Chris Selley: If Judges Can’t Tell What a “Fact” Is, We’re Really Cooked

Chris Selley’s headline is a pointed criticism of a B.C. Supreme Court decision involving the Drug User Liberation Front (DULF), not an objective finding that judges cannot distinguish fact from opinion. His argument turns on a sentence he attributes to Justice Catherine Murray: “Fact: There is a need for non-medicalized safer supply.” The distinction that matters is between Selley’s interpretation of the ruling and what the court’s reasons actually say.

What Selley’s column says the court decided

Selley reports that Justice Catherine Murray found section 5(2) of Canada’s Controlled Drugs and Substances Act inconsistent with rights protected by sections 7 and 15 of the Canadian Charter of Rights and Freedoms. The proceeding concerned DULF. The underlying judgment has not been independently verified here, so this account of the holding should be understood as Selley’s description rather than a confirmed summary of the court’s reasons.

The column reproduces the statement “Fact: There is a need for non-medicalized safer supply” and attributes it to Murray. Because the original reasons are not available to confirm the wording or its context, the quotation’s attribution chain runs through Selley’s column. It should not be treated as a verified direct quotation from the judgment without consulting the reasons.

What the “fact” criticism means—and what it does not establish

Selley objects to the court’s reported use of the word “Fact” in connection with the need for non-medicalized safer supply. That is the columnist’s characterization of the decision. It does not, by itself, establish that the judge treated a disputed policy claim as proven, or that the court made an error of law. To assess those claims, a reader would need the full reasons, including the surrounding passage, the evidence cited, and the legal issue the judge was deciding.

The distinction is important because a constitutional ruling and a policy assessment answer different questions. Whether a law or its application violates Charter rights is a legal question; whether a particular safer-supply model achieves its intended public-health outcomes is a separate empirical and policy question. The column’s reported wording alone cannot settle either question.

What remains unverified

  • The judgment’s exact holding and orders: Selley says section 5(2) was found inconsistent with Charter sections 7 and 15, but the court’s reasons and formal order have not been independently checked here.
  • The quotation’s context: The sentence attributed to Murray is reproduced by the column; the original judgment is needed to verify its wording and how it functions in the reasons.
  • The ruling’s reported length: Selley calls it 22,000 words. That count has not been independently checked and should be treated as the column’s claim, not a confirmed measurement.
  • Later procedural status: The available information does not establish whether the decision remains in force, was appealed, or has otherwise changed. The B.C. Supreme Court explains that released reserved judgments are posted on its website and that a formal order is the ruling’s formal expression, but that general guidance does not establish this case’s outcome: B.C. How to read the column alongside the case

Readers should keep three layers separate: Selley’s argument about the word “fact,” the court’s actual findings and orders, and broader arguments over safer-supply policy. The column is evidence of the first layer. The second requires the judgment and formal order; the third requires evidence beyond the quoted sentence. The B.C. Supreme Court directory lists Catherine Murray as a justice and gives her appointment date as October 19, 2016: B.C. Supreme Court: Judges.
