving. The rule also addresses ingredients that are sugars or are generally understood to contain sugars, as well as calorie-related statements. Where applicable conditions are not met, it specifies statements such as “not a reduced calorie food,” “not a low calorie food,” or “not for weight control.” Whether and how this regulation applies to the drinks’ names and presentation is part of the unresolved dispute.

  • Hot or Iced – Enjoy Starbucks vanilla flavoring throughout the year by adding it to comforting hot beverages or refreshing iced drinks, from morning vanilla coffee to afternoon iced lattes and tea.

“No added sugar” has separate conditions under the regulation. Among them, sugars and ingredients that functionally substitute for added sugars must not be added during processing or packaging. The claim also carries requirements for a calorie-status statement and directions to the nutrition panel, unless relevant calorie criteria are met. So Starbucks’ statement that it adds no sugar addresses a different question from whether the finished drink qualifies to be called “Sugar-Free.”

What is known about the case so far?

The complaint was filed in Seattle on October 2, 2026. The coverage available as of October 7 describes a proposed class action and does not establish that a judge has ruled on the claims, certified a class, or approved a settlement. The case’s central labeling question is therefore an allegation to be resolved, not a conclusion that Starbucks has violated the law. The filing-era case announcement and AP’s October 5 report describe the dispute.
