Commissioner of Central Excise and Service Tax, CESTAT Hyderabad set aside service tax on residential-complex construction services rendered before 1 July 2010, rejected Revenue’s challenge to allowing the Works Contract Composition Scheme during recomputation, and excluded specified individual buyer contracts to finish unfinished flats. It also rejected the extended limitation period, set aside penalties, and remitted the case for calculation of any tax and interest that remained due. The order does not cancel every possible liability: the result depends on the relevant service dates, contracts, and limitation period.
What did CESTAT Hyderabad decide?
The Tribunal’s order in MVV Builders v Commissioner of Central Excise and Service Tax, Appeals ST/22443 & 22488/2014, was pronounced on 25 November 2025. The dispute concerned residential-complex construction and a demand under Works Contract Service for financial years 2007–08 through 2011–12. The official CESTAT order directed the following:
As an Amazon Associate I earn from qualifying purchases.
- Set aside the residential-complex service-tax demand for services rendered before 1 July 2010.
- Reject Revenue’s appeal against allowing the Works Contract Composition Scheme during adjudication and recomputation despite no earlier election, following cited Hyderabad precedents.
- Set aside the demand within the otherwise relevant period for the specified individual contracts to complete and finish unfinished flats for buyers.
- Reject the extended limitation period, confine any otherwise surviving demand to the normal limitation period, set aside penalties, and retain applicable interest on surviving tax.
- Remit the matter to the Commissioner to compute tax and interest in accordance with the order.
The decision turns on distinct questions: when the service was rendered, whether the work was the builder’s own construction or a separate contract with a buyer, whether the composition scheme could be allowed at recomputation, and whether the longer limitation period was justified.
How did the demand reach the Tribunal?
The show-cause notice dated 28 September 2012 demanded ₹5,10,81,932 for 2007–08 to 2011–12 under Works Contract Services. The first adjudication confirmed the full demand and an equal penalty. After an earlier Tribunal remand, the revised Order-in-Original dated 14 March 2014 allowed the Works Contract Composition Scheme, confirmed ₹1,60,75,412, and dropped ₹3,50,06,520.
MVV Builders appealed the confirmed portion; Revenue appealed the dropped portion. Those figures describe the procedural history, not the amount ultimately payable after the 2025 order. The Commissioner was directed to calculate any surviving tax and interest afresh in line with CESTAT’s findings.
Why was construction before 1 July 2010 treated differently?
The Tribunal considered the explanation inserted in section 65(105)(zzzh) with effect from 1 July 2010. For the pre-amendment period, it treated a builder’s construction of its own project as self-service rather than a service supplied to another person under the residential-complex category. The order states: “Before this amendment, such service was only self service because the builder was constructing his own building and hence service was not provided to any other person.”
CESTAT relied on earlier decisions, including Aditya Homes, Aditya Construction Company India, and Krishna Homes, and referred to CBEC Circular No. 108/2/2009-ST dated 29 January 2009. Its holding is about services rendered before 1 July 2010 under the law it considered; it should not be reduced to a rule based only on when a buyer paid or when a completion certificate issued. Contract terms, service dates, payments, notices, and the applicable historical provisions may all matter in another dispute.

What did the Tribunal say about the composition scheme?
Revenue argued that Rule 3 of the Works Contract (Composition Scheme for payment of Service Tax) Rules, 2007 required MVV Builders to have exercised its option earlier. CESTAT rejected that challenge, following Hyderabad coordinate-bench decisions in Pragati Edifice and NCC Ltd. It accepted the approach that an assessee could opt for the scheme during recomputation even without an earlier election, with an opportunity to present its case.
Rank #3
This is the Tribunal’s treatment of the issue on this record. It does not establish that scheme formalities can be ignored in every case; the option, opportunity to be heard, and procedural context remain relevant.
Why were some buyer completion contracts excluded?
The record described MVV Builders selling undivided shares of land and semi-constructed houses, then entering separate contracts with individual buyers to complete and finish flats according to their requirements. Applying the version of section 65(91a) quoted in the order, CESTAT treated those contracts as outside construction-of-residential-complex service because the definition excluded construction for personal use.
Rank #4
The Tribunal said the result did not turn on whether the buyer personally occupied the flat or let it, referring to the statutory explanation and Modi & Modi Constructions. This finding concerns the particular individual contracts and record before it; it should not be assumed to cover every builder-buyer arrangement or construction contract.

The order describes the normal limitation period applicable to the dispute as 18 months and the extended period as five years where the specified aggravating grounds are present. CESTAT found no basis on this record to invoke extended limitation. It noted that ST-3 returns had been filed and that the department’s officer could scrutinize them and determine classification. Any otherwise surviving demand was therefore confined to the normal period measured from the show-cause notice.
The Tribunal also set aside all penalties under section 80. That penalty ruling is separate from its direction to retain applicable interest on any tax that remained due after recomputation.

CESTAT dismissed Revenue’s appeal and remitted the matter to the Commissioner solely to compute tax and interest consistently with its findings. The calculation must give effect to the pre-1 July 2010 exclusion, the applicable normal limitation period, the treatment of the specified buyer completion contracts, and the composition scheme ruling. The judgment therefore reduced the demand substantially in scope but did not itself state a final recomputed figure payable.
How should this ruling be applied to another construction-tax dispute?
The decision is most useful when the facts can be matched to its separate legal distinctions, rather than treated as a blanket exemption for residential construction. A review of a similar matter should identify:
- Service period: Separate services rendered before 1 July 2010 from later services; do not substitute payment or certificate dates for the period of service without examining the governing law and facts.
- Nature of the work: Distinguish a builder’s construction on its own project from a separate contract with an individual buyer to finish an unfinished flat.
- Statutory fit: Check the relevant historical versions of sections 65(91a) and 65(105)(zzzh), including the personal-use exclusion and the amendment effective date addressed by the order.
- Composition procedure: Examine whether an option was exercised, when it was raised, and whether the assessee had an opportunity to present the case. The ruling allowed the scheme at recomputation on its facts and cited precedents.
- Limitation record: Check the notice date, the normal period applicable to the period in dispute, filed returns, and evidence supporting any statutory ground for extended limitation.
The order is an adjudication of the appeals on their record, not a client-specific opinion. Whether it controls a live dispute also depends on the contract and notice facts and on any later appeal, stay, or subsequent ruling. The official order is the primary source for the holdings and final directions.
