Constitutional Engineering: What Two Days of a Three-Copy Word List Taught Me About Agent Governance

I can’t responsibly claim what a two-day, three-copy word-list exercise taught me: the title gives no account of what the copies represented, which agents were involved, or what was observed. What can be said with confidence is that an agent constitution can state intended behavior and priorities, but it is not governance by itself. Reliable oversight also has to address the agent’s harness, tools, environment, permissions, and the people responsible for monitoring and review.

What an agent constitution can—and cannot—do

Anthropic describes a constitution as a natural-language document that establishes purpose and relationships. Its Claude’s Constitution gives the current constitution final authority when guidance conflicts, while treating it as a living framework rather than a mechanically applied legal code.

That makes a constitution useful for expressing behavioral priorities: what an agent should value, how it should handle competing instructions, and what kind of conduct is expected. But written guidance does not, on its own, determine what the deployed system can access or whether a person can intervene. Calling the document a constitution does not make it a technical permission boundary or an organizational control.

Governance covers more than the model

Anthropic describes an agent as a model that directs its own processes and tool use. The model is only one part of the system: the harness, tools, and environment also shape what it can do and how it can be overseen. A policy written for the model may not prevent a broadly permissioned tool or an exposed environment from enabling an unwanted action.

Anthropic identifies risks including reduced oversight, misread intent, unintended actions, and prompt injection. Its stated principles include human control, alignment with human values, secure interactions, transparency, and privacy. Turning those principles into practice requires checking the whole system, not just the instruction text.

Questions to ask about the deployed agent

  • Instructions: Are intended priorities and conflict handling stated clearly?
  • Harness: What actions can the surrounding system initiate, and where can a person review or stop them?
  • Tools: Are tool permissions limited to what the task requires? Does a consequential action need human approval?
  • Environment: Which files, accounts, services, or data can the agent reach?
  • Oversight: Who monitors use, investigates failures, and revises controls as the system changes?

These are operational questions, not a checklist prescribed verbatim by Anthropic. They follow from its account of the agent’s components and the risks those components can create.

A constitution and a risk framework solve different problems

Anthropic’s constitution focuses on intended model behavior and instruction priority. The NIST AI Risk Management Framework (AI RMF) provides an organizational approach to managing AI risk across a system’s lifecycle. NIST says governance is continual and intrinsic to effective AI risk management, with documented responsibilities, monitoring, review, and lifecycle attention as part of its Govern function.

How it operates Natural-language guidance for model behavior; it is described as a living framework, not a mechanically applied code. Governance and risk-management processes spanning the framework’s functions; voluntary and adapted to organizational context and resources.
Who must act The document informs intended model behavior; deployment teams still need to configure the surrounding system. Organizations assign responsibilities and conduct monitoring and review.
Review Anthropic describes the constitution as living; no fixed review cadence is stated in the document. Ongoing lifecycle attention is called for; no universal review interval is specified.

These are complementary lenses, not interchangeable products or formally equivalent standards. A behavioral document can clarify what an agent should do; organizational risk management addresses how people assess, deploy, monitor, and change the wider system.

Agent standards and identity controls are still developing

NIST’s 2026 AI Agent Standards Initiative includes work on industry-led standards, open protocols, security, and identity. Separately, the National Cybersecurity Center of Excellence (NCCoE) project on identity and authorization for AI agents is gathering feedback and developing implementation-oriented resources. Its project hub says it has received more than 600 comments on the concept paper and identifies an SP 1800-series practice guide as the intended final deliverable.

These are active efforts, not a finalized agent standard. The project’s comments count is a status figure reported by the NCCoE, not evidence that a particular control is effective. Organizations should distinguish current controls and guidance from resources still under development.

What the two-day exercise can support

A word-list experiment could illustrate how an agent responds to instructions or competing priorities, but the title alone does not establish what was tested or found. To make the first-person claim meaningful, an account would need to explain what each copy represented, how words were chosen or assigned, which agent was involved, what governance rule was tested, and what counted as an observation. It should also separate surprising results from expectations and report failures or ambiguous outcomes.

Even with those details, two days of observations would describe that particular exercise; they would not validate a general governance method. The broader lesson supported by the available evidence is narrower: explicit behavioral principles are useful, but dependable agent governance also requires controls and review around the system in which the model acts.
