The Chandigarh Bench of the Central Administrative Tribunal (CAT) quashed the termination of Sunil Kumar, a Data Entry Operator in the Office of the Accountant General (A&E), Haryana. News reports say the tribunal found that the termination was punitive but Kumar had not received notice of the allegations or a regular inquiry in which he could answer the evidence. It ordered reinstatement without back wages.
What led to Sunil Kumar’s termination?
Kumar was appointed as a Data Entry Operator in 2015 on the recommendation of the Staff Selection Commission (SSC). The Tribune reported that his appointment included a two-year probation period ending on August 19, 2017, and that no extension order was issued.

The department later said it found discrepancies in photographs and handwriting in the recruitment records. It reportedly referred the matter to the SSC and the Central Forensic Science Laboratory (CFSL), Chandigarh, and relied on findings that photographs, signatures and handwriting did not match those of the person who appeared for the examination. These were the department’s allegations and account of its evidence; they should not be treated as a finding that Kumar impersonated another candidate.

Kumar denied impersonation and said he had taken the examination himself. The Deputy Accountant General (Administration), Lekha Bhawan, Chandigarh, issued his termination order on September 28, 2018. The Tribune’s report describes the dispute and the tribunal’s ruling.

Why did the CAT quash the termination?
As reported, the CAT found that Kumar had not been given notice setting out the allegations or a meaningful opportunity to explain them. It also found that no regular inquiry had tested the material relied on by the department in Kumar’s presence. The tribunal treated the termination as punitive in nature and quashed it.
The reported reasoning is specific to this case. It does not establish that every probationer is automatically entitled to a full disciplinary inquiry. LawLens identifies the case as Sunil Kumar v Comptroller and Auditor-General of India and gives the decision date as September 22, 2026; its summary links to the original judgment.

What relief did Kumar receive?
The CAT directed the department to reinstate Kumar, but did not award salary for the period he had not worked. It directed that the intervening period count for seniority, promotion and notional increment. Hindustan Times also reported the core result and the denial of back wages.

Yes. The reported order leaves the department at liberty to take appropriate action under the rules. The ruling therefore quashes the termination on procedural grounds; it does not clear Kumar of the impersonation allegation or establish that the allegation was false.
